and SHUT DOWN Save Our State!

Our homegrown Minutemen types (the ones with the neo-Nazi sidekicks), Save Our State, will be trying to shut down the Day Labor Center in San Bernardino on Saturday, December 3, at 8:00 a.m. (they think we won’t get up that early) at Lincoln and Highland.

And SOS will be in Glendale the following Saturday, December 10, 8:00-11:00, trying to stop people from working at the Catholic Charities Day Labor Center, 5040 San Fernando Rd.

In San Bernardino, SOS will be celebrating their first anniversary—let’s make it one they won’t forget. They’re going to try to get signatures for their leader Joe Turner’s “City of San Bernardino Illegal Immigration Relief Act”, which will:

  • Prohibit any city-run labor center, where unemployed workers go to find a day's work 
  • Require private labor centers to pay for background checks for workers 
  • Confiscate any vehicle used to hire workers 
  • Deny business permits to any business that hires an undocumented worker, knowingly or unknowingly anywhere in the United States, whether or not the business has been cited 
  • Force landlords to serve as immigration agents, fining them for renting property to an undocumented person knowingly or unknowingly 
  • Register all renters' leases (and, hence, all renters) with City Hall 
  • Require government business be conducted in English only, so that the measure itself will be the first document unavailable to those who don't read English 
  • Open the city to innumerable lawsuits by allowing any resident to sue the city for enforcement

City of San Bernardino Illegal Immigration Relief Act Ordinance

What does it mean?

If you sign the petition, remember that if the City Council rejects it, it will come back on a taxpayer-funded special election.

 

SECTION 1                Title

This chapter shall be known and may be cited as the "City of San Bernardino Illegal Immigration Relief Act Ordinance."

 

SECTION 2                Findings and Declaration of Purpose

 The People of the City of San Bernardino find and declare:

 That illegal immigration leads to higher crime rates, contributes to overcrowded classrooms and failing schools, subjects our hospitals to fiscal hardship and legal residents to substandard quality of care, and destroys our neighborhoods and diminishes our overall quality of life.

A. That the City of San Bernardino is empowered and mandated by the People of San Bernardino to abate the nuisance of illegal immigration by aggressively prohibiting and punishing the acts, policies, people and businesses that aid and abet illegal aliens.

 

SECTION 3                Definitions

 Whenever used in this chapter, the following terms shall have the following meanings:

 

"City" means the City of San Bernardino.

"Contract employer" means any person who obtains the services of one or more individuals through a day labor agency.

"Day Labor" means labor or employment that is irregular or occasional at which a person is employed for not longer than the time required to complete the assignment.  For the purposes of this chapter, "day labor" does not include secretarial, clerical or professional services.

"Day Laborer Agency" or "agency" means any entity engaged in providing day labor workers for a contract employer. 

"Day Laborer" means any person who seeks day labor employment.

"Solicit" or "solicitation" means and includes the following:

1.      The act of making a request, offer or an announcement by the use of spoken word, bodily act or gesture;

2.      A solicitation as defined in this section shall be deemed completed when made, whether or not an employment relationship is created.

"Vehicle" means a vehicle as defined in California Vehicle Code Section 670 as the same now reads or may hereafter be amended.

It means residents of San Bernardino will have to decide whether they want to put every person of Mexican descent under public scrutiny.

It means residents of San Bernardino will have to decide whether they want their city to become a haven for white separatists.

It means residents of San Bernardino will have to decide whether they want their city put under the scrutiny of every pro-white group in the country while this ordinance is debated.

Declaring illegal immigration a nuisance means anyone from anywhere can come to San Bernardino and abate the nuisance "by removing, or, if necessary, destroying the thing which constitutes the same." (CA Civil Code 3495)

SECTION 4                Day Laborer Agencies

 A. Public Funding

1.      The City shall not operate, construct, maintain or fund any day laborer agencies.

B. Operational Procedures, Requirements and Responsibilities

1.      No person or entity shall engage in the business of a day laborer agency without first having obtained and met all applicable business licensing and zoning requirements by the City.

