Morristown, New Jersey - A trial is under way this week between a
54-year old doctor and a 15-year old freshman at West Morris-Mendham
High School for an incident that happened back in 2003 when then the
girl was just 11 years old.

The bicycling Dr. Alexander Dlugi is suing the girl, Lauren Ellis for
damages abstained from a collision on their Chester Township street
that evening in 2003. Ellis was on her inline skates and Dr. Dlugi was
riding his bicycle when the accident occurred.

The doctor claims that Ellis was negligent and causes the accident
because she acted unreasonably and swerved to the left when he
approached her from behind ringing his bell and shouting "watch out".

On Wednesday, an accident expert brought it to study the case said
that Dr.Dulgi could have avoided the collision by simply riding around
the skater and that since he was actually approaching her from behind,
he and not Ellis, was responsible for avoiding the collision.
