PHOTOGRAPHER ASAULTED BY POLICE OFFICER: legal help please!

LAPD OFFICER ASSAULTS PHOTOGRAPHER

Today, at the march at the Westwood Federal Building, while I was taking photographs for the LA Indymedia website, I was assaulted by a police officer. His name is Mulberry, badge number 15514 (see photos below). I noticed him attacking protestors at the front of the group and moved in to photograph what he was doing, and also him. When I turned my camera on him (to document his face, badge number, and name), he assaulted me. He first hit me with the tip of his baton in the middle of my chest, just below my collar bones. He then proceeded to strike me at least two more times, injuring my arm and my right leg/buttock area. The last time he struck me I had my back to him and was attempting to move away as quickly as possible. I have photos of my injuries, two eyewitnesses, and possible video footage, and would like legal representation to file charges against him. CBS has (and aired at least twice) footage of the assault on their news broadcasts. They have refused to give me a copy of the footage without a subpoena. If anyone has footage of the whole incident, I would greatly appreciate getting a copy. Thanks for your help, and for the support folks gave me throughout the rest of the day.

I think the problem here is "failure to communicate" when the officer gives you instructions to move, you best comply. Like with most people the officers get tired of repeating their orders to those who chose to ignore them. One easy solution to keep from getting your fanny from being spanked again is, get a camera or lens that allows you to stand a little farther away. If your there to report on the action, don't be part of the action!

Caught in the act

News choppers took video footage from high above the scene. Their footage clearly shows one Officer assaulting demonstrators. Standing in line with other Cops... the offending Officer lurches forward and starts swinging with his baton. After belting a few people (he's the ONLY ONE doing this), another Officer comes up behind him and holds him back.

No... this particular Officer was completely out of line, and it's not a matter of "obeying his orders." The other Officers DID NOT BEHAVE in a violent manner.

You went to a protest and became a part of it. The officer warned you to move and you did not comply, instead you took pictures. When the police warn you to move back, they mean it.

Maybe you can sell your pictures for legal defense, but you get not a penny from me. Next time, bring a telephoto lens. Sorry you got hit, but that's the game you were playing. You just didn't know it. And now you do.

They have the same emotional instincts as the rest of the species. Some individuals are better able to override those instincts than others.

Pointing a camera can be a provacative act. Don't believe me, go down to the Sandiego Wild Animal park and surprise the gorillas with a big white lense and a flash.

They will react aggressively. Smile at them, showing your teeth and they'll get even more upset.

I suspect the "victim" knew what she was doing.

Any cop that steps out of line and hits protesters should be exposed -- and removed from public service ASAP.

Heidi, I heard you and your story on Conway & Steckler (97.1 FM M-F 8-11 P.M.) tonight, and I hope you sue the pants off of that pig bastard. Not all cops are bad, but we have all run into the power-drunk, cocky, bullying bastards that are out there. They need to be stopped, and taught a lesson. We pay their salaries, they are there to 'serve and protect', they are not there to beat the crap out of people or the media.
Don't get me wrong, I support the liberation of Iraq, but I also support the freedoms that we enjoy as Americans. Freedom of speech, and protesting in a peaceful manner are our rights. No single pig with a power agenda should be able to take that away from us. I understand the police have quite a few bad apples; Chief Bratton will take care of that. Believe me, He will deal with any and all embarrasing officers on the force. On the subject of "No Blood For Oil": I believe most of us have had to take History in school; I've never, ever in the history of The United States, heard of our Great Country going to another foreign soil and actually killed people for their riches. On the contrary, we've (USA) gone to other Countries and brought our technology, showing and helping them extract oil and natural gas from their land, helped refine it, and bought their oil. Yes, bought their oil. Never had we killed their people (from Government on down) for oil. All of you protesters need to get the facts straight before you jump on this bandwagon. This shows just how little you really know. I'm not including you, although you seem to be leaning in that direction. Keep your focus and good hunting in the future. The whole Republican party is not David Duke or Pat Buchanan, and the whole police force is not this one man who attacked you. In contrast, over 1,000 militant protesters were picked up just Thursday in San Francisco alone. Perhaps not every policeman is good--but I'm far more concerned about the thousands of law-breaking, vandalizing protesters than I am about a single overbearing police officer.