2.      Day Laborer Agencies are prohibited from procuring work on behalf of day laborers that are not legally authorized to work in the United States. Agency assumes strict liability with respect to ensuring that all day laborers matched with a contract employer are legally authorized to work in the United States.

3.      Each agency must collect a completed Employment Eligibility Verification Form I-9 for each prospective day laborer and must retain the I-9 form of each employee either for three years after the date of hire or for one year after the employment is terminated, whichever is later.

4.      Each agency must conduct extensive background checks on each prospective day laborer seeking day labor employment to verify the veracity of all identification information and to ensure that each applicant is legally authorized to work in the United States.

5.      Each agency shall collect all compensation from the contract employer for each day laborer transaction.

6.      Each agency is responsible for deducting required FICA and state and federal income taxes and remitting payment of remainder to day laborer.

7.      Each agency shall purchase general liability insurance in amount not less than two million dollars.

8.      Each agency shall provide toilet facilities within its place of business to accommodate the needs of day laborers using the agency.

9.      Each agency shall create an account and record of each day laborer applicant containing the information from the background check and all employment transactions.

10.  Each agency shall create an accurate record of each transaction by which a day laborer was sent to a contract employer.  The record shall include:

a.       The name of the day laborer and the date of the transaction;

b.      The address of the day laborer;

c.       The name, address and telephone number of the contract employer;

d.      The name and title of the individual at the contract employer’s place of business responsible for the transaction;

e.       The type of work to be performed;

f.        The hourly rate of pay to the day laborer;

g.       The compensation payable by the contract employer to the agency;

h.       The number of hours worked by the day laborer;

i.         Actual deductions from the day laborer’s compensation made by the agency.

 C. Violations

1.      Any person or entity that violates any portion of this section shall be subject to a fine of not less than ,000 for each offense.  Each day that a violation shall continue shall constitute a separate and distinct offense.  Any licensee who violates any provision of this chapter shall be subject to suspension or revocation of any licenses and permits.

It means residents of San Bernardino would rather have workers begging for jobs on street corners than seeking work with dignity at a labor center.

It means the City can’t assist labor centers in any way.

It means that private labor centers would have to pay for background checks on every worker who comes through their doors, even those who need only a few days work between regular jobs.

It means everyone who hires a worker for through a labor center, the job they hired the worker for, and the amount they paid will be on record for three years.

It means that labor centers will be shut down.

SECTION 5 Solicitations of Day Laborers

 A.     Any person or his or her servant, agent, or employee who owns, leases, conducts or maintains any vehicle used to solicit day laborers is guilty of creating a nuisance.

B.     Unless procured at a day laborer agency in compliance with this Chapter or at the legal residence of the day laborer offering his/her services, any vehicle used to solicit or attempt to solicit the services of a day laborer is declared a nuisance and the vehicle shall be enjoined and abated by seizure and impoundment, as provided in Chapter 8.35 of the San Bernardino Municipal Code.  If the Common Council amends Chapter 8.35, that Chapter shall be added in its original form to this Chapter.  

C.     This section shall not be construed so as to prohibit a business establishment or property owner from soliciting or hiring employment at or on his or its premises.  For the purpose of this section, vehicles and other similar types of mobile locations shall not be considered a business establishment or premises.

It means that anyone who hires a worker from a vehicle without going through a labor center will have their vehicle confiscated.

As a "nuisance," it means that any person from anywhere can abate the nuisance—in this case, your car.

And remember, the labor centers are shut down, so you can’t hire workers there.

SECTION 6                Business Permits, Contracts or Grants

Any for profit entity, including acts committed by its parent company or subsidiaries, that aids and abets illegal aliens or illegal immigration shall be denied approval of a business permit, the renewal of a business permit, city contracts or grants for a period not less than five years from its last offense.

A.     Aiding and abetting shall include, but not be limited to, the hiring or attempted hiring of illegal aliens, renting or leasing to illegal aliens, or funding or aiding in the establishment of a day laborer center that does not verify legal work status.

B.      Any act that aids and abets illegal aliens within the United States, not just within the City limits, will constitute a violation.

It means that no business that has ever hired an undocumented worker knowingly or unknowingly anywhere in the United States can do business in San Bernardino. Ever.

