Ron Kovic should shut his mouth and except the fate that happened to him. If he wouldn’t have been wounded in Vietnam no one would have ever heard of him. He has nothing better to do than knock this country. Get a real job and get on with your life. Ya your in a wheelchair so everyone should feel sorry for you and listen to your bullshit. Look around you, the people that are listening to you are nothing but a bunch of losers like yourself. I’m in a wheelchair also but I got a job where I’m contributing to society and supporting my family. Ron Kovic, grow up and shut up, people are tired of listening to you. I love this country and the President made the right call in the war on Iraq. You want every one to lay down and do nothing when America gets attacked. If they did that in World War II we would all be speaking Japanese now.
I’m a real American
I hope that Ron Kovic gets to see this.

As a Viet Nam combat veteran, like Ron Kovic, II must disagree with both of you. Most combat vets are against war. Most combat vets don't want anyone else to have to experience what we did. Most combat vets think Bush a rich man's son who used his privledge to avoid real war. Most combat vets realize we have been lied to all our lives by those who run things, For example, Nixon's secret war in Cambodia, KISSINGER's extending the war in Viet Nam for 4 extra years for his own grandizement. If you want truth, start with the book, ADDICTED TO WAR, WHY the US CAN'T KICK MILITARISM by Joel Andreas I am sorry for your wheel chair disability. I hope someday you can follow Ron's example and project sincere spirituality and a love for all mankind. Sincerely, Mark Scully

To "out of touch"... You seem to me to embody all the characteristics of the definitive recreant. Your cowardice is only exceeded by your impertinence. By your logic someone like Benedict Arnold should be a hero, he embodies everything you are looking for in a patriot. After all he was merely supporting the established administrative form, the monarchy of George The Third, simply trying to throw down terrorists, traitors, insurgents and unmistakable revolutionaries. Think about this: What are you gonna do when you're an old man clinging to your walker, our wife just got a hip replacement that cost thousands and did no good, your ticker has just about had it, you may even be a veteran trying to make it on social security pittance you paid into for most of a life time, lousy VA benefits and some pissant pension from a crummy job worked at for nearly fifty years and one black day a gaurdsman or police officer barges into your living room, killing all your adult children who have come to your defense, raping your grandchildren, poking you in the butt with his rifle, ousting you, sending your wife to an internment camp and you to a work camp just for your having been a Morman or a Methodist or for that matter an Atheist, or any other equally inane reason for which he's been ordered to do his duty? What then? Huh? Don't think it couldn't happen. It already has in our lifetimes and continues to. Your fate could be that of the Native American. You ever heard of a reservation? Maybe you want to see all African Americans or Catholics or Jews on one of those things, but not me, not on my watch. It's ethics like yours that make the inhumanities of modern psychology, legalized abortion, capital punishment, euthanasia and biological experimentation/dissection on human beings ungodly realities in the United States of America today. To say nothing of the nightmares created in "third world" and other wise foreign countries by our politicians and big money, and right here at home the tragedy of illegal drug trafficking and the horrible fraud, exploitation and all around nightmare treatment foisted upon our elderly and children. We should all hang our heads in shame. We Americans have all the wit of mindless cattle and half the charm! You're probably also one who has forgotten there is anything like a parochial school or private school and that generations of Americans have exercised their right to take advantage of that alternative schooling their children in the home disregarding the crummy standars/ethics/purposes determined and employed by the State for and in education and raising brighter, and more importantly, more conscientious Americans in the process. I don't agree with letting people who've never served in combat define what patriotism is. You? Real men question there government and watch its moves like a hawk. Policing it if you will. Remember the Rebel? Remember the Frontiersman?? Where were you when your History class discussed the Revolution? Shooting spitwads? Writing love notes to Mary Jane Rottencrotch? Your ego's writing checks your body can't cash son! What was the American Revolution all about ignoramus? Civil authority exists to serve the populace not the other way around. Stand up and say what you want to say. Argue for your rights and don't lay down and take __it. Men like Mr. Kovic have more courage in their little finger than you or I have in our whole bodies. Thank God for men like him. He is a genuine hero. He laid his life on the line so you can talk that talk and he continues to do so. He is a Veteran and represents you and I, protects us, is defending you and yours as surely as any active duty serviceman, cop or fire fighter. Shame on you for speaking out of turn about the man. You and I should be so lucky to have half the fortitude courage and dignty he has! In fact one could talk of authentic honor and an aspect of solemnity when describing this man. A person could apply any number of the sundry virtues wh's actual meanings have been twisted or completely lost and forgotten in our day and age to men like Ron. Pick up your Nicomachean Ethics now and again. Another thing. Please accept my apologies for the following if you do happen to be impotent. You must have no children. For it is only when you have looked into the eyes of your first born and held their tiny, fragile body in your arms that you realize we all belong to God and not to Uncle Sam. There is hope for you yet though. Find your courage. Again, stand up and win your rights and that of your children. The rights of all generations.
Sincerely, A Veteran and Patriot

