CHINA x GOOGLE

Which will the changes be in States in reason of the Internet?

The Chinese Government mentioned Google for the first time directly in the controversy between the Chinese authorities and the company, and he reminded that the American company "is not an exception" when accomplishing the laws of the country.



"The foreign firms should respect the laws and regulations of China, to respect the traditions and the Chinese public's habits and to assume the corresponding social responsibilities, and, certainly, Google is not an exception", it said today, in press conference, Ma Zhaoxu, spokesperson of the Chinese Ministry of External Subjects.



In the center of the dispute between Google and China is an explosive question. Which the size of the state power in the virtual world?



The Chinese government's argument has foundation in the state sovereignty. The sovereignty is a beginning of Public Right that justifies the submission of all to the valid legal norms originating from of State. The argument of Google is the freedom. But the freedom is not an absolute value nor in the USA, because even in the Occident the citizens and companies are subject to the state Law.



The one that Google intends is to do China to adopt the same legal Americans patterns. That is an absurdity, because the legislation of a country doesn't subordinate the one of another country. Besides, a company cannot choose which will be the legislation that will accomplish inside of another country. In each country that operates the company it is subject to the local legislation.



Can a company subordinate a State? Can Google want China to adopt in his territory the same American laws? Under the optics of the modern Constitutional Right the answer the these two questions are NOT.

However, the own State is an institution that serves to concrete purposes and it is subject to the social dynamics.Therefore, it can suffer mutations along the history (this has already been happening). But these mutations are slow and certainly they won't just affect a country. The changes caused by the Internet will affect all of States. The USA will also be affected, it will have to leave of to act as an empire above the other countries and to pass to be a State among same.
