Pacifica Exe Director position is in confusion still putting KPFK at risk

Pacifica is in broken shape, in at least two separate pieces: The Executive Directorship is allocated to 2 people by at least 2 groups. One is Summer Reese, [ a long time PNB chair and member, and she was contractually hired after many months working as interim ED ] and the other is Bernard Duncan, former KPFK general manager [ who claimed to be going to NZ to be with his girlfriend and he left his KPFK position months before his contract was up.]

"….with unclear lines of authority and dueling national offices (one set up on the 2nd floor inside of KPFA).

Siegel and Yee partner Alan Yee appeared solely representing disputed board chair Margy Wilkinson. Yee's employee Jose Luis Fuentes is the author of the motion to fire Reese. The Pacifica Foundation and the 11 remaining defendants had no legal representation. …

A procedural requirement to individually serve 12 defendants in 5 different cities (including one with no established place of residence) was virtually impossible in the abbreviated time frame between the filing on April 3rd and the hearing on the morning of April 9th.

The judge indicated an inclination to grant the requested injunction and set out an expedited schedule to get the matter back into the courtroom as soon as possible…to May….

A Board member Lydia Brazon, one of the defendants, engaged in private correspondence with former CFO Raul Salvador, who was let go on January 2, 2014. Only 4 days after the board decision, Brazon assured Salvador on January 6th he would be re-hired, doing so prior to the election of new board members. [t]Here is Brazon's email of January 6th, 2014….

Oakland law firm Siegel and Yee attempted on March 28th to route Pacifica's payroll processing through their office, asking Pacifica's payroll administration company to contact "their office" for instructions. The law firm's attempt to take over Pacifica's internal operations was rejected by the vendor, which forwarded the correspondence to national office staff at 1925 Berkeley Way….

Dan Siegel represented the Pacifica Foundation in the mid-2000's during multiple employee sexual harassment complaints against KPFK manager Eva Georgia. Siegel represented both Pacifica itself and Georgia personally in the two suits, one by news reporter Mollie Paige, and after settling both,, ascended to the interim executive director position.

He then negotiated Georgia's generous severance package with his former client. His firm Siegel and Yee, then billed Pacifica for several hundred thousand in legal fees. It is expected the entire mess cost listener-sponsors in excess of 0,000….

Siegel then did a repeat turn as corporate counsel/interim executive director in 2007-2008, and in March of 2008, fired national election supervisor Casey Peters and named himself as his replacement, thus filling all 3 positions simultaneously.

In 2009, Siegel ran for the local KPFA board and testified against Pacifica under oath that former CFO Hicks was victimized by racist attitudes resulting in a 0,000 settlement. Siegel resigned from the Pacifica board on January 9, 2014 to run for the mayor of Oakland. He is currently polling at 6%, according to a late February poll…..



Houston station KPFT's license expired in August of 2013. WBAI's license expires in June of 2014…”

All us locals in Los Angeles have to question KPFK directly : about how their just recently exited general manager, Duncan, just left his duties there to then be placed in an apparent attempt at a much higher status position - as ‘Pacifica Exe Director’, or maybe as interim one - and placed there by a group that claimed authority,

And the small majority rules ? – only 12 of 22 PNB member group - suddenly determined that Summer Reese was no longer employed – even if she was hired in a January 2014 legal contract ?

Did Duncan know all that he was going to achieve when he chose to leave KPFK in the lurch and exit the scene – for promised higher status and more money position at Pacifica ?

And who did he tell at KPFK or in Los Angeles, where everyone else assumed he was being loyal to his station and position there?

Or who else knew ? [this info emerging is a surprised even to some of those who non-officially continue to be involved and concerned about KPFK’s existence, Integrity and continuance.

Who knew or helped him leave early ? or with a lame excuse before he left – his not saying that he was going to try to move up and up and up the ladder, or is he working to do so ?

What secret collusions and doings were going on in hiding while the ever longer pledge drive was driving KPFK listeners away with the lengthy and boring fund raising that went on 24 hours for 27 days....supposedly then under the new interim GM from KPFA ?

Was the interim GM from KPFA Berkeley in on the plans ? so Duncan could move 'ahead' to greater fame and power and money ?

Were the local staff informed ? And did they take any actions? Could they help or hinder Duncan in his moves ?

Were the LSB members of KPFK informed ?

or did they agree to any of what then transpired to their station's GM manager?

Strange stories will surely be exposed someday, hopefully soon enough to ask for all the pledged monies back however it may be gotten. An explanation and revelation of what has been apparently in the works for a while, or could spontaneous restructuring of all Pacifica ‘just happen’ by spontaneous combustion with no incendiaries ?

Our GM Bernard Duncan fooled us ?

How did Bernard Duncan fool us all ? He came to LSB meetings pretending he was 'leaving early… for personal reasons' and not stating any other plans or dates when asked directly by members there a few months ago.

Didnt he know what he was doing ? Or was he deceiving all LSB members ? did he also deceive all the KFPK staff too ? Or selective ones and not others ? Who knew ? who knows ?

A few recent months ago a heavy meeting with many KPFK staff, and some programmers - and people with a clear agenda that they did not voice or make clear - were at LSB meeting to promote their favorites: Alan Minsky was lauded for being interim program director and it was said he should stay [to not be let go, promoted, fired or what ?]

