In Formaldegate George Bush has committed contempt of court and perjury. To quote from ( Did Bush lie under oath in funeral home case? by Robert Bryce and Anthony York, Paragraph 1 ). "A sworn affidavit by Texas Gov. George W. Bush insisting he had no discussions about a state investigation into a political contributor's funeral home business has been contradicted by the company's own lawyer." To quote from ( Bush in Contempt on Formaldegate by Robert Bryce, paragraph 2 ). "the former executive director of the Texas Funeral Service Commission, filed a motion asking a state court to find Bush in contempt for not telling the truth about his interactions with officials from Service Corporation International..." Perjury and contempt of court are grounds for impeachment. Bill Clinton, Federal Judges Alcee Hastings and Walter Nixon all were impeached for perjury yet when George Bush commits perjury nobody in the country cares. When George Bush got into trouble over Harken Energy he ran crying to daddy and he got a whitewash from his personal attorney James Doty. To quote from ( Harken Energy - Bush's No Good Trade by Tom Flocco, Paragraph 5 ). "So, in the end, the younger Bush was cleared of insider trade wrongdoing by his personal attorney and by his father's vice-presidential counsel, a virtual impossibility for the average U.S. citizen."
George Bush should be impeached for his perjury and contempt of court in Formaldegate and for his Harken Energy whitewash. Federal Judge Alcee Hastings was acquitted of all criminal charges before he was impeached on a vote of 413 to 3. No there were not 413 democrats or 413 republicans in the U.S. House. Notice what the republicans will say, even though George Bush may have committed perjury, contempt of court and insider trading he has not been convicted of any of these crimes. Therefore George Bush must not be impeached but if you are a democratic president or Federal Judge ( Such as Former Federal Judges Harry Claiborne, Alcee Hastings, or Walter Nixon ) whether you are convicted of felonies or not you must be impeached to respect the constitution. Even though George Bush has not been convicted of a felony he can still be impeached since impeachment is not a criminal proceeding.
In the rest of this story I will only quote from ( Proceedings of the U.S. Senate in the Impeachment Trial of Alcee L. Hastings ). The first quotes are from ( Part Five: Standard of Proof and Impact of the Jury Verdict ). First quote ( Top of page is numbered 282 and bottom of page is numbered 166, paragraph 2 ). "Senate precedent as well as the nature and purpose of impeachment dictate that a civil rather than criminal standard of proof applies in this and any impeachment case." "Judge Hastings reliance on the criminal standard of beyond a reasonable doubt has absolutely no historical support." Next quote ( Same page as above, Paragraph 3 ). "In 1986, the Senate overwhelmingly rejected Judge Harry Claiborne's motion to designate beyond a reasonable doubt as the standard of proof in impeachment proceedings."
Next quotes ( top of page is numbered 283 and bottom of page is numbered 167 ). First quote ( Paragraph 2 ). "In this very case, the Senate determined that impeachment is not a criminal proceeding." "It is an independent proceeding serving a fundamentally different purpose than criminal prosecution." "By making this decision, by a vote of 97 to 1, the Senate established that impeachment is a civil proceeding." Next quotes ( Same page, Paragraph 3 ). "Therefore, when taking the first step toward resolving this case, each senator should choose a civil standard of proof." "The House submits that the appropiate standard is preponderance of the evidence."
Alcee Hastings unsuccessfully attempted to appeal his impeachment in Federal Court. I will continue to quote from ( Proceedings of the U.S. Senate in the Impeachment Trial of Alcee L. Hastings ) and from the ruling of U.S. District Judge Gerhard A. Gesell of the U.S District Court District of Columbia which is found in this book. First quote ( top of page is numbered 913 and bottom of page is numbered 7 ). ( Paragraph 3 ). "Impeachment trials are sui generis: in several instances in the constitution, impeachment is distinguished from criminal proceedings."
Next quote ( top of page is numbered 914 and bottom of page is numbered 8 ). Quote is from Paragraph 1. "It is clear that the federal rules of evidence do not apply in impeachment trials, and the constitution itself does not require unanimity among the Senators sitting in judgement." "Senators determine their own burdens of proof, they need not be persuaded beyond a reasonable doubt that the defendant committed each and every element of every article."
Christian Republican voters who elected George Bush President said that moral values was the single most important issue in this election. The Chrisian Bible says that you should not steal or lie. So just where is the Christian Republican voters indignation at George Bush's perjury, contempt of court and insider trading.