After seeing "Born on the Fourth of July" as a teenager I was deeply moved by Rons' determination and bravery. His patriotism has rubbed off on me intensly. He left his friends, family, and the girl he left behind to fight for his country! And he had the bravery to tell what was going on over there and to protest the war no matter what happened to him! My admiration also goes for Sen. John Kerry who went to fight and won several medals and saved lives and also came home to protest the war. How come none of the swift boat ads say "Ron Kovick" brought down moral or got POWS tortured! Ha! Ha! John O'Neil is the biggest liar of them all! I did research on "Stolen Honor" and all the POWS in this film were pilots and had been shot down and taken prisoner very early on in the war so they have no idea what did or didn't happen! I just wish Kovick could have been Kerry's vp candidate although Edwards is pretty good as well. God Bless you Both!! Sincerely,

Disabled ACLU Members Ask Supreme Court, “Does ADA Apply to Foreign-flagged Ships?” >PLEASE SHOW YOUR SUPPORT BY JOINING US NEAR THE SUPREME COURT BLDG 9AM MONDAY 28FEB2005< Washington, DC, February 10, 2005. – Five disabled Texans seek a US Supreme Court ruling about the applicability of the Americans with Disabilities Act (ADA) to foreign-flagged ships within territorial waters of the United States. Opposing oral arguments in the case, “Douglas Spector et al. v. Norwegian Cruise Line Ltd.” are scheduled for 9:00 a.m. Monday, February 28, 2005. Douglas Spector, Ana Spector, Julia Hollenbeck (ACLU-TN), David T. Killough (ACLU-TX), and Rodger Peters (deceased), all present or former Houston, Texas, residents, are Petitioners in the Proceedings. The Petitioners allege discrimination against persons with disabilities (PWD) by Norwegian Cruise Line (NCL) in violation of Title III of the ADA. Counsel of Record is Thomas C. Goldstein, Goldstein & Howe, P. C., a Washington, DC, law firm. Petitioners are represented by the Houston law firm, Bruckner & Burch PLLC. “This case concerns the application of Title III of the…ADA…42 U.S.C. 1281 et seq. to cruise lines operating within U.S. waters and in U.S. ports,” according to the Petitioners’ brief. The problem is that a previous ruling by the Fifth Circuit gives foreign-flagged cruise lines unrestricted ability to ignore ADA. On appeal, the court ruled that cruise ships are indeed “public accommodations” and means of “public transportation,” as defined by ADA. However, the law does not expressly state that it governs foreign-flagged vessels. Approximately 96.92% of the cruise industry’s operational vessels bear foreign flags, chiefly for convenience and to take advantage of the more liberal tariff terms offered by the country of registration. American citizens with disabilities contend that Congress never intended that cruise lines should be able to discriminate against anyone in violation of ADA, especially within U. S. territorial waters, merely because their ships may fly a foreign flag of convenience. American citizens using tickets purchased with American dollars from a cruise line headquartered in this country and cruising between American ports cannot be disenfranchised from ADA’s protection by a foreign flag. This case is just a beginning, because it raises numerous far-reaching and worrisome questions about international maritime law and diplomatic courtesy. All Petitioners are members of Wheel Me On, Inc., a not-for-profit advocacy group that promotes awareness about the accessibility needs of persons with disabilities and ADA enforcement.-END- SUBMITTED BY David Thomas Killough, 2300 WILCREST DR, 105 CREST APTS, HOUSTON, TX 77042 Tel: (713) 791-9995/Fax: (713) 791-9958/Cel: (713) 818-7088 email: kilodt@msn.com

