Dear Honorable Judge Charles R. Breyer, US District Court San Francisco .

I have no attorney, no legal council, and no money and live 3,700 miles away from your district. I am not very articulate and just tell it like it is. I am not an attorney nor to I pretend to understand how to play this corrupt game of stone walling my just federal case I have witnessed.
I no longer fear any of you because a true American Patriot should not fear blatant government corruption and should fight it with the very last drop of his blood, not for himself but for his children so they will not inherit slavery as their only liberty in the future.
I do not understand the court's unfair rules as I have been denied legal council to guide me in matters of fighting blatant corruption and crimes. All this Court must do is take a long hard look at the facts and quit twisting blatant lies in order to deny my most basic Civil Rights, "the right to due process and the right to a trial by jury", that has been stolen out from under me as now is being done by this new change of Venue to California by a Chief Federal Judge in Puerto Rico himself.
My case might as well have been transferred to Mars ..as I can not walk or swim that far either! What part of "ProSe and in forma Pauperis" did the federal Chief Judge in Puerto Rico not understand? The, "I don't have dime left in my pocket and I'm walking barefoot in the jungle" or the "I don't want a bullet in my head the day before trail if you send my Case to California"? The unbelievable petty excuses used to send my case to your district (and deny my right to due process) are absurd to even the most ignorant of America's Citizens.
Just who's rights was the US Constitution and the Bill of Rights written to protect? The US Army and it's taxpayer provided legal council like the US Attorney's Office here in Puerto Rico? Or as the US Constitution true intention to provide a shield against government tyranny ?
As the victim of a well documented federal crime by the abuse of governmental powers blatantly against the impoverished and living on a tiny island in the Middle of the Atlantic Ocean where is my individual protection and right to due process when I can not even dream of being present for to many well founded reasons and fears.
The Chief Federal Judge's use of other case laws cited to change the Venue have nothing to do with my circumstance at all and as are totally misplaced as to only to benefit the government's own interest and intentions to corruptly cover my well know case up while they still can. I will not let them as my life depends on it as silence has meant death for too many innocent America's I knew already.
Too many other potential witnesses in this case are already dead no matter what the official story was I no longer believe in coincidence when it comes to a government cover-up of this scale and determination to conceal the true facts that are damming against my former employer the US Army Corps of Engineers. I received a well documented "death threat" in California on September 3, 2000 at my then duty station.
By the end of that same year after failing many attempts to resolve the problems internally and having not returned to work after September 6th 2000. BY December of 2000, I spoke directly to the Head of the Agency itself, face to face General Robert B. Flowers Chief of the US Army Corps of Engineers and his intention to cover-up all that happened had become very clear as well the FBI office in Santa Rosa, California to who failed to enforce my protected "Title 18 rights" as a federal officer at the time nor investigate a blatant federal crime that had been committed against my family and I on federal government property itself.
I then fled with my family for our lives back to Puerto Rico exile during February of 2001 where we ARE protected by my wife's huge family of American Citizens who still believe in the US Constitution's "guaranteed individual protections" unlike the Federal Court in Puerto Rico who has just blatantly "violated my most basic human and civil rights" by ordering me to my death by sending my case to your district in order to prevent me from ever getting my 7th Amendment rights enforced.
Civil Rights as I have demanded for by a "trail by jury" because I have no faith in a well documented and highly corrupt system anymore. As I was working in Puerto Rico 1998 when many of my employment troubles began for "blowing the whistle on FEMA fraud, waste and abuse" to the tune of 1 billion dollars plus their real motive for a cover-up, I demand my case be tried here in Puerto Rico where it belongs by an impartial jury of fellow American Citizens.
I demand that the Justice system not make petty unbelievable excuses for the US Government's cover-up and crimes and enforce my guaranteed Civil and Constitutional Rights as an Individual who is protected by their 200 year old wisdom. If I am no longer enjoy these guaranteed and most basic human rights; then I demand it be put into writing for history's sake along with a "Declaration of War" against one of America's most impoverished US Citizens as further treason to our beloved US Constitution as I accept the challenge of A Civil War if it is the Court's wish to protecting a Government tyranny and well known dictatorship by acting dishonorable and using lies as facts in making legal opinions and life threatening and Unconstitutional Orders.
I have been Ordered to appear in San Francisco and I can not. I have been threatened in writing that my guaranteed right to due process will be denied, if I do not appear in person 3,700 miles away; with your Honor well now knowing I can not comply what would you have me do?
