introduction 1

The United States lead the world in export, import, money spent, money earned and just about everything else, yet tragically the us has a high rate of homicide and suicide. When someone kills someone that person goes to jail and is given a fair trial and the verdict is set and justice is served. When someone commits suicide the crime scene is investigated and investigators try to figure out if the person had an accomplice if no one is found then the case is closed. If a burglar steals money from another person an investigation is conducted and the police search for the criminal if he is found then he also goes to court and the verdict is set and justice is served, and the list goes on and on. With all that in mind why is it that only 2% of rapist and sexual offenders are punished for their crime when an act of rape or sexual harassment is committed why is their no criminal investigation why is justice nearly 98% of the time not served. What is the difference between killing someone and raping them even though a victim of rape lives they may be permanently damaged and they may become people or speech shy they may stutter when they talk to a stranger, they may always be in a state of constant paranoia, if not given proper therapy most of rape victims end up committing suicide, they feel that they would rather die than live the way they are living. It seems as though sexual harassment is increasing in schools, more and more there are stories of teachers caught sleeping with students or a teacher forcing him/herself onto a student. In schools not only is their teacher to student harassment but also student to student harassment

____________________________________________________________________________________introduction 2

A freshman her first day of high schools the l4 year old girl scrambles through the hallways looking for her room number then she finds it as she enters the class room and takes a seat she sees that a boy behind her is starring right at her a much older boy she sinks into her seat to try to avoid him but he gets up and sits right next to her after class the boy introduces himself to the girl and leaves after school she notices that the boy is stalking her she walks a little faster but so does he she then begins to run and the boy hunts her down. He then forces himself onto her and the girl is shocked she does not know what to do. The boy tells her that if she tells anyone he would hurt her. What should the girl do now, she may feel ashamed to confront her parents out of fear of what they may do next, and she does not want to confront the teachers at the school in fear that the boy may keep to his word and hurt her. The fact is that many of these cases occur in public schools more than people would like to think, the even more tragic thing is that most children(mostly female) do not know what to do or how to protect themselves at times like these and through ignorance they do not act and let these thing go on and on. The girl in the incident may think that if she would get to know the boy better or get closer to him maybe thinks would be sorted out yet the fact is the closer she gets to him the worse it will be and all that she would be doing is digging a deeper hole for her to climb out of when the incident has passed.

introduction 3

It’s a girls third week at school she has fitted in perfectly she like all her teachers and has already made many friends, yet she is still uncomfortable for it is unknown to the school or to many of her friends that her science teacher is harassing the girl slowly step by step the teacher makes his move at first the teacher may tell the student to stay after class to help him tidy things up or the teacher may talk in a different tone to the student or the teacher may give the girl special privileges, the girl is easy “prey” for the teacher because it is always implied to the students that teachers for the most part are just like a second family and that its okay if a teacher hugs you, but in fact it is not okay. Mean while without the knowing of the girl or any of the other students or staff at the school the teacher has manipulated the student into having sex with him so that the girl would pass the class. When the girl goes home and has time to think about what really happened that day she is in a very bad position she fears that if she tells her parents they may go embarrass her in the school and that if she tells the school the teacher would not pass her she then thinks to herself that she only has a couple more months till the semester is over and she gets a different teacher. The girl may also think of dropping out of school or constantly skipping as an alternative to going to the teacher’s class. What should the girl do? Who can she turn to for help?

body of the report and i think a conclusion

More than 330,000 sexual harassment cases occur each year in the united states, their has been a very sharp dramatic increase in the number of sexual harassment victims in the united states (more women were raped in the year 1990 than in any year prior to that in united states history). Without appropriate actions taken this number will continue to increase. Even worse that that in (1993 the senate judiciary committee determined that only 2% of rapist are imprisoned), what happen to the other 98% of the rapist? (In one survey conducted which surveyed collage men, more than 35% anonymously admitted that they would commit rape or sexual harassment if they could get away with it) if 98% of rapists are getting away from jail time what’s to stop the college men from sexually harassing fellow female students or raping them? The fact is that 1 out of every five college women reported being forced to have sexual intercourse.