SECTION 7                Renting to Illegal Aliens

Illegal aliens are prohibited from leasing or renting property.  Any property owner or renter/tenant/lessee in control of property, who allows an illegal alien to use, rent or lease their property shall be in violation of this section, irrespective of such person’s intent, knowledge or negligence, said violation hereby being expressly declared a strict liability offense.

A. Property owner is hereby required to submit a copy of the lease or rental agreement to the City Clerk’s Office within 45 days of execution.

B. Any person or entity that violates this section shall be subject to a fine of not less than ,000.

It means that every lease and every lessor will be registered with City Hall.

It means fines for landlords who knowingly or unknowingly lease to undocumented residents.

It means that landlords of business and residential property become immigration agents.

SECTION 8                English Only

Unless explicitly mandated by the federal government, the state of California or the county of San Bernardino, all official city business, forms, documents, signage, telecommunication or electronic communication devices will be conducted or written in or utilize English only.

It means that this ordinance will not be available to some of the very people it affects, to people who don’t read English.

It means that no public form or document, service, or meeting ever will be.

SECTION 9                Severability

If any part or provision of this Chapter is in conflict or inconsistent with applicable provisions of federal or state statutes, or is otherwise held to be invalid or unenforceable by any court of competent jurisdiction, such part or provision shall be suspended and superseded by such applicable laws or regulations, and the remainder of this Chapter shall not be affected thereby.

 

It means that any court challenge will have to address each section separately and dismantle this piece by piece.

SECTION 10             Injunctive and Declaratory Relief

Any citizen residing in the City of San Bernardino may sue for injunctive, declaratory, or any other appropriate relief to enjoin violations or to compel compliance with the provisions of this section.

It means that any resident can sue the City for any perceived violation.

It means clogging up the local courts with businesses suing each other, with neighbors suing each other, with troublemakers suing whoever they can.

SECTION 11             Duties to Defend

 If any part or parts of this section are challenged in court, the City shall defend the legality of this section until all appeals have been exhausted and a final judgment is enacted.

It means the City of San Bernardino has to pay for defending this ordinance through as many appeals as are filed.

 

What does the City of San Bernardino Illegal Immigration Relief Act Ordinance really mean?

It means the residents of San Bernardino will have to decide whether their City wants to officially sanction apartheid.

Really Leslie....You keep pushing the extremist notion that anything that addresses crime must be racist connected and you'll be able to start your own cult soon.

I am not complaining about your other interpretations simply because I'd go hoarse or arthritic doing so. I was however, compelled to defend the work of Mandela and the suffering of those whose cause he championed, when you hijacked the term that nearly became synonomous with the movement to rid black Africans of a voice in their own country. Unlike the workers you have chosen to misrepresent as victims of racism here, they were fighting for rights IN their own country. A distinct difference between them and the mexican aliens that you keep evading and obfuscating with charges that a handfull of mexicans present in a few scattered areas north of latitude 36 N, 200 years ago translates into perpetual continental dominance or ownership.

Even without that argument, the term aparthied was borderline plaugurism in light of the bold differences between the plight of blacks in Africa, and the self imposed exile, or migration if you prefer, of Mexicans.

I believe I feel Mandela trying to turn over in his grave.

It's ironic. The white supremacists want to pass a hate law against the City wherein it becomes illegal for the City to assist people with finding employment.

The irony is that it's the Republican economy that's brought America the 10% plus unemployment rate, record mortgage foreclosures, and record poverty levels... And these white supremacists are nearly all Republican.

Race hate is always ugly, but it can be amusing by turns, looks to me.

Joe Turner's law is obviously designed to segregate Mexicans and other Native people away from "real" "Amerikkkans."

It is obviously designed to force them out of a place to live, out of the ability to work, and to set up social conditions of prejudice and persecution against any who might remain.

The analogy to Apartheid is strict.

Those from Botswana or Swaziland or the "homelands" artifically established by the Nazi/Euro/ Apartheid regime, were unable to live and work in certain areas based on:

1. Where they came from / what alleged "border they crossed and

2.The color of their skin

To be in white areas you had to have "papers." To be _anywhere_ you had to have "papers."

