TO THE INTERNATIONAL COMMUNITY:
Through this communiquè we wish to expose the brutal
violations to the human rights that all of our
comrades from various social organizations and civil
population have been subjected to during the
manifestations against the third Summit Meeting of the
European Union, Latin America and the Carribean.

WE EXPOSE:
1.- The acts of intimidation and repression on the
part of the police and federal and state security
forces started days before the meetings, by means of a
constant campaign of pursuit, not only against
activists, but against any person that was seen
dressed differently, with this violating the right of
free passage.
2.- On May 27 activists camping in plaza Juarez were
surrounded by riot cops and not allowed to exit from 8
PM until 3 AM , a clear violation of their personal
rights.
3.- During the protests on May 28th, around 6 PM the
following occurred: the prescence of police
infiltrators and provocators, the fact that the riot
cops that repressed the protestors were members of the
milititary police (PFP) and military personal dressed
as civilians to enact their form of highly coordinated
psychological intimidation.
4.- Also during the protests on May 28th, the police
used unconventional arms of dispersion like pepper
spray, tear gas, and toxic foam, as well as batons to
excessively beat the protestors.
5.- All the arrests were made in an indiscriminate
manner with the use of excessive violence not only
during the protests, but afterwards when many
retreated passively. Street sweeps were also
implemented throughout the night, with the police
arresting anyone young and dressed differently,
violating the right to freedom of expression as well
as freedom to protest.
6.- The protestors were illegally detained, as none
were caught in the act of a crime,and taken to the
jail, where they suffered constant beatings. During a
period of 24 hours they were disappeared and denied
all communication with friends and family, while the
authorities denied that they were in custody.
7.- On May 29th, after the arbitrary detencion of
bystanders and protestors, among them members of the
organizations that have signed below, a passive rally
was realized in front of the seretary of security for
the state of Jalisco on May 29 at 4 PM, where various
people were being detained. Here the situation
presented itself again: with the constant and
irrational pursuit by the police (who stood near the
human barricade) continuing. An action was realized
by provacators with the intention of ending the rally
while under cover cops insulted us. During the entire
rally the state security forces intimadated the
protestors, taking photos and videotaping. In a
concious and passive manner a commision was allowed to
enter and negotiate which resulted in the release of
10 people (who now are able to give testimonies of the
situation of those still detained). After the 10 were
released it was decided that the encampment would
remain until all detainees were released. At this
point the aggression of the police intensified, with a
large contingent of riot cops mobilizing for
intimidation purposes. The encampment decided to
avoid confrontation and moved to Plaza Juarez.
8. The actual situation of those detained clearly
infringes upon their basic human rights:
-Neither food nor water has been given in the last 36
hours
-All information has been denied to family and friends
of confidence
-Charges have not been given to detainees, nor who
accuses them and with what evidence
-Lawyers have not been able to work in the defence of
the rights of the accused
-The authorities have not given an official statement
of the people detained
-Those detained have been threatened and suffered
physical and verbal aggresion, and some women have
been forced to excercise nude
-All detainees have been coerced with threats to sign
confessions that they had no part in writing
-The state commision for hunman rights has not
defended at any moment the individual rights of those
detained
-The government has asigned public defenders who
solely act as witnesses
-The only evidence given for the accusations are the
testimonies of the police
-The few who were released have been subjected to a
campaign of psychological intimidation, including a
specific case where two women were followed to the
hotel where they were staying
-Sufficient medical attention has not been given to
the wounded detainees. Specific medications have been
knowingly denied to the detainees
-The detainees in critical condition have not been
given sufficient attention, which could later lead to
grave consequences (Such is the case of Liliana
Galavis Lopez who has a concussion from a wound of 10
centimeter diameter as well as a jaw injury of unknown
seriousness)
-The authorities confirm that all those being held in
the Public Ministerial have been accused with evidence
of supposed illegal conduct, although it is known
through accounts of families detainees that some have
no political affiliation of interest in social
movements and are detained due to coincedence and bad
luck, solely for being in the wrong place at the wrong
time
9. We would like to make known to the international
community the names of those detained, who are the

10. All of the following rights have been denied by
the authorities:
Article 1- In the United Mexican States, every
individual will enjoy the guarantees that this
Constitution grants, which shall not be restricted or
suspended except in the cases and with the conditions
under which the same is established. (During the
repressive actions of the state and federal
government on the 28th of May the city of Guadalajara
took away the individual guarantees given by the
constitution)
Article 6 - The expression of ideas will not be the
object of any judicial or administrative inquiry. (In
the case of those detained it is clear that they were
objects of arbitrary abuse by the by authorities,
being repressed, tortured, and harrassed for the
simple fact of protesting)
Article 9 The right to associate or peacefully
assemble for any lawful purpose shall not be abridged.