Another problem is that the victims of rape or sexual harassment do not know what to do so they keep quiet and they do not tell anyone (over 42% of sexual harassment victims reported that they had told no one their story) when victims do not tell their stories or go to get proper therapy they hold in a lot of stress younger victims may turn into a state of constant paranoia it is also said that less than 5% report their stories to proper authorities.

In schools the definition of sexual harassment is any unwanted sexual advances, requests for sexual favors, or any other verbal or physical conduct of sexual nature. Verbal sexual harassment includes taunting, rumors, graffiti, jokes, or gestures. Physical sexual harassment includes direct contact which includes removing of a persons clothing, brushing up against a person, touching a person without their willing, forcing a kiss upon someone, molesting a person, and many other forms. Sexual harassment is clearly defined as an unlawful act to all students, and the fact that severe consequences would be served to the person who commits sexual harassment still has not stopped the steady yet rapid increase in sexual harassment cases in public schools of the United States.

New studies show that sexual harassment is an increasing problem not just in high school but also in primary and secondary schools. Students in school are supposed to be protected and shielded from images or acts of sexual harassment or anything of sexual nature more and more students are getting involved in sex at younger ages there are even worse problems such as teenage pregnancy.

If a student is sexually harassed by a teacher or other staff member the student may feel uncomfortable and not come to schools at all or even skip classes. Their have been many cases where teachers abuse their powers to overpower a student into having sex with him/her such as in the case of Christine Franklin of Georgia was forced by her coach to have sex she trusted her coach enough to stay with him alone after school to help grade papers but the coach obviously abused his position and before Christine knew it the coach was asking her about how her sex life was going and at the spur of the moment Christine found herself having sex with her coach Andrew hill. Cases such as this are tragic because are not the students supposed to trust their teachers? When a student has a problem in school do they not turn to their teachers first? Some experts feel that students in public schools are given a false sense of security with their teachers the students look to their teachers as a second set of guardians yet this poses many problems because as in the case of Christine Franklin when the student put too much trust in a teacher it could lead to a very bad situation.

Another very common way that teachers abuse their power is to bribe students their have been many cases where a teacher was caught having sex with a student and upon the asking of the child what happened the student would reply the teacher said if I did not do it I would fail the class or another form of bribery is a student may tell a teacher that she would have sex with him in exchange for a descent grade in the first way the bribe was initiated by the teacher in the second way the bride was initiated by the student. It is specifically described in any teacher’s union handbook that the teacher may never hit a student or have any kind of relationship of sexual nature with the student yet why are cases of teacher student sexual relationships appearing more and more?

That is how students are sexually harassed by a teacher but what about students sexually harassing other students? This is the most common form of sexual harassment in schools. The fact is that the average teacher to student ratio in the United States is 1:25 that’s 1 teacher to look out for 25 students and that’s an impossible task especially because students may commit sexual harassment acts in empty classrooms or the bathroom where teachers are not present. Students may commit sexual harassment for personal pleasure or peer pressure for example the many popular cases of the swimming pool game called whirlpool which reached its peak in 1993 but only because of higher security and a mandatory of 2 lifeguards at swimming pools the game is rarely heard of one case of the game happened in 1993 was when a group of seven boys surrounded a girl they all lounged themselves at her trying to each pull at her swimwear to expose her privates they also sexually assaulted her the police were called and within 3 minutes the police jumped the boys in the water and all seven of them were arrested they made examples of the boys because they did not know the seriousness of what they had done or were trying to do (Stan 90).