What a coincidence, huh?

What the quasi-Nazi thug "Ayatollah Gondola" always forgets is that we UNDERSTAND HISTORY, that we see the games of racist imperialism clearly for what they are - they've been repeated all over the WORLD, time and again.

We've also seen their arguments over and over - every instance is a "exception" to the rule.

"Look", they say, "Gilchrist's congressional campaign courted Nazis - but that's NOT ME!"

"Nazis have come to SOS events repeatedly, but that's NOT ME!"

Oh yes, Minutemen says James Chase, shot migrants at the border but those were ROGUE Minutemen - that's NOT ME!"

"Oh, yes, the Church killed millons in the Inquisition - but those weren't REAL CHRISITIANS"

Oh, the US set up reservations here for Indians, and set up 're-concentration camps' during the conquest of the Phillipines, and "Strategic Hamlets in Viet Nam, and yes, Hitler modeled himself on us AND SO DID THE MASTERS OF APARTHEID - but that's NOT ME!"

Well, except for the city's department of Human Resources, yes, this should be the domain of business owners, whose primary focus, is prescreeening applicants, and providing eligible and qualified workers to the employers, and handling the worker's payroll. As it is many city-sanctioned day labor hiring centers, give the employers the false comfort they are not violating any city, state or federal laws by hiring, persons at the sites.

2. Require private labor centers to pay for background checks for workers



Temporary employment agencies, that I have applied with, charge no fee to the employee. I don't know if the employers pay a fee to hire someone, or if the costs of for background checks for workers, comes from the operating expensies of the business.

BTW -- The agency is the employer of the worker, and business owner who accepts the worker, is the client of the agency. The worker represents the agency to the client.

3. Confiscate any vehicle used to hire workers

This is simple forfeiture, of property used in the commission of a crime. A good punishment to the business owner, should his property be used in a crime, but what if the business owner isn't driving it that day? It gets kind of tough to run a business, don't it? No, this needs a case-by-case review.

4. Deny business permits to any business that hires an undocumented worker, knowingly or unknowingly anywhere in the United States, whether or not the business has been cited

It would be too far fetched to enforce this, if the businesses relocate, file for bankruptcy, and change names.

5. Force landlords to serve as immigration agents, fining them for renting property to an undocumented person knowingly or unknowingly

No, too much of a Communist stink to this one. BTW -- "landlord" is too broadly defined to apply. Managers of apartment or condo unit complexes, typically require documentation to establish a paper trail to verify a person's rental history, character, employment, credit history and weed out certain persons with criminal or mental stability problems.

6. Register all renters' leases (and, hence, all renters) with City Hall



Again too Communist. BTW -- The CIA, used to operate a "Welcome Wagon", that sent a kindly female around to meet and greet new arrivals to the area, ofer coupons good for inticing the newcommers to patronize local merchants, and gather census or demographic data.

Yes, we do need to encourage, immigrants to learn English. We do provide free ESL classes. It is expensive or cost prohibitive to have an interpreter for every language spoken, in every city hall. We do live in an age, where computers and electronics can connect us instantly to resources, that enable us to conduct our daily lives and business, in a real-time environment, while crossing both cultural and language barriers.

8. Open the city to innumerable lawsuits by allowing any resident to sue the city for enforcement

Yes, but to tie up the city government , in enumerable lawsuits slows down the government's ability to render to the people, while draining the coffers.

About Past Laws Regarding Mexicans and Immigrants

That links to a paper about Mexican American Repatriation and the nativist movements in California in the 1930s.

During that time, over 100,000 people were deported to Mexico. Most of them were native born American citizens.

That article's a good starting point for understanding this anti-Mexican nativist movement.

Also, during the 1950s, Operation Wetback deported a lot of people, and many of them were American-born children of undocumented people. INS would do sweeps and target anyone who was brown.

That is Apartheid.

Aparthied is just another name for "police state" for one group of people.

If you look at the proposed hate bill, the reverse is just as true. If I as a while male were to stand on some employment center to find work for the day, becvause of my skin hue I wouldn't be subjected to this latest Christian hate. I'd be ignored and wouldn't have some clown walk up to me and demand to see "papers, please" like Nazi Germany.