Go to California to my death or worse for my family? ..I did not start this "War"..I have always only wanted to end it by living up to my Oath of Office to defend the US Constitution form all Enemies both foreign and domestic. Thee is no government guided book on how to do that so I guess I will have to wing it.
I will no longer summit "to the tyrants will" as I am swore not to surrender to tyrants who willfully violate the US Constitution's individual protections. We are a Nation of "We the People" and you and I both have a responsibility to uphold that promise to America's less fortunate citizens not just the wealthy and political powerful as you well know.
I find these games with my liberty to be an insult to all that I was willing to die for as a former US Military grunt. I have filed an Appeal with the US court of Appeals in the First Circuit as I pray it will protect my Civil Rights unlike the Chief federal judge who has blatantly ignored those most basic of Constitutional guaranteed rights to Life, Liberty and Property.
The US Army and the US Attorneys Office have flat lied and used forged documents in their legal motions to get my case unconstitutionally changed to California where they can finish the job of "terminating me permanently" by making good on their official uninvestigated "Death Threats". I have a well founded fear of them making good on their promises to kill me so I perhaps will never return to California knowing full well American Justice is dead along with our most basic human rights.
I have no Military defense from "Gestapo Tactics" to terrorize my family and I in California. However here in Puerto Rico with my wife's family numbering into the thousands I at least have a chance to finish the job I never asked for. The responsibility to fully expose government tyranny, corruption, abuse and refusal to enforce our most basic guaranteed Civil Rights by our own Government.
This combined with the dirty criminal secrets a corrupt US Government Department and it's officials with the conspirator nature wish to remain concealed from the public's continuing ignorance. I have the responsibility and had the responsibility to expose this treason as a US Government Official despite the FACT not one of my former leaders would admit to any wrong doing no matter how many of our federal laws they willfully violate in coving it all up to protect their own special interests and well known greed.
A so called Judicial System that no longer protects the "individual's US Constitutional and Civil Rights" by abusing it's powers over an impoverished natural born American Citizen by deliberate denial of the well known facts! I have it well documented now there is biased cooperation by the federal district court in Puerto Rico to ignore my most basic human rights and "stone wall" my case by holding to the tyrants will of a government abuse, despite the well known public FACTs of my case. The Justice system well knows the US Army has lied as well as the US Attorney's Office who are using forged Government documents with deliberate meant to mislead the Justice system by "false facts" to enforce the "tyrant's will" against a victim of a federal crime, that to this date has never been investigated by my own government nor by an unbiased process of law in any fashion.
I have documented a cover-up and mean to prove it and thus is further reason why my case was sent 3,700 miles away rather than face me in a jury trial here in Puerto Rico where much of it began and was well document in Public Editorials long before my illegal termination from honorable US Government service of 11 years.
I was terminated from federal service a full 7 months after I refuse to return to a hostile work environment and moths after I had permanently fled to Puerto Rico from tyranny into forced exile from the US Government itself. Yes I know that's embarrassing to the US Government but then again where is my Constitutional Protections, I have been thus far totally denied by the same system we are suppose to believe in and as many have given their life for already?
How am I to believe in American Justice anymore? How am I to believe in a system that is not afraid to commit heinous crimes against its own people with out any fear of persecution, "with total protected impunity from being charged with a crime" as they routinely break federal laws they so willing inflict on the people (mostly impoverished). How polices the police? Certainly not the federal government itself anymore. I having personally documented and witnessed acts of Government corruption have not found any enforcement authority over official criminal acts committed by the US Government itself?
Is this not corruption and betrayal to our most basic legal ideals? I am not a rebel and as Che Guevara would perhaps have said, the people must liberate themselves from just this sort of government tyranny and official treason against it’s own people. I am an American citizen but that does not seem to matter to the federal Justice system any more?
Why is that? I only reported a federal crime as I did not commit the crime, I was only dutifully reporting for the benefit of the people's will and trust in me as a Government Official. Perhaps General Powell can now understand this concept too. Yet despite my doing my sworn duty I became just another countless victim and have had all my human rights and civil rights stolen from me just the same.
The proof and evidence you know asked yourself is with in the federal courts own official documents as well as by the corrupt actions of a federal chief judge here in Puerto Rico to deny me those protect rights as promised to all of America's US Citizens.
I was sworn to duty to protect our rights but it is now very apparent I can not find "one government official" within any federal department or the Justice system itself who will enforce or uphold their duty and the law against any corrupt US Government Official internally.
