Human Rights Council Special Session on the Occupied Palestinian Territories, July 6, 2006

(Geneva, July 6, 2006) – This first special session of the Human Rights Council provides an important opportunity to address the current humanitarian and security crisis in the Occupied Palestinian Territories (OPT), especially in Gaza, where Israeli military actions have led to the killing of Palestinian civilians, as well as periodic shortages of food, fuel, electricity, water and medicine, and Palestinian armed groups have committed serious violations of international humanitarian law. The council should address abuses by both sides to the conflict. In addition, Human Rights Watch hopes that this will be the first of many special sessions of the council, and that the council will demonstrate its political objectivity by providing an equally timely response to the many other serious and deteriorating human rights situations around the world.

According to the United Nations Office for the Coordination of Humanitarian Affairs (OCHA), in May and June 2006, 87 Palestinians were killed in Gaza and almost 300 injured, mostly from Israeli fire but also due to clashes between Palestinian armed groups and individuals. Many of those killed in June were Palestinian civilians who died during Israeli air force “targeted killings,” which either missed their targets entirely or caused significant civilian casualties. During this period, Palestinian groups have indiscriminately fired numerous Qassam rockets at Israeli towns.

Gaza’s population of 1.5 million is currently facing significant hardships due to the Israeli blockade on Gaza’s few crossing points, Israel’s destruction of Gaza’s only electric plant and Israel’s withholding of Palestinian tax revenues, coupled with international donor aid cuts after the swearing-in of the Hamas-led Palestinian Authority in March 2006. As a result, for the fifth month in a row, the Palestinian Authority has been unable to pay most salaries to its approximately 160,000 civil servants.

Even though Israel unilaterally withdrew its troops and settlements from Gaza in 2005, it continues to have obligations as an occupying power in Gaza under the Fourth Geneva Convention because of its almost complete control over Gaza’s borders, sea and air space, tax revenue, utilities, population registry, and the internal economy of Gaza. At a minimum, Israel continues to be responsible for the basic welfare of the Palestinian population in Gaza.

Since June 25, Palestinian armed groups have abducted and killed an Israeli settler in the West Bank and are currently holding Israeli soldier Corporal Gilad Shalit hostage, whom they have offered to release in exchange for some of the Palestinians imprisoned by Israel. A hostage is a person held in the power of an adversary in order to obtain specific actions, such as the release of prisoners, from the other party to the conflict. Holding persons as hostages and the summary execution of anyone held captive are war crimes.

Since the capture of Corporal Shalit, the Israeli army has re-entered parts of the Gaza Strip. The air force has destroyed government buildings, bridges and the only domestic electricity plant in Gaza, which is essential to power the water system, sewage treatment and medical services in Gaza; the laws of war prohibit attacks on “objects indispensable to the survival of the civilian population.” Israeli forces have also detained elected members of the Palestinian government and legislature, a step which has undermined the ability of the Palestinian Authority to function.

As well as actual bombing raids, Israeli military airplanes have conducted nightly sonic booming raids over Gaza, apparently with the aim of making the civilian population fearful that actual bombing is under way. Article 33 of the Fourth Geneva Convention prohibits “measures of intimidation” against the civilian population.

Since late 2005, Palestinian armed groups have indiscriminately fired hundreds of Qassam rockets into Israel, in violation of the laws of war, seriously injuring several Israeli civilians, damaging civilian infrastructure and causing fear among the civilian population living near the Gaza border. On July 4, a Qassam rocket damaged a high school, empty at the time, in Ashkelon in southern Israel. Many of these rockets were launched near civilian areas, placing Palestinian civilians at risk in the event of an Israeli response. Parties to the conflict must, to the extent feasible, avoid locating military objects within or near densely populated areas.

