dear all:

i received a letter yesterday from the office of Orange County District Attorney Tony Rackauckas informing me that i was being charged with "violation of section(s) 484(a)-488 PC petty theft by taking and carrying away" on May 25, 2005. early this morning, i put calls into both the DA's office and the GGPD to inquire the details. they told me nothing.

later this morning, i get a call from Detective Reynolds telling me GGPD has a search warrant for my place of residence in Westminster. he proceeded to question me about a flashlight that i am accused to taking on the night of the 25th. he said it belongs to one of the police officer and that "this is a serious matter, we are not playing games" and "just tell us where it is" and "if you don't have it, tell us who does." i maintained that I DO NOT HAVE SUCH AN ITEM IN MY POSSESSION and that furthermore, THIS IS HARASSMENT. he persisted in questioning me; to which i responded that i needed to consult with a lawyer and that there was nothing more i was going to say. i asked several times for a phone number to follow up. just as i was about to give up and say i will just call the GGPD if i need to follow up, he states, "well, i would have given you my phone number earlier if you would just answer the question." he then proceeds to give a contact number.

lesson to be learned here: DON'T EVEN TRY TO TALK TO THEM.

why? because you are not obliged to do so. i did not need to ask for a number. i did it out of courtesy and to demonstrate my cooperation.

GGPD ended up leaving my house in defeat. they did not find the flashlight in question because... I DO NOT HAVE IT IN MY POSSESSION!

i am sharing all of this because i want you to be aware of attempts by the police to intimidate us and squash dissent through harassment and engaging us in THEIR legal process, thereby wasting our time, money, and energy. they want to make us feel afraid to speak out against brutality and advocate on behalf of those who have been wronged.

in the coming days and as this unfolds, i expect that i will stay really busy as i continue my work with the Legal Defense-Offense Committee and addtionally, fight my own battle. so, if i don't respond to your calls or e-mail in a timely manner, i ask now for your understanding. let's also continue to organize because racism and fascism, in all of its strains and manifestations - be it the police or the Minuteman Project, has NO place in a movement for love, liberation, and self-determination!

The Nazi Stromtroopers have sunk to a new low. Raiding a house for a FLASHLIGHT?!?! With the costs of that raid, they could have bought 10 flashlights. Further, to suggest that a girl, hit by a racist van driver, who then went straight to the police department, stole a cop’s flashlight?!?! This is blatant harassment!!! I am outraged!!! I hope people are contacting the press and ACLU!!! This is going to make a great lawsuit!!! I can't get over this. Was it that she was part of the legal defense group, or was it because she spoke at City Council, or was it because she gave an interview to Fox News, or was it because the cops want to silence people critical of them, so they go after someone they think won't fight back??? I watched the City Council meeting at home, and I saw this woman speak, I never thought these cops were really the Nazi Stromtroopers my neighbors claim they are, but THEY MUST BE!!!!

Here are a few suggestions:
1. Start a legal defense/offense fund for 5/25!
2. Get lawyers to sue each officer involved and the city as a whole (let them keep all the money won, the money is not the goal, it is justice!
3. Get more vocal with the press, they are the only counter balance to state power, and the people need all the leverage they can get.
4. Start a "replace the council" fund going, and donate money to anyone who wants to beat them in the next election, we need to clear the council of all Nazi Stromtrooper Supporters.
5. Do not plea, do not give up. If they take people to court, make them do everything required by the law. Have a jury trial, delay hearings, drag this out, each day is more costs.

If such a video exists, then let whoever has it produce it, preferably in court, and testify to its authenticity under oath.

And, since cops have been caught editing video evidence for the purpose of giving a false impression before, let them be prepared for their evidence to be given critical scrutiny and for the possibility that strong, i.e., physical, evidence might come from sources other than the police.

That's what it will take to convince any thinking person of what the facts are. All the unsupported claims, counter-claims and slagging matched on the entire Internet are no more than the idle wind, which we regard not.

See, you just discredited yourself. She didn't steal any flashlight. So if you claim that it is on the same tape that has our "lawyer" jumping on the hood of a car, then it must not exist, if it does, we want to see it. A bunch of people went to the city council and demanded an independent investigation, and they demanded that this video tape that the nazi stormtroopers have also be included in that investigation. WE WANT THE POLICE TO PRODUCE THAT VIDEO TAPE AND PROVE THEIR ALLAGATIONS, BUT THEY WON’T, BECAUSE THEY CANT, BECAUSE THEY ARE NAZI STORMTROOPERS! I myself think if she stole a "10 dollar flashlight" that these charges are pathetic and wrong. Atleast to storm a house. But lets see on june 27th what they really have. Then jump to conclusions! It seems to me that those who claim biggotry and unfairness scream conspiracy on everything. I believe if they did storm her house over a petty flashlight, then it will be unnecessary force and be thrown out. But I have a little more faith that the police aren't that stupid.
