JUDGE REJECTS PLEA FOR RAISETHEFIST.COM WEBMASTER

by updater Tuesday, Oct. 01, 2002 at 10:35 PM

.

JUDGE REJECTS PLEA FOR RAISETHEFIST.COM, SHERMAN AUSTIN

Raisethefist.com, Sherman Austin went to court on Monday, Sept 30th to plead guilty to felony: 18 U.S.C. 842 (p)(2)(A): DISTRIBUTION OF INFORMATION RELATING TO EXPLOSIVES, DESTRUCTIVE DEVICES, AND WEAPONS OF MASS DESTRUCTION WITH THE INTENT THAT SUCH INFORMATION BE USED IN FURTHERANCE OF A FEDERAL CRIME OF VIOLENCE. The plea bargain was to give Austin a felony conviction with 1 month in jail, 5 months in a half-way home and 3 years supervised release.

As the prosecutor read the factual basis of the plea agreement in court, Judge Wilson immediately turned defiant, saying 1 month in jail was not acceptable. He expressed that posting such information regardless of any intent should be illegal, (this of course completely disregarding the 1st amendment and the thousands of NON-ANARCHIST web sites which distribute bomb making instructions), stating that the offense is too serious for Austin to serve only 1 month in jail. Judge Wilson argued that Austin should serve more than 12 months, even though the sentencing is between 6-12 months for Austin's criminal history category under violation 18 U.S.C. 842.

The judge also attempted to make Austin out as a terrorist, saying he didn't care how old he was, that his political philosophy behind his reasons of posting the information made it a very serious federal offense, with the intent that the information be used for malicious destruction at international events of foreign commerce.

Austin's attorney argued that the intent of posting the information was not that it be used for offensive purposes, but that it would be used in a self-defense manner only if police were to violently attack demonstrators, putting them in danger and disallowing them to exercise their freedom of speech.

If going to trial, Austin faces 3-4 years in prison if convicted of both felony charges: 18 U.S.C. 842 (p)(2)(A): DISTRIBUTION OF INFORMATION RELATING TO EXPLOSIVES, DESTRUCTIVE DEVICES, AND WEAPONS OF MASS DESTRUCTION WITH THE INTENT THAT SUCH INFORMATION BE USED IN FURTHERANCE OF A FEDERAL CRIME OF VIOLENCE; 26 U.S.C. 5861(d): POSSESSION OF A FIREARM WHICH IS NOT REGISTERED TO HIM IN THE NATIONAL FIREARMS REGISTRATION AND TRANSFER RECORD.

Once indicted, a plea would offer Austin 6+ months in jail.

On January 24th, 2002, Sherman became one of the first victims of the new USA Patriot Act when 25 heavily armed FBI agents and secret service surrounded and raided his home in Los Angeles because of his anarchist web site http://www.raisethefist.com. All computer equipment along with political literature, even protest signs were seized and loaded into a big white truck.

Austin was not arrested until a week later when he decided to attend the World Economic Forum protests in New York. He was arrested by New York police after being targeted law enforcement officials. After spending nearly 30 hours in jail, Austin was taken into a back room in hand cuffs and interrogated by the FBI and Secret Service for several hours. 10 minutes later he was released from jail with charges dropped. Within minutes he was re-arrested by 6 FBI agents and placed in maximum security federal prison. At his bail hearing he was accused of driving 3,000 miles carry out his "plot" of mass destruction against the WEF event, and on the way back to "blow up" the Olympics in Salt Lake City, Utah. Even though federal agents searched his car in New York, and found absolutely nothing, and there was a blatant lack of evidence, he was denied bail and the judge ordered Austin be transported to California with a US Marshal escort, as the judge felt "the Government has also shown by clear and convincing evidence that there is a very serious risk of danger to the community"

While awaiting finial extradition to California at a "hub" for prisoners in Oklahoma. Thomas Mrozek, public affairs officer for the U.S. attorney's office in Los Angeles said, "We have opted not to seek an indictment at this time. We are continuing to investigate the matter, but as of right now, he's off the hook."

Screw the judge and fuck the FBI. But a good thing that Austin goes to trial to strike down this unconstitunional piece of shit legistlation.

I vow to keep the Reclaim guide available online with a proper disclaimer: I do condone, advocate and incite the use of violence against law enforcement authorities and political figures including the president of USA.

So SUE me FBI. Sue the entire Internet. Let's see, if the First Amendment has become a casuality in the so called war on terrorism.

SHUT THE FUCK UP

by Perspective Thursday, Oct. 03, 2002 at 8:49 PM

Maybe people should think twice before making statements like "Death is the Solution". In the past, court cases like Jeffrey "Free" Luers', who is currently serving 22 and a half years in Lane County Oregon for the torching of three SUVs that were then sold, was treated with much more sever penalties quite possibly because of some invisible people's communique mentioning his name for another series of SUV burnings. Maybe these statements can wait ex post facto. Until then, SHUT THE FUCK UP!

some of you folks are honest enough to acknowledge that your goal is to kill people.