In a stated bid to stop the Qassams, Israel has fired more than 8,000 artillery shells into northern Gaza since late 2005, including around 5,000 in a one-week period. According to the Palestinian Ministry of Health, this shelling has killed 47 Palestinians, both members of armed groups and civilians, including 11 children and five women, and has injured 192 others. The shelling has also displaced residents of northern Gaza and severely interrupted their daily lives. Under the laws of war, attacks are indiscriminate if they are not directed at a specific military objective and attacks against military targets must not cause harm to the civilian population that is disproportionate to the expected military gain. All feasible precautions must be taken to avoid harm to civilians or civilian loss of life. According to a preliminary Human Rights Watch field investigation, the pattern of Israeli artillery fire into northern Gaza is indiscriminate because, given the type of weapon and location of the attacks, Israel has failed to distinguish between combatant and civilian.

Human Rights Watch calls for an immediate, effective and independent investigation, which may comprise a number of the relevant U.N. Special Rapporteurs, as well as additional international humanitarian law, military, ballistic and forensic experts, to carry out an on-site investigation into Israel’s military actions in Gaza, as well as Palestinian rocket fire into Israel. All parties should allow the investigative team full access to all necessary locations, evidence and individuals.

Human Rights Watch also calls on Israeli security forces and Palestinian armed groups to respect international humanitarian law and human rights principles. As an occupying power in Gaza, Israel remains responsible for the basic welfare of the Palestinian population in Gaza, in particular the health, educational and humanitarian needs of the population, to the extent these are affected by Israeli restrictions. Israel must ensure that it does not fire indiscriminately in civilian areas, that attacks on military objects do not cause disproportionate civilian harm, and that it does not target objects indispensable to the survival of the civilian population. In addition, Israel should cease using aircraft intending to cause fear among the population by creating sonic booms over the Occupied Palestinian Territories. Palestinian armed groups should ensure Corporal Shalit’s well being and stop making demands as a condition for his release, avoid locating military objects in densely populated areas, and should stop firing inherently indiscriminate Qassam rockets into Israel.

Endless repetitions of the alleged fact that 1,000 missles have been fired into Israel in the past few days, but no mention of how many 500 pound bombs, heavy artillary shells, air to ground missles, and missles and shells from warships have been landed in Lebanon or Gaza. The deaths of Lebanese and Palestinians are mentioned matter of factly, those of Israelis as a tragedy. The example of the kidnapped soldiers is repeated endlessly as a justification of Israel's rampage, but no mention is made of how many Arabs have been kidnapped by the IDF or the Mossad. No wonder so many Americans are so ignorant and confused.

ACTION ALERT: Stop Israel's Attacks on Gaza & Lebanon


BACKGROUND: Israel is using weapons supplied by the United States to target Palestinian & Lebanese civilians and civilian infrastructure in the Gaza Strip and Lebanon in violation of the US Arms Export Control Act and the Geneva Conventions. * On July 12th, Israel killed 23 Palestinians in the Gaza Strip with missiles fired from aircraft and shells fired from tanks. Israel killed 9 members of one family in a missile strike on a house near Gaza City.
* On July 12th, Israel launched a massive invasion of Lebanon. Israeli aircraft fired missiles targeting civilian infrastructure, including bridges, roads, a mosque, a community center, and the Beirut International Airport, and the Israeli navy is blockading Lebanon's ports. Israel has killed at least 50 Lebanese civilians and injured more than 100, including entire Lebanese families of 10 and 7 people killed in the villages of Dweir and Baflay.
* On June 27th, Israel launched a massive invasion of the Gaza Strip. Israeli aircraft fired missiles targeting civilian infrastructure. In illegal acts of collective punishment, Israel demolished three key bridges, the Gaza Strip's only electricity generation plant, and part of a university, thereby endangering Palestinian human rights to food, water, health, electricity, education, and freedom of movement. Israeli Prime Minister Ehud Olmert admitted that the purpose of these measures is to "apply pressure" to the civilian population of the Gaza Strip.
* On June 20th, Israeli aircraft fired at least one missile at a car in an extrajudicial assassination attempt on a road between Jabalya and Gaza City. The missile missed its intended target and killed three Palestinian children and wounded 15.
* On June 13th, Israeli aircraft fired missiles at a van in an extrajudicial assassination of two Palestinians in Gaza City. A second barrage of missiles fired shortly afterward killed nine Palestinian bystanders.
* On June 9th, Israel shelled a beach in Beit Lahiya killing 8 civilians and injuring 32. At the site of the killing, Human Rights Watch found evidence of a 155mm artillery shell consistent with those fired from an Israeli M-109 Self-Propelled Artillery. Israel's human rights violations in the Gaza Strip and Lebanon are being committed with US weapons financed by US tax dollars:
The Israeli air force fighter squadrons are composed of Lockheed Martin F-16I Fighting Falcons and Boeing F-15Is, which fire US-manufactured AMRAAM, Sidewinder, and Sparrow missiles. From 2000-2005, the United States licensed to Israel at least $1.062 billion of spare parts, engines, and missiles for its F-15 and F-16 fighter planes.
From 2000-2005, the United States licensed to the Israeli navy more than $572 million worth of patrol boat, ship, and submarine components and spare parts, torpedoes, and sonar equipment.
From 2000-2005, the United States licensed to Israel more than $348 million worth of tanks, components, and spare parts.
From 2000-2005, the United States licensed to Israel $69,163 worth of M-109 spare parts and 155mm artillery shells.