Article 11 - Every person has the right to enter the
Republic, leave it, travel through its territory, and
change his or her residence without the necessity of
an identification card, passport, safe conduct pass,
or similar item. (Violated during the police
kidnapping of youth in Plaza Juarez on May 27th)
Article 16 - Nobody can be disturbed in his or her
person, family, residence, papers, or possessions,
except by virtue of a written order by a competent
authority, that is founded in and motivated by legal
procedural cause.
No order of apprehension and detention can be issued
except by the judicial authority, preceded by a
denunciation, accusation, or complaint about a
specific action determined by the law to be an offense
for which the individual may be punished by loss of
liberty; and there exist facts to support the
punishment and the probable responsibility of the
accused.
The authority that executes a judicial order of
apprehension must put the accused at the disposition
of a judge without delay and with the strictest
responsibility. Failure to do so is subject to
criminal law.
No accused person will be detained by the Public
Ministry for more than 48 hours, within such time as
the accused must be set free or put at the disposition
of the judicial authority. All abuses of the above are
subject to punishment by criminal law.
Article 20 - In all criminal processes, the accused,
victim, or person offended against by a crime will
have the following guarantees:
A. Of the accused:
I. Immediately when he or she petitions for it, the
judge should always grant provisional release under
bail, except for crimes which, because of their
seriousness, the law expressly prohibits this benefit.
II. The accused does not have to confess. Prohibited
and punishable by criminal law are: holding the
accused incommunicado, intimidation, or torture.
Confessions given to any authority other than the
Public Ministry or judge, or before these without the
attendance of his defender will lack all force
whatsoever.
III. To have a public hearing within 48 hours of being
consigned to the judicial authority with the name of
his or her accuser, and the nature and cause of the
accusation, at the end of which it is very apparent
that the punishable act is being attributed to the
accused, and the accused may answer the charge,
stating in this act his opening declaration.
V. To have the witnesses that have things to say about
him or her, allowing for the time that the law says is
necessary, and to have help in obtaining the
appearance in court of those persons whose testimony
he or she wants, always having them meet in the place
of the process.
VII. To be provided all the facts needed for defense,
and that make up the case.
IX. From the start of the process, to be informed of
the rights that this Constitution gives in his or her
favor, and he or she will have the right to an
adequate defense by himself, by a lawyer, or by a
person of his or her confidence. If he or she does not
want to, or cannot name a defender after being
required to do so, the judge will assign him or her an
official defender. Also, the accused has the right to
have his defender appear in all phases of the process,
and the defender has the obligation to appear whenever
he or she is required.
WE DEMAND:
First- The immediate and unconditional liberation of
each and every one of the detainees along with all
charges dropped.
Second- A valid list of names of all those detained.
Third- The immediate and total cease of all
harrassment against those detained, their familys, and
those who have been released.
Fourth- We demand the guarantee of the physical well
being of all those detained and then immediate cease
of all torture they have been subjected to.
Fifth- The supporting organizations and the families
of those detained give direct responsibility of the
lives and physical well being of each and every
detainee to the President of the Republic Vicente Fox
and the Governor of the State of Jalisco Francisco
Ramirez Acuña.
Sixth- The permission of the defense lawyers to act
on behalf of the detainees.
Due to the above, based upon what we have experienced
here, the supporting organizations and civil society
conclude that the actions taken by the federal and
state government are part of a war directed against
the civil population and show clear fascist practices
in its oldest form.