That doesn't make you good people -- it makes you wanna be murderers.

The so called "progressive" movement has copious blood on its hands, and is constantly seeking to add more.

Kudos for Judge Wilson. Sherman was willing to admit to his crime, obviously because he was in fact guilty!

But for the intervention of law enforcement, who knows how many innocents would have been killed with bombs made at his direction.

Grow up

by Mordecai Wednesday, Oct. 09, 2002 at 3:37 PM

Your anarcho-protest movement is skewed and laughable. Your goals for "change" admittedly radical, etirely predictable, and utterly inane. You hide behind race and rhetoric, and are unwilling to face or accept the consequence of your "action" in a society built on laws. Be the laws biased or not, malicious or benevolent, some laws are viable and necessary to protect the average citizen from imbeciles who wish to incite or are willing to provide violent meaures to counteract what THEY see as offensive to their silly litany of woe against the institution. If a change for the better is what you seek, use whatever is left of your intelligence within that skull filled with brainwashing and misconstured foolishness. Anarchy is a joke, period. Ask the Bosnians, you wankers. Your Utopian anarchic society cannot and will never exist in this reality. The brainiac behind Raise Your Fist (and sing along with Dio or Crue?) is getting exactly what he deserves, so... grow up.

when the law becomes tyranny, self-defense becomes duty.

by rtf Wednesday, Oct. 09, 2002 at 8:40 PM
blackstarliberation@yahoo.com

Spend only a few minutes searching the internet and you'll see it's not against the law for any other web site, which is not anarchist to post the exact same information, if not, even more of it. The information contained on raisethefist.com was absolutely nothing you couldn't find on any other web site, or in any library. Nevertheless, I didn't even author it. However, since it was found on an ANARCHIST web site, that's where the law had to selectively intervene and say, "you broke the law". The law likes to talk about 'taking responsibility', yet it's so quick to accuse those who are the very victims of abusive police who don't get held responsible for their brutality and murder which they inflict on our communities. The law doesn't hold the police accountable when they're firing their rubber bullets, cracking their batons over peaceful demonstrators, brutalizing, criminalizing, or even murdering people in our community. But when a victim of this violence tries to defend him or herself against such blatant tyranny, they're called a criminal, a terrorist, and accused of endangering the lives of others - while at the same time pigs occupy our streets and TAKE the lives of people in our communities. How long are you going to wait until you realize that self-defense is our only defense.

The actions from the feds have blatantly admitted that self defense is a crime. They've made it a crime because it's the only thing we have against tyranny. It is the only thing we have against police beating, criminalizing, and gunning down people in our communities.

Self defense is not a crime. A crime is teaching a man or women not to defend themselves when they are the constant victims of brutal attacks.

A technicality

by gremlyn Thursday, Oct. 10, 2002 at 7:23 AM

The legality of Sherman's case is a technicality. He was very obviously targeted for his general beliefs and the over-all views on the website.

The fact that http://www.raisethefist.com became so popular, I believe, is what triggered this whole extravaganza. I wish with all my heart that Sherman had NOT plead guilty. If he is convicted, we might as well open the flood gates for the FBI and turn ourselves in.

We need solidarity at this point, and please, a bit of tact. There is something to be said for strategy.

FREE SHERMAN!

To T-Mex...I'll be the first to admit that anarchy is currently, at best, an ideal. However, without ideals, where would this country be? Would we even have a constitution? Anarchy is a viable alternative on a small scale. Instead of bashing those who hold it's ideals, why don't you try to first find out what those ideals are? There are two things that really get me down; complacency and ignorance. Get a grip, and a clue.
Defeatist pessimists are the last thing we need.

fed up with the feds

by Randolph G. Grant Iv Thursday, Oct. 10, 2002 at 11:59 AM
rgrant@ucla.edu (310)649-0516

I have met Sherman a few times, I have heard the brother speak out on his views and while I don't agree with everything he says I strongly belive he should have the right to say what ever he wants. If Sherman chooses to use the internet to make himself heard as I am doing now to make myself heard then he should be absolutly free to do so. What we have here is a federal government who has strayed so far from the constitution that they (the feds) have to supress all of us out here who took the time to read the damn thing and demand that our rights be given to us. Let me quote from the constitution for a moment here...
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. That sounds pretty straigth and simple if the congress made a law which would in anyway impinge upon Shremans freedom of speach then that law is null and void. Too bad this federal judge is not living up to his oath to uphold the constitution, if I were Shermans judge I would file a motion to recuse the judge on those grounds, but hey thats just me. In closing I would like to say to all you good people out there who are speaking out against the tyranny that is taking place in the USA keep the struggle going. And to all you cowardly federal agents too scared of doing the right thing and speaking out against the orders of your corrupt superiors, grow some backbone, and to the sadistic criminals who are playing the role of defenders of justice and freedom, do us all a favor and resign.

crime?

by updater Friday, Oct. 11, 2002 at 10:26 PM

" If we he did was legal, one wonders why he was prepared to admit to having committed a crime."