I appreciate the fact that we live in a country where the police do protect us in times of need, but there is no excuse for the few of them who abuse their power. Yes, I do feel safer knowing they are out there, but the enforcement of the law does not give them the right to beat, abuse (verbaally or physically), or play the power games.
Ever notice that cars and houses in the neighborhood are getting broken into, but the cops are all over yer ass like you are a felon if you get pulled over for a broken tail light? There are rapes, robberies and murders every day, yet where are the cops? I'll tell you where: sitting on their motorcycles with radar guns in a road construction zone on a Sunday when no one is working on the road, pulling over and citing people en masse for doing the normal speed limit. And why? Money!
For health reasons, I cannot drink alcoholic beverages, yet when I D.J.'d at a local bar years ago I was pulled over twice a week by the Garden Grove PD for two years. Searches, sitting on the curb freezing my ass off, being asked if I worked at a gay bar, being cited for a tire that was a 1/16th of an inch too worn, followed for miles, jailed because I had no ID, yet knew all of my info on my liscence and registration, bullied by these losers with a badge.
Watch COPS every once in a while. These assholes pull someone over for a burned-out light, and somehow they turn it into a felony drug arrest. F them. Stop some real crimes, fellas. Stop beating people for expressing their rights.

If a cop (especially now) steps out of line he is thrown to the wolves. The lawyers that make tons of money telling people that violate the law they can get money after getting arrested. There are bad cops and they get taken care of must faster that ever before. But it is the cops cleaning up the ranks. Taking them off the streets when they realize the problems.

The reason that your car is getting broken into, and there are no cops around, it is more likely they are on another call because there are fewer and fewer of them because of budget cutbacks. Some police departments have the same amount of cops they had 20 years ago, that is not a lie. And as for cops writing tickets for money, that is not true. By the time the state takes them money from fines there is very little sent to the cities.

last week or has been injured by the police at a protest in the last week
please email me. We "The Arrested" (mostly a group of us from Saturday's
arrests) had a meeting tonight at the Peace Center to discuss our next step.
We plan on combining our cases and pleading not guilty as a group and are
seeking legal representation and will be interviewing lawyers. We are also
investigating pressing charges against the police for brutality.

Our next meeting is scheduled for THURSDAY MARCH 27th at 7:30 PM at 2170 W.
Washington Blvd. (which is off the 10 at Washington and Western). All
Arrestees and Victims of police brutality are urged to attend.

It is very important that we get in contact with all arrestees and injured
ASAP.

Maybe because it may be a danger to drive your car on the road when it is in that condition! Maybe one day you will appreciate that cop who pulls over people to cite them for a broken taillight or no brake lights the day you rear end someone because you didnt know the guy in front of you was braking since his brake lights werent working.
And for those who are wondering where the police are when "real crime" happens, maybe they are babysitting protestors who dont know how to protest peacefully and are blocking streets for those people who are trying to get to WORK or home or to the hospital cause they have an emergency. Get a real job and quit blaming your deficiencies on the cops.

Look, asshole alleged war correspondent, the lady was taking a picture on the streets of LA - no in some foreign country at a battle line.

The LAPD pigs are totally out of line. They had NO reason to strick her when all she was doing was preserving and obtaining evidence as to what pig cop was using excessive force.

The photographer had every right to photograph the protesters. They were on public property. The police cannot bar the media from photographing events such as these when they are on public property. The police officer violated the photographer's First Amendment rights. He should know better than to assault a working member of the news media. If the officer
would have paid attention during his criminal law classes at the academy and at college, he would have known this. Every criminal justice major (such as myself) knows all about the First Amendment!

You obviously have never known a real police officer.

Most, if not all of your comments are pure bullshit. From reading them I somehow come to the conclusion that you are 16-18 years of age, with poor school grades and a minimum wage job that includes asking people if they want fries with their order.

