Given today's rights climate, the thought of using any copyrighted material in a documentary film strikes fear in the hearts of even the most experienced makers. As a result, historical documentary and those that comment or criticize popular culture appear to be on the hit list for extinction. Newer makers self-censor topics to steer completely clear of films that will likely require huge budgets to clear rights. But it wasn?t always this way and today doc makers are fighting back. ?Fair use? is a tool filmmakers can legally use to justify certain uses of copyrighted material.