Sherman didn't admit to comitting a crime. He admited to knowingling posting the information on his site. How is that a crime? That is actually perfectly legal. What's illegal is having INTENT in posting the information. The FBI say's Sherman's intent was that the information be used by him and "his followers" to disrupt events such as the IMF, WEF and Olympics. Each time Sherman was stopped at these events by law enforcements, they found nothing on him. Not even a freaking sling shot. So instead the FBI is trying to prove that Sherman's intent is the meer existance of his radical politics which see to advocate self-defense. The FBI is trying to distort shermans politics as making self-defense look like terrorism. Sherman openly advocates self-defense, so there's nothing to hide about that. He also condemns international terrorism, as you can read on his web site. The FBI is angry because they see that self defense is indeed an effective tactic amongst the oppressed, which can be used to no longer accept, and recognize the abbusive authority in power. This pisses the FBI off to a point where they have no choice but to label it as "terrorism" in order to look justified in coming after him. The FBI obviously has no problem with pigs gunning down black people time after time, or shooting rubber bullets at children and peaceful demonstrators, or cracking their batons over peoples heads. But they have a big problem when people choose to defend themselves against such blatant tyranny. This is why the FBI has decided to target Sherman, because they've decided that self-defense is now a crime. And if I remember correctly, sherman said what he did was not a crime, a crime would be teaching a man or women not to defend themselves when they are the constant victims of brutal attacks. Just because Sherman signed a plea doesn't mean he felt he comitted a crime. He was put into a corner, especially in today's "every decent is a terrorist" climate. This movement doesn't have far much the capacity that movements int he 60's had, when people like Huey, or Assata got popped by the state, and were able to get saved. Until this movement reaches that capacity, you can't blame anyone for copping a plea when they have so much at stake. This isn't a few months , it's 3-4 years. And if terrorism enhancement applies (which the judge decides) it's 20 years.

I'm just quoting the post:

Sherman Austin went to court on Monday, Sept 30th to plead guilty to felony: 18 U.S.C. 842 (p)(2)(A):

He went to court to plead guilty to a felony. Felony means "serious crime".

So, I guess you're asking "how is a crime a crime?"

it seems necessary for the court to prove that he had intent to cause destruction. however, with the recent 9.11/terrorist shenanigans, i fear it may not be difficult to scare a jury into a conviction.

time will tell. i think that one of the most important things right now would be to make people aware of what's going on.

Anybody read th eposted info

by jc Saturday, Oct. 12, 2002 at 12:59 PM

The posted information is a joke. Their is far more dangerous information on the web. There is nothing in there that can make an explosive dangerous to the public. Even the part about fuel fertilizer bombs is extremely brief and filled with no more information then could have been picked up by watching the Tim McVeigh trial on CNN. Instead, the majority of the information listed is for making small explosives to be used in such ways as "making a firewall that police will not walk through". Also the link to the explosives section contais a minority of the information posted. Rather the majority of the info is about shield walls, defending protestors from arrest and that sort of thing. This whole attack on Austin is ridiculous.

For all you out their who are willing to condemn him: educate yourself about the issue. The things you are saying are ludicrous.

sit around and complain?

by protest boy Saturday, Oct. 12, 2002 at 3:02 PM

this debate, and support for sherman is all fine and dandy; however, it is doing nothing to help his situation. i understand that we need to voice our views to others, and in this case the public is who should recieve the message. if all the public gets are the stories of this incident that the media provides, sherman will continue to look more like a criminal and less like a defender of rights. we need to find out when the trial will begin, and take to the streets. even if you just print out a bunch of stickers and slap them wherever-the-hell, your voice must sound. a public protest MUST happen at some point during the trial, and i am willing to organize some sort of group meeting in my area. please dont just sit here and talk -- if this is all that happpens the conformed idiots who have posted above will be right about resistance to this crooked faction being a joke.

This Prosecution...

by Diogenes Friday, May. 02, 2003 at 8:05 PM

is a rank obscenity against the Constitution. I have never
been a big fan of Sherman's Web Site. A little too strident
and over the top for my taste.

However, I support unreservedly his right to express his
opinions.
What has transpired in this persecution is nothing more
than legalized extortion. It is a clear violation of the First
Amendment and the Judge should be ridden out of town
on a Rail - after a sufficient quantity of Tar and Feathers
have been applied.
Perhaps a good 6 inches would suffice.