Oh I can well prove that fact and so can many others…if we could just get our cases to where they really belong. Is that not blatant Corruption the highest levels of our Nation's Government? I expect nothing less form a Fascist Government by this treason but by my own US Government is unjust and criminal in nature and must be punished not protected as is now being done. These well document alligations include too many Government officials who collect a taxpayer provided federal pay check as they seem to forget just who it is they really work for. INot the "Good Ole Boy" system I have witnessed and well documented.
Are we not free in America any longer or have I always just been kidding myself as I enforced federal laws for 11 years on our own citizens? I always thought it strange the real crooks were sitting in the big offices within federal buildings and their many innocent victims were sitting behind prison bars or dead.
Are We the People only Citizens who serve the US Government's greedy officials these sad days or do we not have the most basic rights promised in the Bill of Rights my family and I have been denied recently? However I meant to prove all this to a Jury not more corrupt government officials as they well know their blatant crimes against the people that have yet to be punished.
Because I refused to stay silent over US Army Corps of Engineers internal Corruption problems I have been imprisoned by forced exile within my own Nation but not silenced in my duty to tell the "Whole Truth".
The only way I will now return to California will be because California is in a bloody Civil War for as long as injustice and corrupt acts of government tyranny and is openly aloud to prevail over American Justice there will be dissidents fighting it. I am living in Puerto Rico exile because of official's racist acts of US Government tyranny and abuse against it's own people. You don't not want me back in California because "I will and have" defended my most basic human rights to life liberty and property as is my human right that has thus far been totally denied and flatly stolen by criminal means from my family and I by a corrupt system of lies under the color of the law.
If I return to California it will not be alone I plan on letting everyone know about this official and well documented betrayal. The facts are as a trained US Marine, I am dug in for the long fight for freedom, liberty and justice once again as my ancestors must have been against the British Tyranny they overcame. It's a fight I have the human right and responsibility to fight right here in Puerto Rico. Short of Civil War back there in California or Oregon perhaps, you will not be seeing me soon as any further complacency to just accept defense's blatant deceptions full of lies and fraud, to change my case's venue to California will be a well known betray to the most basic human rights of an individual and his family.
What is it the mighty US Government fears from a fair fight right here in Puerto Rico itself? Are there nothing but abusive power hungry empire building within federal government these days? Why do they fear an impoverished American citizen living on a tiny island that they must send my 3, 700 miles a way, deny my appointment of council motions just so I may not participate in the so called American Justice system at all? Is that not the abuse and acts of a dictatorship and not a Justice System? Any decision that does not send this case back to where is truly belongs (in Puerto Rico's federal court) will be just further proof our once honorable Government no longer represents "We the People".
I challenge the Mighty US Government and it's US Army leadership (I am suing) to prove me wrong…. In a fair fight not a cowards denial 3, 700 miles away across a vast Ocean as we have been so witness by the documented facts of this case. This case belongs in Puerto Rico not California for many countless reason I outlined as the US Government well knows too mostly because they are deliberately attempting to deny my guaranteed right as an impoverished American Citizen "the inalienable right to Constitutional due process of law".
A basic human right as the court well knows has been denied by the chief federal judge's unconstitutional and unlawful order to send his problems to California for fear of a trail by jury here in Puerto Rico. A few last points of basic human logic. Does not the US Army have a Military Occupation called a Military base or bases in Puerto Rico? Does not the mighty US Government have a US Attorney's Office in Puerto Rico too? Does not the US Government have all the taxpayers funds at their beckoning to defend corrupt and criminal federal managers as well as US Military leaders?
How does a case law that talks about a few hours drive relate in any way to a man who must swim 3, 700 miles to appear in person as you have ordered? It would take another thousand miles more if I take the Panama Cannel route and I don't think I'd be back home in time for supper either.
Despite my lack of case law knowledge do not think me stupid… this change of venue is treason at it highest level against our beloved US Constitution's and Bill of Rights guaranteed individual protections. If this case is allow to continue in California then there will be no more doubts at who all the well known traitors to the US Constitution really are despite my being helpless 3, 700 miles away being denied my every basic human and civil right by my own US Government officially. For such blatant injustice to prevail in America I can only pray for the people to raise above the corruption and destroy it once again as history and the US Constitution dictates should be done once a government has burned our last hope of true freedom, liberty and justice for ALL it's peoples not just the ones who can afford a corrupt government attorney at the taxpayer's expense.