Supreme Court
to hear Baytown natives case
Published February 15, 2005
A
Baytown native will have his day in the U.S. Supreme
Court Feb. 28, as the justices hear arguments on whether
a U.S. law protecting the rights of the disabled applies
to foreign-flagged ships operating in
America.
David T. Killough is one of five named
plaintiffs in a federal lawsuit against Norwegian Cruise
Line Ltd. alleging that the company provided them
unequal accommodations in violation of the Americans
with Disabilities Act. One of the other plaintiffs,
Rodger Peters, died last year, four years after the suit
was originally filed in Houston federal
court.
The case will decide whether Congress
meant the 1990 law to apply to foreign-flagged vessels
operating at U.S. ports. Although NCL is based in Miami
and many of its ships are based in American ports, the
ships are registered in the Bahamas.
Killough, a
1962 Lee High School graduate, lived in several places
before returning to the Houston area about 10 years ago.
He is the director of occupational, environmental,
safety and health matters for AARC Environmental Inc., a
consulting firm.
Killough has been partially
disabled since 1998, when a surgery to remove a
cancerous tumor from his left leg damaged some nerves,
partially paralyzing the leg.
But Killoughs
involvement in the suit stems from his capacity as an
attendant to a woman, Julia Hollenbeck, who is paralyzed
as a result of her development of post-polio syndrome, a
condition which affects people who were exposed to the
polio virus prior to the development of the vaccine in
the 1950s.
In 1999, Hollenbeck booked an
eight-day cruise to celebrate her birthday. The ship,
Norwegian Sea, left the Barbours Cut terminal and called
on the Mexican ports of Cancun and Cozumel, as well as
Islas de la Bahia off the coast of Honduras.
I
asked Julia to make sure she was going to be comfortable
on the trip with her wheelchair, and that Norwegian
could appropriately accommodate her. So she contacted
the travel agent, and not being satisfied with what the
travel agent said, she contacted Norwegians U.S.
headquarters (in Miami), Killough said.
He said
the company assured Hollenbeck that the ship, built in
1988, had appropriate accommodations for her and that
she and Killough would be able to participate in the
NCL-sponsored activities at the cruises three ports of
call.
That wasnt the case. We were held onboard
as a captured audience when the ship docked. They had
even gone so far as to sell us tickets to the onshore
activities, but on the day of the activities, when the
ship pulled into port, they wouldnt let us
debark.
Killough said that in Cancun, which is a
shallow-water port, the ship isnt able to pull
alongside a pier, so passengers are ferried ashore by
Mexican tender vessels.
We found out later that
Norwegian had had a terrible experience in the recent
past. A person in a wheelchair had been dropped between
the two vessels and crushed to death, Killough said.
For that reason, NCL officials wouldnt let
Hollenbeck leave the ship. And because the companys
rules required that disabled passengers could not be
left unattended by their companies, Killough was not
able to debark at Cancun either.
While the pair
was able to go ashore at the other two ports, Killough
said, they were not allowed to participate in the
NCL-sponsored onshore activities for which they had
already paid.
We had to hire at our own expense
hire an off-duty NCL employee who was about the size of
Arnold Schwarzenegger. He was able to drive for us and
physically carry Ms. Hollenbeck into places of
interest, he said.
We felt left out. We were a
captured audience, Killough says of their
experience.
They later learned that another
couple, David and Ana Spector, had a similar experience
with the cruise line. Along with the late Rodger Peters,
they filed the original lawsuit in 2000, hoping to be
granted class-action status. The district judge did not
grant that status, but allowed the suit to proceed.
In its response to the lawsuit, NCL primarily
argues that when Congress enacted the ADA, it did not
explicitly state that the law would apply to foreign
vessels. Making it so would subject ships to all laws of
any country they entered, rendering centuries of
maritime law meaningless, the cruise line
argues.
The district judge ruled that Title III
of the ADA does apply to foreign-flagged vessels
operating out of American ports, but denied the
plaintiffs claims that NCL had violated the
barrier-removal regulations of the law.
Both
sides appealed to the Fifth Circuit Court of Appeals,
which held that Title III did not apply to
foreign-flagged ships. But in a similar case out of
Florida, the Eleventh Circuit Court of Appeals made an
opposite ruling, creating a contradiction.
Elaine
Roberts, one of the Houston attorneys representing the
plaintiffs, said the split between the two appellate
courts is probably one of the main reasons the Supreme
Court agreed to hear the case.
Were not trying
to talk about extraterritorial application, foreign
cruise ships that operate in other countries. Clearly,
when you have a Miami-based company like NCL, whose
headquarters is in Miami, all their hiring, personnel,
legal department is in Maimi, and they sail into
American ports, we feel they should be held to
compliance with the ADA, both in terms of their policies
and their physical facilities, she said.
Roberts
said that the plaintiffs and their lawyers feel they
have strong arguments, as well as good company. Aside
from leading disability-rights organizations, the U.S.
Department of Justice and the attorneys general of Texas
and several other states have weighed in on the
plaintiffs side.
Its a shame that the cruise
lines wouldnt look to the public passenger potential
for this. Because, just as a public service matter, you
would think that a cruise line would want to make sure
that its accessible for all of its guests, regardless of
whether the ADA was in effect or not, she
said.
Apparently, NCL doesnt feel that way, and
has actively fought it for five years now. Its a shame
when individuals have to go to the courts and resort to
five years of litigation in order to get something that
you would think would automatically be guaranteed to
everyone traveling on their cruises, she
said.
In a written statement, the cruise line
said that accessibility issues are very important to
both cruise vacation providers and to the traveling
public. The inconsistent court decisions around the
country on this subject are confusing to both cruise
lines and their guests.
The company said that it
was grateful that the Supreme Court is reviewing the
case to clear up the matter.
Norwegian Cruise
Line is proud of its record in accommodating passengers
with disabilities. Just as NCL prevailed in this case in
the Court of Appeals, we are confident that the U.S.
Supreme Court will affirm that NCL has acted properly in
matters relating to disability access, the statement
said.
The company also provided a fact sheet
listing the ways it says it has acted to accommodate
disabled passengers.