From a legal viewpoint sexual harassment is an issue parallel to sexual discrimination the united states has declared that sexual harassment is also a form of sex discrimination not only at school but also at work when someone says sexual harassment or rape what do most people think? Usually they picture in their minds a women being overpowered by a man because that’s the fact that it is very rare that a male is sexually assaulted or raped. It is sad that in this day and age women are still view as a sex toy or housewife. Women’s paychecks still do not equal men’s paychecks and with the exception of a few, women are still confined to jobs such as secretary or typists. Although it is very rare their have been cases where women use their ability to declare sexual harassment just to harass other men or they may put themselves in a position where they are prone to sexual harassment whether it be by the way they dress talk or act or where and when they are at different locations when the act is committed against them they sue and get the money because the courts always seem to swing in favor of the victim

People need to take actions against sexual harassment the first line of defense in the attack against sexual harassment are fellow students, teachers are not always with a particular students but students are together all the time maybe if a teacher feels that a student is slacking behind the teacher may feel that something is going on and may choose to have a conversation with the student to determine the problem but usually signs of slacking off in school work are very rare but something that is very common for a victim of rape or sexual harassment is to alienate themselves from friends for example they may not answer the phone if a friend calls or if a friend comes over to the their home they may pretend to always be busy signs like these are rarely picked up by the teacher but are always seen by the student and students should report any problems troubling their peers because these problems may someday affect the school as a whole there is a fine line between a “tattle-tale” and trying to protect your friends one of the most famous tragic cases is the case of the columbine high school shootings after the shootings police interrogated a number of students and all the students said the same thing they all said that the shooters were always saying stuff like I want to kill my self or I am going to kill that teacher and they also said I am going to shoot up the school, while some students passed this information as a joke others completely ignored it but now can anyone ignore the fact that all those student deaths could have been avoided?

Legalities of sexual harassment cases tend to get complicated for example one women sued the school district because her daughter was constantly being harassed by a group of boys and then one say the boys raped the girl and sexually assaulted her. When the case was in court the school defended itself by saying that the girl never reported any of these harassments and that the girl never confronted any staff members, and that no one in school was even aware of the problem the court ruled in favor of the school and declared that the girl should have told someone something, but because she did not the school cannot be held liable for what happened to the girl. On the other hand if a school out of negligence does not react to the complaint of the student the student can then report the problem to an official higher up if the official higher up does not do anything and the problem continues then the school and the school district are to be held liable for their carelessness.

Another fact is that victims of sexual harassment often do not know what to do when they are indifferent situations. During an attack you must never laugh or moan you must always remain quiet also try to look your attacker in the eye and remember your attacker’s description and any physical characteristics and what they are wearing, you must also know exactly what the attacker did to you. Questions a victim may be asked are who attacked you? Where did the attack take place? When did the attack take place? How did the attack occur? Were their any witnesses? Can you prove that you were hurt? A growing problem for law enforcers is that sexual harassment victims or victims of rape tend to over exaggerate the problem or what had happened to them for example one girl said that she was raped by three men but the video camera in the parking lot showed their was only one. That is why courts tend to focus on the effects of the sexual harassment or rape rather than the intent of the attacker.

Although the two are very different some people think that flirting is a form of sexual harassment but its not flirting is welcomed or desired act which is seen as a source of pleasure or fun sometimes seen as a game, while on the other hand sexual harassment is unwelcome and uncalled for its also illegal. Their have been many cases where a women has called sexual harassment on a man who was touching her the mans defense was that he was flirting with her and she welcomed it but even though she welcomed it the man still had to pay the court and the women fines, that is why you must be careful with who you are playing with.

No matter how many times people are told they will never know the seriousness of sexual harassment. While sexual harassment is a major battle, the first place sexual harassment should be stopped is in schools. Schools should be safe havens where children are free from problems of sexual nature, is that not why schools implement dress codes that ban the wearing of skirts that are too high or see through clothes or other revealing clothes. Some people feel that sex education should be removed from the schools required curriculum; they feel that topics of sexual nature are best taught by the children’s parents. Parents also agree that their never should be a standard set by schools on the topics of sexual nature, It’s the year 2003 and sexual harassment and rape still goes on in this country when will it ever stop?
