We live here together, raise children, attend schools, drive on the same roads, and rely on each other in so many ways. Why should there be this artificial division between those who are "legal" and those who are not?

U.S. immigration policy is a lie. There is no intent or desire to send immigrants back from whence they came. There is only the intent and desire to terrorize immigrant workers so that they cannot assert their rights.

A house divided against itself cannot stand. If a large group of people is functioning as citizens and yet still does not have rights, how can that division be good for our nation? End the hypocrisy. Full amnesty and citizenship rights for undocumented persons now!

We Will Make This the "Land of the Free"

Twelve million people who live and work and raise children here are not yet free. Instead, they live under the threat of immediate deportation, separating them from their homes, jobs and families.

Some in Congress would have this threat turned from deportation to immediate imprisonment. That is what these demonstrations are all about: defending real freedom, right here in America.

Remember that before the Civil War, when Francis Scott Key wrote his immortal lines, we were a nation that condoned and promoted slavery. Those slaves were not citizens, either, and when they tried to escape, a well-organized system of enslavement attempted to capture and punish them.

It is easy to talk about freedom if you take all of the people who are not free and draw a line between them and everyone else, and then claim that only the people on your own side of the line actually matter. But the only way you can actually fight _for_ freedom is to demand freedom for those who don't already have it! Otherwise, you are using the word freedom to mean _your_ freedom, and to hell with everyone else! Put _that_ in your Star-Spangled Banner and smoke it, freedom lover.

INA: ACT 237 - GENERAL CLASSES OF DEPORTABLE ALIENS

Sec. 237 1/ [8 U.S.C. 1227]


(a) Classes of Deportable Aliens.-Any alien (including an alien crewman) in and admitted to the United States shall, upon the order of the Attorney General, be removed if the alien is within one or more of the following classes of deportable aliens:


(1) Inadmissible at time of entry or of adjustment of status or violates status.-


(A) Inadmissible aliens.-Any alien who at the time of entry or adjustment of status was within one or more of the classes of aliens inadmissible by the law existing at such time is deportable.

(B) 2/ Present in violation of law.-Any alien who is present in the United States in violation of this Act or any other law of the 2b/ United States, or whose nonimmigrant visa (or other documentation authorizing admission into the United States as a nonimmigrant) has been revoked under section 221(i), is deportable.

(C) Violated nonimmigrant status or condition of entry.-

(i) Nonimmigrant status violators.-Any alien who was admitted as a nonimmigrant and who has failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248, or to comply with the conditions of any such status, is deportable.


(ii) Violators of conditions of entry.-Any alien whom the Secretary of Health and Human Services certifies has failed to comply with terms, conditions, and controls that were imposed under section 212(g) is deportable.

(D) Termination of conditional permanent residence.-

(i) In general.-Any alien with permanent resident status on a conditional basis under section 216 (relating to conditional permanent resident status for certain alien spouses and sons and daughters) or under section 216A (relating to conditional permanent resident status for certain alien entrepreneurs, spouses, and children) who has had such status terminated under such respective section is deportable.

(ii) Exception.-Clause (i) shall not apply in the cases described in section 216(c)(4) (relating to certain hardship waivers).

(E) Smuggling.-

(i) In general.-Any alien who (prior to the date of entry, at the time of any entry, or within 5 years of the date of any entry) knowingly has encouraged, induced, assisted, abetted, or aided any other alien to enter or to try to enter the United States in violation of law is deportable.


(ii) Special rule in the case of family reunification.-Clause (i) shall not apply in the case of alien who is an eligible immigrant (as defined in section 301(b)(1) of the Immigration Act of 1990), was physically present in the United States on May 5, 1988, and is seeking admission as an immediate relative or under section 203(a)(2) (including under section 112 of the Immigration Act of 1990) or benefits under section 301(a) of the Immigration Act of 1990 if the alien, before May 5, 1988, has encouraged, induced, assisted, abetted, or aided only the alien's spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.