Discrimination is disacrimination whether one benefits from it or is -- as this bill intends -- oppressed by it.

How about that for telling? "The left" has as their cause human rights, equal rites, civil rights, and end to discrimination, hatred, and bigotry. "The left" also has as their cause the end to this fascist regime's war crime atrocities against humanity in Iraq -- a fascist regime who's targeting and slaughtering brown people who worship the "wrong" gods.

That's the causes that "the left" have.

And pointing out, underscoring, and enumerating the hate? That's "twisting" some how.

I wonder if this clown also believes the Bush regime's treasonous lies about Iraq attacking New York on September 11'th, or Iraq some how having weapons of mass destruction, or about how Iraq constituted some kind of threat and that the brutal Christian atrocities being committed by the American babyu killers isn't just about oil.

Funny how "the left" stands for what's right while they stand in opposition to hate, bigotry, murder, genocide, rape, torture, racism, homophobia, organized crime, and everything that "the right" embraces.

I just have a small linguistic correction. You should have said too authoritarian, not too communistic. Remember, in the 1980s we established several governments in Latin America like Pinochet’s that were very authoritarian, but they were our best buds because they included communists in the masses they murdered.

Communism (which has never been tried) is what Marx calls the "end-state". In other words, communism is the goal, and when reached, society no longer has a practical use for government, and it is abolished. Therefore, the exact opposite of communism is the authoritarian systems you are talking about.

Sorry, just a linguistics clarification.

Apartheid is just segregation. It's just defining groups, and giving one group more rights than another group. It existed in America until the 1960s (legally I mean), and in South Africa until the 1980s.

The only shocker of South Africa, for Americans, was the dire poverty of the townships, and the extreme violence used to maintain "order" in the face of uprisings. The reason for that, really, is the relative poverty of SA compared to the US. If the townships looked like America's ghettos, and the protests weren't so desperate, it wouldn't have been so alarming.

Right now, the line between "legal" and "illegal" is fuzzy. It's so fuzzy that there isn't much chance of a gangs of cops beating on the undocumented people for being in the wrong place at the wrong time. However, if popular support for stronger categorizations continues, we'll start seeing more Apartheid-like conditions in America, including the poverty and violence.

I'm on a real roll with the links lately, so, here's a real blast from the past. It's a bio about Asa Carter, aka Forrest Carter, a well known American segregationist, part time Klansman, liar, and mean sonafabitch.

Carter wrote that book "Little Tree" some years back that caught on with New Agers. Yeah, New Agers were duped by an American Hitler. How can Apartheid be that far behind.

San Bernardino fighting back against illegal immigration

Some folks in San Bernardino are taking matters into their own hands when it comes to fighting illegal immigration. A new citizen petition will force a vote, either by the city council or by citizens themselves, to crack down on illegal aliens.

Behind the home-building boom in San Bernardino, another story: rising crime, failing schools, a flood of illegal aliens.

One citizen decided to do something.

“I got tired of local politicians saying that illegal immigration is a state and federal issue.”

So Joseph Turner fought city hall, forcing a vote on an ordinance he wrote himself. The initiative makes it illegal for landlords to rent to illegal aliens, prevents the city from using our tax dollars to build day labor centers for illegal aliens like you see popping up at Home Depots all across Southern California, and also institutes an English-only policy that says all official city business must be done in English only.

Because turner gathered 2,200 signatures, the city council is boxed in: either pass the petition or put it on the ballot.

“I'm going to vote for this initiative to be implemented. And if that fails, I will vote to send it to the voters. We either adopt it as an ordinance as is, or we put it before the voters as is. We have no authority to change it.”

San Bernardino is part of one of the fastest-growing regions in the United States and that explosive population growth is fueled in part by illegal immigration. An estimated 200,000 to 800,000 illegal immigrants are living in the region.

The city's problems are dire: the 99th lowest graduation rate among the hundred biggest school districts in America and the 18th most dangerous city in America, with 58 murders last year.

“We have Mexican gangs that are active in San Bernardino, and most of their members are illegal immigrants.”
