Legislative Alert: Legislation Attempts to Impose New Internet Sales Tax

On Tuesday, the Senate agreed to begin debating a small business tax bill (S.2237) that some say could boost job creation. Unfortunately, Senators Mike Enzi (R-WY), Dick Durbin (D-IL) and Lamar Alexander (R-TN) have expressed plans to offer an Internet Sales Tax amendment. This amendment would make it much harder for entrepreneurial small business retailers to use the Internet to serve consumers across America, and raise the prices consumers would face when they shop from small businesses online.

eBay Inc. opposes any Internet Sales Tax proposal that raises barriers to small business retailers using the Internet to grow. The best tax policy would encourage entrepreneurial small businesses to use the Internet, create jobs and serves consumers in new and innovative ways. The current Internet Sales Tax proposal is the opposite – a tax proposal that will make it harder for small business retailers to use the Internet and grow.

Oppose Efforts to Impose New Tax Burdens on the Internet

Two bills have been introduced in the U.S. House and Senate that would impose complex sales tax collecting requirements on Internet retailers and entrepreneurs, including our eBay sellers. If passed, H.R. 3179 and S. 1832, would require small online retailers to comply with varying sales tax rates for thousands of tax jurisdictions and to collect and remit sales taxes from each customer, regardless of whether or not the seller has a presence in the state.

This new sales tax scheme would be extremely burdensome and costly to small online retailers like you who have set up shop on the Internet. eBay is working very hard to stop these bills from becoming law, but we need your help!

Dear Member of Congress:

As your constituent and one of the 82 million registered eBay users in the US, I'm asking you not to impose any new sales tax laws on the Internet.

The Supreme Court decided that most small businesses, like the majority of those operating on eBay, don't need to collect sales taxes from out-of-state customers. This decision was made because it would be an unfair and costly burden for small businesses to collect sales taxes for 15,000 tax jurisdictions in 45 states.

eBay sellers, like many other small business retailers, would be directly impacted by any new Internet sales tax system. It would increase the cost of doing business and shopping on-line, which would hurt sellers and buyers alike.

Please oppose any efforts to impose new tax burdens on the Internet.