(iii) Waiver authorized.-The Attorney General may, in his discretion for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, waive application of clause (i) in the case of any alien lawfully admitted for permanent residence if the alien has encouraged, induced, assisted, abetted, or aided only an individual who at the time of the offense was 3/ the alien's spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law. 4/

(F) [repealed] 5/

(G) Marriage fraud.-An alien shall be considered to be deportable as having procured a visa or other documentation by fraud (within the meaning of section 212(a)(6)(C)(i)) and to be in the United States in violation of this Act (within the meaning of subparagraph (B)) if-


(i) the alien obtains any admission into the United States with an immigrant visa or other documentation procured on the basis of a marriage entered into less than 2 years prior to such entry of the alien and which, within 2 years subsequent to any admission of the alien in the United States, shall be judicially annulled or terminated, unless the alien establishes to the satisfaction of the Attorney General that such marriage was not contracted for the purpose of evading any provisions of the immigration laws, or

(ii) it appears to the satisfaction of the Attorney General that the alien has failed or refused to fulfill the alien's marital agreement which in the opinion of the Attorney General was made for the purpose of procuring the alien's admission as an immigrant.

(H) WAIVER AUTHORIZED FOR CERTAIN MISREPRESENTATIONS. -- The provisions of this paragraph relating to the removal of aliens within the United States on the ground that they were inadmissible at the time of admission as aliens described in section 212(a)(6)(C)(i), whether willful or innocent, may, in the discretion of the Attorney General, be waived for any alien (other than an alien described in paragraph (4)(D)) who-

(i) 5a/ (I) is the spouse, parent, son, or daughter of a citizen of the United States or of an alien lawfully admitted to the United States for permanent residence; and

(II) 5a/ was in possession of an immigrant visa or equivalent document and was otherwise admissible to the United States at the time of such admission except for those grounds of inadmissibility specified under paragraphs (5)(A) and (7)(A) of section 212(a) which were a direct result of that fraud or misrepresentation.



(ii) 5a/ is an alien who qualifies for classification under clause (iii) or (iv) of section 204(a)(1)(A) or clause (ii) or (iii) of section 204(a)(1)(B).

A waiver of deportation for fraud or misrepresentation granted under this subparagraph shall also operate to waive deportation based on the grounds of inadmissibility directly resulting from such fraud or misrepresentation.

(2) Criminal offenses.-

(A) General crimes.-

(i) Crimes of moral turpitude.-Any alien who-

(I) is convicted of a crime involving moral turpitude committed within five years (or 10 years in the case of an alien provided lawful permanent resident status under section 245(j)) after the date of admission, and

(II) is convicted of a crime for which a sentence of one year or longer may be imposed.

(ii) Multiple criminal convictions.-Any alien who at any time after admission is convicted of two or more crimes involving moral turpitude, not arising out of a single scheme of criminal misconduct, regardless of whether confined therefor and regardless of whether the convictions were in a single trial, is deportable.

(iii) Aggravated felony.-Any alien who is convicted of an aggravated felony at any time after admission is deportable.

(iv) High Speed Flight.-Any alien who is convicted of a violation of section 758 of title 18, United States Code, (relating to high speed flight from an immigration checkpoint) is deportable.


(v) Waiver authorized.-Clauses (i), (ii), (iii), and (iv) shall not apply in the case of an alien with respect to a criminal conviction if the alien subsequent to the criminal conviction has been granted a full and unconditional pardon by the President of the United States or by the Governor of any of the several States.

(B) Controlled substances.-

(i) Conviction.-Any alien who at any time after admission has been convicted of a violation of (or a conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)), other than a single offense involving possession for one's own use of 30 grams or less of marijuana, is deportable.

(ii) Drug abusers and addicts.-Any alien who is, or at any time after admission has been, a drug abuser or addict is deportable.

(C) Certain firearm offenses.-Any alien who at any time after admission is convicted under any law of purchasing, selling, offering for sale, exchanging, using, owning, possessing, or carrying, or of attempting or conspiring to purchase, sell, offer for sale, exchange, use, own, possess, or carry, any weapon, part, or accessory which is a firearm or destructive device (as defined in section 921(a) of title 18, United States Code) in violation of any law is deportable.

(D) Miscellaneous crimes.-Any alien who at any time has been convicted (the judgment on such conviction becoming final) of, or has been so convicted of a conspiracy or attempt to violate-


(i) any offense under chapter 37 (relating to espionage), chapter 105 (relating to sabotage), or chapter 115 (relating to treason and sedition) of title 18, United States Code, for which a term of imprisonment of five or more years may be imposed;

(ii) any offense under section 871 or 960 of title 18, United States Code;

(iii) a violation of any provision of the Military Selective Service Act (50 U.S.C. App. 451 et seq.) or the Trading With the Enemy Act (50 U.S.C. App. 1 et seq.); or

(iv) a violation of section 215 or 278 of this Act, is deportable.