When LSB members were asked what the big audience and commotion was about, no one in public at the meeting responded ...at all...so those 'in the know' did and all the others did not.

Those who cant or dont attend the lengthy boring conflictual LSB meetings and yet who pay and pay and listen and pay more did not know anything at all, of what was happening anyhow ...behind closed locked secreted doors.

This is what has been carefully branded as "free speech" public sponsored FM radio ? huh ? where, what ? This cant be the same KPFK at 90.7 FM that continually audio-faces sideways to sell premiums, to beg for money, to plead innocence and to insist it is NOT LIKE ALL THOSE HYPOCRITES AND LIARS elsewhere... and then when the inner staff, gen'l manager and others are doing just the same that they hate in our US governments' doings.

what is happening ? Exposure in Los Angeles is nil and none.

and Bernard Duncan, who came to work at KPFK in 2011 - claiming loyalty to KPFK and it's listener-subscribers - has secretly silently re-appeared recently as an [maybe interim, maybe permanent ] Executive Director of Pacifica – announced in some places... but not audible nor visible in LA.

Is this true ? Could he do this to his former sponsors and employers? Did he step Out of KPFK to uplift hisself up to a higher position on top of the heap ? All by hisself ? Or with whose help or push ?

What in hell, or like hell, is going on at Pacifica ?

Where is any truth about KPFK and Bernard revealed? Fact check - but not on google because it doesn't seem to produce the stories found about KPFA and Pacifica written elsewhere.

this interview was re-played on KPFK 90.7 FM radio April 15, 2014 at 10:15 am.

the initial part was not transcribed here but this interview came on suddenly and was begun after another person was interviewed on the program. This recording [date it was done was not heard to include here ] did not appear to have more information to clarify what was the intention or whom Bernard refers to when he uses the words “they” and “we” in his replies to Mitch.

If anyone has better clarifications and identifications, it would be helpful to have further elucidation to this impromptu transcription – provided here to INFORM ALL KPFK LISTENERS AND SPONSORS as an update of what else has been noted elsewhere.

Bernard was for about 3 yrs the Gen’l Mgr at KPFK and left his position a few months before contract was completed with statement “for personnal reasons…” to return to New Zealand to be with his girlfriend who was going there. that is all the information that was provided to KPFK LSB public members about his early departure from his job.



M = is Mitch Jeserich = hosts “Letters & Politics,” of KPFA –Mitch works at KPFA Berkeley and is replayed on KPFK at 10am weekday mornings

B = we need to run this like a business…THEY [who is “they” was not clarified nor stated openly as heard on air ] asked me to… we need to match that with …..I need to know what is coming in and going out, it is a business….. work as a team …..be of service to the public, to people who pay for service…..be sure we can pay the bills – that is the problem right now

M- status of WBAI struggling economically for years now, errors at WBAI, what is going to happen there in future, will network still run it or run it locally

B- lots of Q regarding that, I understand WBAI is a very valuable frequency, great, but If listenership is dropping because of what they offer we need to look at it as a business.. I have NO DOUBT they will continue to operate in

M = Ella May agreement? [this is what words sounded to be, but could be similar sounding words that are unknown to transcriber to confirm ]

B- I am not sure about that…explain to listeners what that means :

M-==ownership of signal, but we would rent it out to a public radio

B- that was my understanding of the situation. Pacifica Fdtn Radio owns frequency and we need to look at it in a holistic way…we need to look at stations individually and in a holistic way

M- WBAI will operate as a Pacifica station ?

B- yes, for sure.

M- ending employment of Summer Reese – has been horrible regardless of which side.. embarrassing to network…people will ask why they should donate ?

B- my position on elaboration of the situation - a lot of stuff thrown around on Facebook, to and fro from network – I have not engaged in any of that but I have not been involved in the tennis match….

M-= many have not been involved on the air

B- yes……..[missed a few words here ] …. not true, elaborations, continues to be a variety of stuff about my history and people involved in this tit-for-tat battle I will not be engaged in.. network needs to move forward and get better and better ……. we need to move forward…I have not been involved in any of the stuff that is going on around behind the scenes…we [ B did not clarify who is “we” vs. anyone else here ] have not been engaged because we want to just keep doing what the People want us to do..

M - I hope people want us to do

B- yes, I agree completely

Pacifica's turmoil updates here

Reposting here excerpts UPdating what else is occurring that affects our KPFK seriously.

KPFK's chair of LSB has visited the national office located in Berkeley and is mentioned below.

The turmoil is confusing and maybe even dangerous to our local radio station KPFK at 90.7 FM, tho no sounds come out of there telling us the precipice it may be on - especially when our just prior Gen'l Manager has moved into a top dog position that is claimed to be legal and correct - as interim Exe Director of Pacifica Fdtn.

There has been much conflict with who is Pacifica's legal counsel, who is Pacifica's Exe Director, who makes decisions that affect the whole empire that seems to be toppling or at least shaking up now. And where else but here at INDY is any information being revealed?

“Camp Pacifica enters its 4th week at 1925 Berkeley Way where Pacifica's National Headquarters remains free of the rogue board's takeover attempt.

On Monday, KPFK local station board chair Tej Grewall came to visit Camp Pacifica. She had to be told it was not okay to take pictures of people at the office without their permission. Pictures were deleted from her phone prior to her departure. A Google Glass moment.”…
