In May of 2016, two of our comrades in Azerbaijan, Qiyas Ibrahimov and Bayram Mammadov, were arrested for spraypainting the monument of the former dictator Haydar Aliev. It was on the night before the so-called "Flower holiday", a day made up in conmemoration of Haydar, the father of the current President of Azerbaijan. Nonetheless, as the charges for spraypainting would not have been very high, more than 1 kilogram of heroin was planted in each of our comrades' homes. They were processed on different trials. Qiyas has already been sentenced to 10 years of prison, his friend Bayram Mammadov is still on trial. From Azerbaijani comrades we received the text of Qiyas' speech in front of the jury, him being interrupted regurlarly by the judge. In support of his case, we made an audio version of this speech and the judge's comments.

The the feared stayaway order from La Pintoresca Park, the hub of Black Lives Matter organizing in Pasadena, was averted.

Both have refused, insisting that their medical marijuana collective activities are legal under state law. Medical Marijuana is an affirmative defense meaning the defendants must prove their innocence similarly to a self defense level of proof. This gives tremendous power to California judges who can ensure a guilty plea by denying a medical defense. Judge Charles Sheldon, Dept. K has already declared that he will not allow a jury to hear the truth, he will not allow patients to testify or expert witnesses on California medical marijuana issues. If they are convicted, both face up to 7 years in state prison.

A Meanness in This World (tags)

The January 8 shooting of Representative Gabrielle Giffords and murder of federal judge John Roll and five other people in Tucson, Arizona has been blamed on a lone nut, and both wings of the corporate media — center-Right and far-Right — have fallen over each other to absolve the ultra-Rightists of talk radio, Fox News and the Tea Party of blame for the alleged shooter’s actions. Nonsense. Not only did Sarah Palin’s Web page specifically “target” Congressmember Giffords for defeat last April — a piece of hysterical rhetoric Giffords called Palin out on at the time — but the radical Right’s incessant propaganda on talk radio and Fox News, with its ceaseless calls not only to defeat but “eliminate” its “enemies,” created a national climate that ensured that the killer’s madness took the form it did and his delusions led him to attack two individuals that had already been the targets of radical-Right bullying and harassment.

ABSOLUTE FEAR (tags)

The cop out of Quezon City Regional Trial Court (RTC) Branch 84 Judge Luisito Cortez from the multiple murder case against suspected massacre artist Datu Unsay Mayor Andal Ampatuan Jr. mirrors the desperate state of the justice system in which arbiters of law on whom the people rely for justice, are either cowed by criminals or syndicates or are easily bought off. The courts have been embroiled in many other situations that cast a cloud on the reputations of most judges in the country, including the recent tussle about big business bribery where, as opposed to the Ampatuan case, judges are on each other’s neck to have the case assigned to them. The judiciary, nevertheless, is rich with stories of exemplary judges, and there are many who would defy all odds just to uphold the rule of law. A handful has been killed in recent years by those whom the judges had passed their verdict.

Romina Tejerina: A story of gender violence and patriarchal unjustness (tags)

Romina is a poor youth who was born in one of the most conservative and old-fashioned regions of Argentina: Jujuy. One day, while leaving a party she was raped by her neighbor, Eduardo Vargas. As a result of this raping she became pregnant. For six months she hid her pregnancy, all the while carrying out abortion steps through in-home methods. In spite of being raped, she was unable to ask for assistance as the society where she lives looks negatively upon pregnancy out of wedlock. To be raped is generally looked upon as the fault of the victim, because they either provoked the situation or did not do enough to resist it. During the time that her pregnancy lasted, the rapist felt as if he had gotten away with it and threatened her constantly in order that she wouldn’t say a word. Later, after various attempts at abortion, it ended – prematurely – in the bathroom of her house. She was overcome with post-traumatic stress upon sight of her recently born dead baby. Romina then found herself in a state of mental confusion upon learning what one of the official reports had said. The judge that wrote them never believed that it was actually a case of rape.

One of the first measures taken by the administrator was to cover with a black canvas the plaque at the entrance of the factory which said: "CIPLA, company controlled by the workers." A marvelous national and international compaign demanding the end of the intervention at Cipla was launched just a few hours after the Federal Police carried out their war operations. Messages began to arrive to the Lula government and the Minister of Justice, Tarso Genro, who is responsible for the Federal Police and Luis Marinho, Minister of Social Security, from whose ministry the request for the intervention in Cipla came. Messages were also sent to the Minister of Labour and Employment, Carlos Lupi. This strong and immediate reaction gave us the strength and energy to organize the resistance against these riduculous events.

On the Philippine Judge’s Decision to Deny Custody of a Convicted US Marine to the US Emba (tags)

The Alliance for Just and Lasting Peace in the Philippines (AJLPP) USA highly commends Judge Benjamin Pozon of Makati City, Philippines for standing firm on his decision not to give the U.S Embassy custody of convicted rapist Cpl. Daniel Smith of the U.S. Marines despite the lap-dog subservience of the US-Arroyo government and its Department of Justice. What remains now is to ask all patriotic Filipinos to unite and act to scrap the Visiting Forces Agreement (VFA) that is the source of all the indignities and violations of our national territory and honor as a people. The United States will always use the onerous and lop-sided VFA to advance their interest against our people and nation. Truly, it took the courage of a Filipino woman, “Nicole”, who stood up for her dignity as a person to emphasize the unequal relationship between the US and the Philippines. It took another brave Filipino man, a judge, to uphold our sovereignty and the majesty of Philippine laws to make us proud to be on a moral high ground and to stand firm as Filipinos. It will take the people of the nation to unite the country to continue to stand and fight for its sovereign rights.

ON SMITH CUSTODY RULING (tags)

News sources today reported that the ruling of Makati trial court Judge Benjamin Pozon for convicted US Marine Daniel Smith to remain at the Makati City Jail “reflects a misunderstanding of Philippine obligations under the terms of the Visiting Forces Agreement (VFA) during judicial proceedings,” the United States embassy said Wednesday. The embassy statement, issued a few hours after Pozon’s ruling, reiterated the American position that Smith, being a member of the US military, should remain in US custody pending final judicial proceedings -- including the appeal of the 40-year sentence on Smith for raping a Filipina last year -- of the case.

JUDGE ALARCON THROWS OUT RALPH HOROWITZ’S LAWSUIT (tags)

The court ruled that the plaintiffs had not alleged facts or provided the court with evidence showing that the Farmers had engaged in a willful act in their use of the preliminary injunction that was not proper in the regular conduct of the legal proceedings. The court held that under case law in California, even if a party files an action that it knows is substantively meritless and does so for an improper purpose, these facts alone do not constitute a claim for abuse of process. The Horowitz plaintiffs had to show that the Farmers used the preliminary injunction in an improper way after they obtained it. The plaintiffs failed to allege or show in their opposition brief any such misuse of the injunction, and because they did not, the court granted the Farmers’ motion and dismissed the plaintiffs’ lawsuit.

Federal Judge Barbara S. Jones has proven herself to be an anti-democratic and constitutionally bankrupt lawyer as well showing her politics in the glaring light of public opinion by ruling against a peace march in New York City scheduled for Saturday the 15th February. Jones's ruling proves beyond a shadow of doubt that the high alert the White House put up last week is strictly political.