I DEMAND a trial by JURY as I have been willfully denied that right if this misuses of the American Justice system is allowed to prevail by protecting criminals thus giving credence to a questionable case law under the color of the law more credence over the well known intentions of our oldest Constitutional laws that represents the most basic founding rights and principles human rights of the individual not the US Army!
Where is it written the US Army has more Civil Rights than that an individual natural born American Citizen within the Bill of Rights or the US Constitution for that matter? I can't find it but the chief federal Judge in Puerto Rico seems to have found it? Could I have been so wrong for 41 years thinking and believing I lived in an American Democracy and not a dictatorial police state as in Cuba?
Who's responsibilities is it to defend our most basic human and civil rights if it is not the American Justice system? Really I'd like to know that answer because by the Government's own corrupt and criminal actions where federal mangers and military leaders live above our laws sure looks like to their victims "we live in a dictatorship and not a democracy we want the rest of the free World to believe. Well sir I can no longer believe a bold face well documented lie that is at your finger tips on your court computer system.. All you have to do is read it for yourself and you too will have no more doubts at what a betrayal this whole American Justice system experience has been to my family and I as it's continuing victim's of blatant injustice and official denial.
MY wife once said, "when you are the victim you can see clearly through the prism of lies". I guess federal chief judges can't read or see at all as he sent my case to you 3,700 miles away from the good fight.
Hey tell you what I can do… hop on a plane ..no wait make that two planes to save the taxpayer's some money; come to Puerto Rico and I will take you by the hand and show you in person the whole truth. If you leave Puerto Rico unconvinced that what I am saying is not the "whole truth and nothing but the truth" then I will not hold you responsible to what ever just decision you a make in this case afterward. It's not like I can just hop in a plane and come to you, that would take big bucks as you well must know.
To ignore this challenge and continue with the government's corrupt deeds or criminal game will then by further denying my civil rights to due process, then I will do my damnedest to expose all the traitors to our American democracy as is my sworn duty…. so help me God.
Now how could an Officer of American Justice decline such a humble honest offer as that? I guarantee you will be safer with my family than a whole US Army by your side. You see we have never had a friendly fire incident to date as a fact the US Army can not deny. Give my family and I a reason to believe in American Justice System again come to Puerto Rico and see the US Army Corps of Engineers lies for yourself.
I always wondered why a man or woman would become a federal judge if they were not interested in the whole truth and nothing but the truth so help us God? You can even stay with us in our termite infested, open top septic tank Puerto Rican family home….. saving the American taxpayer even more money.
I mean it is all about money with the federal government these days right? All you'll need is a plane ticket to Puerto Rico..my family and I can take care of the rest. I have plenty of time on my hands to show you around Puerto Rico, Local tribunal records, FEMA sites and other government atrocities because after my illegal termination from honorable US Government service (not to mention the Death Threat) I have not been working for what is it now… almost four long hard years.
If you think I am joking I reassure you I am dead serious about the problems too many good Americans are ignoring… the invention to come here and see it for yourself is now open to you if you will take the challenge to learn the "whole truth", not the US Army's criminal cover-up. I insist you stay in my home as anyone can only appreciate the hardships we have face and lived with from our perspective and not from the $500 a night Hotel Casinos in Old San Juan or the Private Villas FEMA personnel stayed in when this all began for me a federal whistle blower. Over 1 billion was spent here in Puerto Rico and I know where much of it went… it was not helping the impoverished People of Puerto Rico.
If you do this one small challenge, your eyes will see as mine see, you will never be able to close them again to the official lies of our corrupt leaders, you will see why my case truly belongs in Puerto Rico and not your federal court in California. The Chief federal Judge's eyes in San Juan, Puerto Rico are closed to his own people's suffering are your to remain closed too? Why did he and the US Army send my case to California 3,700 miles away from the true Battlefront? Come to Puerto Rico and find out why this is my only challenge I can beg from you now.
As you well must know by now I will not be going to California any time soon at least not until the criminals in the federal workplace who are getting away with murder are put behind prison bars for deliberately betraying their Oaths to our Nation ad it's people.
I will not and can not accept government corruption's an unstoppable and fatal disease of our once proud Nation. I for one have stood up to it…I will never surrender my promise to our People, to protect and defend our most basic human and civil rights; so routinely ignored by our leaders today.
A law (Our US Constitution and the Bill of Rights) without any enforcement is like having no laws at all…you decide if you will accept the challenge to uphold our oldest laws as I have despite the pain, misery and suffering my family and have had to endure for nearly countless years now.