Israel's summer of killing civilians and destroying civilian infrastructure in the Gaza Strip is a clear reminder that Israel remains the occupying power of the Gaza Strip despite last year's "unilateral disengagement". Living under military occupation, the Palestinians of the Gaza Strip are "protected persons" under the terms of the Geneva Conventions. Israel's targeting of civilians and civilian infrastructure in the Gaza Strip and Lebanon is a violation of the Geneva Conventions and constitutes war crimes.
In addition, by using US-supplied weapons to commit these atrocities, Israel is violating the terms of the US Arms Export Control Act and Foreign Assistance Act. The Arms Export Control Act restricts the use of US weapons to legitimate self-defense and internal policing; US weapons cannot be used to attack civilians in offensive operations. The Foreign Assistance Act prohibits US aid of any kind to a country with a pattern of gross human rights violations.
TAKE ACTION: Hold Israel to account for its killing of civilians and destruction of civilian infrastructure in the Gaza Strip and Lebanon.

We heard that before - in 1982. The vicious invasion of Lebanon that killed 20,000 people was justified on the grounds that it would end rocket attacks on Israel - which had already practically ceased at the time of the invasion. Instead, it created a new generation of embittered enemies of zionism who make up the current "terrorist" militias. The present Israeli rampage is destroying the childhoods of tens of thousands of young Lebanese who will be armed enemies of Israel, seething with rage, six or seven years from now.

False Cries of antisemitism

When Harvard Law Professor and self-described civil libertarian Alan Dershowitz asked Governor Arnold Schwarzenegger to stop the University of California Press from publishing Beyond Chutzpah, he unleashed a pre-publication firestorm. It becomes clear after only a few chapters why Dershowitz sought to suppress this book. Finkelstein so thoroughly demolishes Dershowitz’s credibility that, if this were a boxing match, the referee would have stopped the fight in the third round and declared Finkelstein the winner by technical knockout. But on the larger question of whether Finkelstein fulfilled his goal of “lifting the veil surrounding the Israeli-Palestine conflict,” the answer is more complicated.

Alan Dershowitz’s bestselling book, The Case for Israel, offered a vigorous defense to critics of Israel’s treatment of Palestinians in the Occupied Territories. The book won wide praise from leading academics, journalists and book reviewers from across America.

It was precisely this uncritical response to what Norman Finklestein saw as a deeply flawed work that led him to write a book debunking it. Finkelstein previously raised hackles among mainstream Jewish leaders with his book, The Holocaust Industry, and thanks to Dershowitz’s attempt to halt its publication, Beyond Chutzpah is likely to arouse even greater controversy.

From the initial publication of The Case for Israel, red flags should have been raised over Dershowitz’s capacity to adequately research the book.. Dershowitz publishes nearly a book a year in addition to his law school duties, and also maintains an active public speaking schedule. He apparently fit the book into his schedule by ignoring facts that conflicted with his arguments and by routinely misstating the historical record. Finkelstein reveals that The Case for Israel was as much ideologically-driven as a book by right-wing pundit Ann Coulter, only that in Dershowitz’s case, his Harvard pedigree gave his dishonest ramblings academic and mainstream credibility.