Ron Kovic was a guy that suppoted this country, and would of died for this country. As a youngster, he opposed activism, but after serving 2 tours of duty in Vietnam, he eye witnessed situations an oridinary person wouldn't. Why did he change his stripes? Mainly because the Bronx and Queens VA hospitals treated him like dirt when he was a patient there. If you gave your life for this country and got treated poorly, wouldn't you be livid?
I think Kovic deserves a break. If I experienced the same thing he did, I would of probably done the same thing. Granted, he may be a little too far to the left, but I understand what he's doing, and I don't have a big problem with it.
If you don't know much about Kovic, I suggest seeing Born On The Fourth of July with Tom Cruise. It's a great movie, and may get you to change your opinion of Ron Kovic.

Ron Kovic is a true American patriot ---that is, one who stands for the rights of the American PEOPLE, as opposed to the American GOVERNMENT. His disability resulting from the service of that government is (ironically enough) exactly what led him to protest the actions of the government--unjust and useless warfare, genocide abroad, cynicism/apathy/lack of funding at home. Ron was THERE, man!! Who among us is better qualified to speak out regarding these issues? I am now 55 years old (4 yrs. younger than Ron), and my heart still bleeds from Vietnam. Peace, Ron.

I saw him speak in person at the big protest march in Hollywood in March of 2004. I don't know a whole lot about him. But I'm guessing he's not the kind of veteran who sits on a high horse and talks down on younger people telling them to "love it or leave it!" or "show some respect for a veteran!" I suppose we'll see him again this coming March.