Police officers are indeed human beings. But just like any other profession, we have our share of misfits that slip by the hiring process and give us a bad name. For the most part the men and women in law enforcement are dedicated people who care about trying to make this world a better place to live. A great many of us have prior military service AND higher education degrees (in fact in most cases several degrees). Yet armchair lawyers like you seem to take great glee in spewing inane drivel about us based on nothing more than the actions of a few despicable people who should never have been allowed to wear a badge, and your self styled "expertise" from watching too many episodes of "COPS".

We are the first people called when there is a deranged lunatic running around with a gun shooting someone, or when a drug dealer is trying to sell crack to your kids. We are the first ones lambasted by you for pulling you over for speeding or when we arrest you for driving drunk. You get pissed off when you see two of us on the side of the road together talking, (and are even angrier when we don’t show up 5 seconds after you call the phone because the kids next door are making too much noise with their music) not knowing that we are probably exchanging information on a serial rapist who is working in our area, or intelligence on the latest gang activity. Sure we might also be discussing the latest ball game, (speaking about bad role models, what about those overpaid scions of depravity?) but then again we are allowed to on break aren’t we? I’m sure that NONE of you have EVER talked about anything else at work other than work. In fact I’ll be willing to bet a months salary that MOST of the comments made on this forum were done while the authors were at work!

We are criticized for using “excessive force” when trying to take a drug crazed man waving a knife into custody and end up having to shoot him because he lunges at one of us with the knife. You think that the crap you see in the movies where the detective shoots 100 yards with a 2 inch snub nose revolver and hits a guy in the wrist is reality and that we can shoot the suspect in the hand and just wound him. I want to see any of you try to shoot something the size of a human fist moving at about 40 miles per hour, with 150 foot pounds of force that only has to travel 2-4 feet before it kills you. You can’t do it, why do you think police and military are trained to shoot for the center of a person’s body mass?

We are asked to do a job that most of you are incapable of doing, or unwilling to do yourselves, but yet we are the bad guys. WE are the ones who have to find the elderly shut in that no one has seen for three days, that no one else bothers to check on until they call us, and who has fallen down in their house and died from exposure. We are the ones doing CPR on crack addicted babies born to junkie mothers, or who have to carry the corpses of the children beaten to death by abusive alcoholic fathers who got mad because the baby messed their diapers. We are the ones who see all of the worst of humanity, day in and day out, who the public expects to act like emotionless robots regardless of the shockingly insane brutality we see people doing to one another, and yet we still come back the next day in the hopes that maybe today we will make a difference and actually be appreciated for everything we do.

I’m not saying any of this to justify the actions of the officer who hit the author of this story. I’m tired of people like you painting ALL of us as jack booted nazis just because a few cops step over the line. I guess NOONE ELSE in the world has ever done anything wrong right? All doctors, lawyers, judges, politicians, journalists, contractors, bankers, investors, ball players, actors, musicians, ministers, businessmen, etc. etc., ad infinitum have been paragons of professional ethics right? Only the cops EVER cross the line, the rest of you perfect people walk on water.

As far as I am concerned, if you have never walked the street in a cop’s uniform, with that badge on and done the things I have been asked to do, and seen the things I have been forced to see, all in the name of “serving and protecting” a public that treats us like trash, and for a society that is deteriorating every day you can keep your uneducated, inexperienced and irrelevant opinion to yourself.

I am a police officer in a college town. We deal with protests and "civil disturbances" quite often.

First, I don't know what the actual events were that happened that day, so I cannot pass judgement on your credibility or the officer involved. I am sorry if you were a victim of an unjust use of force.

However, I ask that you not use the words "pig" or "nazi" because all that does is make you look less credible. Go onto the LAPD website, and go to the awards sections, and read some of the incidents they have dealt with, and at the least, understand what we do.

And for all of those you call police ignorant, nazi pigs, look at yourself in the mirror, take a good look, and realize that you are being ignorant, thinking all police are the same. Then read a book about nazis, and you'll see what they did to people, because your comparason of police and nazi is uneducated and juvenile.