Although Finkelstein acknowledges early in his book that The Case for Israel is so rife with inaccuracies that it is not necessary to write a book refuting them, he spends most of the book doing precisely that. The author is so angry at the credibility assigned to Dershowitz, that he feels obligated to provide great detail refuting Dershowitz on every issue --from Israel’s use of lethal force, its denial of Palestinian rights, the demolitions of Palestinian homes, its opposition to Palestinian nonviolence and on and on.

But unlike the famous historian Arnold Toynbee, whose inventions of historical fact nevertheless became the basis for much of his era’s knowledge of world history, Alan Dershowitz never had credibility as an independent arbiter of the facts. Dershowitz is a passionate supporter and defender of Israel and, as he does in his criminal defense work, zealously represented his client regardless of their actual innocence.

There is so much written on the Israel-Palestine conflict, in books, magazines, newspapers, and on the Internet, that it is hard to believe that any reader turned to Dershowitz’s The Case for Israel for intellectual guidance. Like Ann Coulter’s bestselling books, Dershowitz’s work was bought and read by those already agreeing with his views. The sympathetic book reviews received by Dershowitz did not influence public opinion or America’s staunchly pro-Israel Middle East policy.

Many readers will enjoy Finkelstein’s destruction of the intellectual basis for The Case for Israel, as Dershowitz is revealed as an arrogant blowhard who needs to be taken down a notch. But while Finkelstein devotes chapter after chapter undermining the assertions of an author he quickly proves lacks credibility, he spends too little time focusing on his stated goal of “lifting the veil” surrounding Israel and Palestine.

Although anger at Dershowitz’s falsehoods fuels Beyond Chutzpah, Finkelstein has two other targets: America’s mainstream Jewish establishment and the nature of the state of Israel.

As reflected in his chapter titled “Crying Wolf,” Finkelstein argues that mainstream American Jewish organizations falsely raise the specter of Anti-Semitism in order to insulate Israel from criticism. Finkelstein notes how ADL leader Abraham Foxman and other neo-conservatives inappropriately raise the anti-Semitic banner, and Beyond Chutzpah even charges that “American Jewish elites, alongside Israel, are the main fomenters of anti-Semitism in the world today.”

Really? That sounds like conservatives arguing that widespread poverty and misery in Africa and high crime rates among African-Americans here are the main fomenters of racism. As a child of Holocaust survivors, Finkelstein knows well how the Nazi Party blamed Jews for anti-Semitism, and this argument is beneath a man of his intellectual talents.

False charges of racial, gender, or religious bias does not mean that such attitudes have disappeared. While Finkelstein sees anti-Semitism being used as a cover for insulating Israel from criticism, he does not discuss how anti-Jewish attitudes have fueled hostility toward Israel and continue to perpetuate cultural stereotypes in this country.

Moreover, the reason American foreign policy tilts so heavily toward Israel has nothing to do with false cries about anti-Semitism. Rather, it is a function of a campaign finance system that allows pro-Israel backers to support pro-Israel candidates in Senate and House races across the nation.

Ultimately, Finkelstein’s vehement attacks on Israel undermine his stated goal of “lifting the veil” about the truth of the Israeli-Palestinian conflict. This is unfortunate, because Finklestein’s scholarship is rigorous, his writing engaging, and he makes many criticisms about Israel that seldom appear in print (his critique of the Israeli Supreme Court is particularly illuminating).

But in order to “lift the veil,” Finkelstein needed to write a book that reached beyond the already converted. When he blames Jews and Israel for anti-Semitism, and claims without documentation that the “Zionist movement ethnically cleansed Palestine in 1948” (conventional history has Israel being attacked by its Arab neighbors after winning independence that year, and then winning the war for its survival), he loses credibility with those whose opinions are not fixed and who could potentially be won to his side.

Finkelstein has won the battle against Alan Dershowitz, and his appendix establishes what the Harvard Law School Administration refused to admit: that The Case for Israel is built on plagiarism. But the vehemence and anger that went into his battering of a celebrity writer overwhelms Finkelstein’s larger purpose.

Beyond Chutzpah is likely to leave its readers opinions of the Israeli-Palestinian conflict unchanged, if not further polarized.