There is even a section related to class in the law. If an immigrant brings over a million dollars to invest, they will get a green card. See here:

Visas shall be made available, in a number not to exceed 7.1 percent of such worldwide level, to qualified immigrants seeking to enter the United States for the purpose of engaging in a new commercial enterprise (including a limited partnership)— "

"(C) Amount of capital required
(i) In general Except as otherwise provided in this subparagraph, the amount of capital required under subparagraph (A) shall be $1,000,000. The Attorney General, in consultation with the Secretary of Labor and the Secretary of State, may from time to time prescribe regulations increasing the dollar amount specified under the previous sentence. "

Thus, a millionaire boss can come into America... but a regular worker cannot. So the worker pays a few thousand to a smuggler to come in without status.

Slavery Was Protected by Laws, Too

Slaves were not citizens, but they were still subject to the laws of the nation, and those laws included recapture and punishment if they escaped.

Whoever posted all of this legislation as some kind of argument against immigration reform probably would have condemned escaped slaves as lawbreakers, as well.
Because the new slavery is wage slavery, and the new slave is the immigrant worker who works two or three jobs at low wages just to get by.

The escape from wage slavery is organization, unionization and legislation. Present immigration laws and policies are designed to prevent immigrants from participating in all of the above.

People who cite the present laws as some kind of argument against immigrant rights (i.e., because undocumented persons are "lawbreakers") are, first of all, begging the question, because it is precisely _changes_ to those laws that we are discussing and promoting through these demonstrations.

But, more fundamentally, when laws are so unjust as to force people to choose between starvation or death by political oppression on the on hand, or breaking those laws on the other, then we cannot blame the people who break the laws; we have to blame the people who make the laws. And, if there is no real ability or intent to enforce the laws, except selectively against politically active immigrants and their supporters, then we have to point out that hypocrisy, and work toward a more honest and consistent public policy.

So let me say it: you super-patriotic flag-wavers who stand so self-righteously on the laws of the land as they presently are, are not good citizens, and are not good human beings. You are smug and self-satisfied defenders of your own privilege against the rights of all of those who are not in your group.

And you are also dupes, because people much more privileged than you are the real beneficiaries of all of the human exploitation that the present policies attempt to guarantee. The exploited state of undocumented persons is used to drive down wages across the board, and it is also being used to justify the creation of a police state that will soon rob you of your rights just as it is now robbing immigrants of theirs. Wake up.

How many times do I have to say it? The Supreme Court has ruled time and time again that the protections in the Constitution apply to ALL RESIDENTS, not all citizens, not all "legal" residents. I say again, defend THAT! And read the thing before you run off at the mouth.

But the framers of the Constitution, unlike you and the rest of the zenophobes, recognized that there are _people_ who are not citizens. When the Constitutional framers meant "citizen," they said "citizen."

See if you can find what Constitutional rights are restricted to citizens. Hint--voting's not one of them. Who gets to vote is up to the states, which could empower people without documents to vote. Or do you oppose states' rights, too?

A bit more to mull over. Paul Revere had no concept of "legal" and "illegal" residents. He had no concept of Manifest Destiny or California. And if California reverted to the culture of its European roots, you'd all be speaking Spanish. If you want to revert to the culture of the conquerers here, start thinking Spain, Catholicism, Moorish architecture, colorful clothes, zarzuelas, and Lope de Vega. Anglos and the English language are real newbies to the California scene. If you want Anglo dominant culture and English language, go to the east coast.

Funny how you want to lay claim on the US Constitution for all the illegal aliens but... you do NOT think that they have to obey our laws regarding illegal immigration.

you may be interested to know that the U.S. now has the second highest infant mortality level of any so-called first world nation (second only to Latvia).

Now, I am sure that you are not sitting by idly while this happens, are you? No, you are demanding better health care for the African Americans whose citizenship was earned through slavery, and whose obscenely high infant mortality levels are what is driving the U.S. decline to near third world status on this very important indicator.

What? You're not doing that? Well, then, how can we take you seriously when you lament the (very real) present U.S. decline?

If you were candid, you would admit that having to rub shoulders with third world *people* is what you are really objecting to when you worry out loud about the U.S. becoming a third world country. You simply don't want to share "your" space with people who don't look like you and who don't speak the same language. And that, my dear citizen, is not a very nice attitude to have toward your fellow human beings.

The various quality of life indicators that make the U.S. either first or third world have no clear relationship to the presence or absence of undocumented persons. They do, however, have absolutely *everything* to do with the disparity of wealth and privilege in this country. And providing rights to undocumented persons would go a *long* way toward remedying that fundamental disparity - not just for the undocumented, but for everyone, includng you, dear citizen.

So, my suggestion to you is:

Become more informed
Show more concern for your fellow human beings
Root out the prejudice that is polluting your soul

I apologize, I retract that last statement. It was out of line. I let myself get carried away. I am better than that.
But I do still stand by the rest of my thoughts.

I do not have hate in my heart. Nor am I racist. I am a realist.
I am not for the felony law. Nor am I for a blanket amensty eiether. I do though want the borders of my country closed. And illegal immigration to be controlled. To many bad elements come in with the good people. There needs to be a controlled enviroment. Plain and simple.

Continuing Dialogue Between Citizens

I cannot accept your apology, because I am merely a rogue gringo, and therefore not the offended party. But I do respect your ability to engage in self-criticism.

We are in agreement about the right of the U.S. to pass and enforce laws regarding immigration. Every nation has a right to impose certain requirements upon those wishing to pass across its borders. That is a basic principle that applies to any integrated entity, whether it be a cell, a political organization, or a nation. If a cell, for example, did not have selective transport of materials through its membrane, it would very quickly cease to exist.

But what I would like you to consider is whether the present policies are the best policies for our nation. To me, it seems that there is a de facto policy of allowing large numbers of people to immigrate and work here, and a nominal (legal) policy that says that none of these people should be here at all. And the contradiction between the stated and actual policy masks a hidden agenda to import and maintain a large class of resident workers who have rights that are inferior to everyone else's.

Democracy depends upon public understanding, and when the true intent of a policy is masked by rhetoric, it prevents the functioning of our democracy. If the true intent of the present policy were to be understood, very few people living in the U.S. would support it.

Regarding "too many bad elements" coming in with the good people, consider how much easier it will be to find these bad elements (e.g., narcotics traffickers, terrorists, etc.) when there is a reasonable legal path toward immigration for the large numbers of people who are truly needed to work in this country. WIth such a policy, many fewer people will be crossing the border illegally, and the people who we truly need to keep out will threrefore be much easier to find.

Regarding your desire to screen out communist sympathizers, Che admirers, etc.: isn't that just an attempt to impose your own values on our national policy? There are many native born citizens who admire aspects of communism or who admire Che Guevara; would you want to silence them, as well?

If the U.S. screens immigrants for their beliefs, wouldn't that unfairly influence our national dialogue in an arbitrary manner that conforms to your own bias? Shouldn't people be able to debate these ideas on their merits, rather than having an agency that forcibly filters out all non-majoritarian views at the border?

If you believe in democracy and in freedom, then you have to support freedom of expression and the free exchange of ideas. The kinds of immigration restrictions that you propose would interfere with that free dialogue.

Finally, you can't really believe that citizenship is as easy as filling in an application. That is just so silly that it is hard to believe that you yourself take it seriously. Do you think people would be risking their lives every day to cross illegally if all that they had to do is fill in a form? I recently heard a news report about a young woman who had been in the U.S. since childhood, finally went in to immigration to apply for citizenship, and found herself in an immigration cell a few hours later, after which she was deported to Guatemala, where she did not know anyone and did not even speak the language. Her husband and young children are now going crazy trying to get her back.

So, this claim about filling in a form to gain citizenship is not reasonable, but since you're obviously re-examining your own beliefs at the present time, I'll consider that part of your statement to be an artifact of that transitional process.

Perhaps you got that master's degree before 1982, which would explain your lack of familiarity with Plyler v Doe. Let me quote:

"The Fourteenth Amendment provides that '[no] State shall . . . deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.' . . . . Whatever his status under the immigration laws, an alien is surely a "person" in any ordinary sense of that term. Aliens, even aliens whose presence in this country is unlawful, have long been recognized as "persons" guaranteed due process of law by the Fifth and Fourteenth Amendments.

"The Fourteenth Amendment to the Constitution is not confined to the protection of citizens.
