Proposition 8, DoMA and the Supreme Court (tags)

The U.S. Supreme Court has agreed to review the constitutionality of Proposition 8, the ban on same-sex marriage passed by California voters in November 2008, and also the provision of the Defense of Marriage Act (DoMA) that defines marriage under federal law as only between one man and one woman. But the current Right-wing Court is likely to uphold Prop. 8 as constitutional and leave the battle for marriage equality to state-by-state political and social campaigns.

The Nevada State Engineer's decision last week supports the SNWA proposed pipeline despite numerous objections from the indigenous Goshute Nation and many other scientists who warn that the finite aquifers of the Snake and Spring Valley targeted by the SNWA pipeline would not sustain this amount of extraction without causing ecosystem collapse as springs dry and species become extinct. The recent controversy over whether institutions owned by the Roman Catholic Church should be required to include birth control coverage in the health insurance they offer employees, the attempt in Virginia to require women seeking abortions to submit to medical rape, and the radical Right's reaction to the 9th Circuit appeals court ruling that Proposition 8 is unconstitutional raises the question: why does it seem as if only bigoted Right-wing churches have "religious liberty" in this country? Why are America's officially tolerated spiritual belief systems seemingly limited to those of the Roman Catholics, Mormons and Southern Baptist Convention?

Prop 8 Struck Down by Federal Court (tags)

Yesterday (February 7, 2012) California proposition 8 voted on in the 2008 November 4th election stating that “Only marriage between a man and a woman will be recognized,” was overturned by the federal court. A victory for human rights, regardless if one is gay, straight, bisexual, anything in between or beyond. This battle between supporters and those opposed has been going on for over three years. Yet the fight for equality has been going on far longer than that.

Two Hard Cases, Two Bad Laws (tags)

The November 14 decision by the U.S. Supreme Court to consider the constitutionality of so-called "Obamacare" and the November 17 decision of the California Supreme Court that the proponents of Proposition 8 have legal standing to appeal it all the way to the U.S. Supreme Court are both disasters for the progressive community. But they also highlight the conflict between general principles of justice progressives should support and tactical positions in specific cases that may work to our short-term advantage but cause us problems later on.

Zenger’s Newsmagazine Editorial on Proposition 8 Decision (tags)

Written before the most recent development in the federal case challenging Proposition 8 — the good-news, bad-news decision of the Ninth Circuit Court of Appeals to delay same-sex marriages in California until at least December, but also to consider the all-important issue of whether the supporters of Proposition 8 even have legal standing to appeal — this editorial from the summer 2010 print edition of Zenger's Newsmagazine shows what a roller-coaster this issue has been and how the Queer community needs to be militant and ready for a long-term battle for full equality before the law, including marriage rights.

Pesante-USA pointed out that “ when the courts disregards the 1987 constitution and favors political dynasties like that of the Arroyo’s, the high court does not only fail the nation but betrays its people. The Supreme Court’s Jan. 19 ruling reverses that decision, sending the case back to the Third Circuit. The lower court can either let the death sentence stand or order a new trial to hear other claims brought by Mumia.

One and One-Half Class Citizen (tags)

The California Supreme Court decision on May 26 upholding the validity of Proposition 8, the ban on same-sex marriage voters approved in last November’s election, but also ruling that the estimated 18,000 same-sex marriages in California between June 15 and November 4, 2008 were still legal, left the same-sex couples who got married in time (including this author) in an anomalous position. We can’t really call ourselves second-class citizens because our marriages are still in force, but we can’t call ourselves first-class citizens either because other couples with love and mutual commitment equal to our own can no longer follow suit. In a sense, the voters and the courts have granted us “special rights” we neither wanted nor expected.

The romance of rape (tags)

It is tempting to describe the decision of the Court of Appeals acquitting Lance Cpl. Daniel Smith of the crime of rape, promulgated by the all-female 11th special division, as the revenge of the “manangs”. The decision certainly seems to have been written by a conspiracy of spinsters, in vigorous denial of reality, and sustained by fantasies of chivalry (in favor of the American serviceman) and chastity (against the woman we all call “Nicole”). “This court finds [as] deceptively posturing Nicole’s portrayal of herself as a demure provinciana lass,” the CA ruled, contrary to the unflattering characterization, sometimes using colors supplied by the victim herself, that the trial painted of flirty, hard-drinking Nicole. “On hindsight, we see this protestation of decency as a protective shield against her own indecorous behavior.”

RP Government Impotent (tags)

( The AJLPP Secretariat reprinted the editorial of the Inquirer, the prime newspaper in the Philippines in its reaction in the CA decision on the Smith rape case) MANILA---Close this When the Court of Appeals handed down its decision acquitting Daniel Smith, no one was surprised. The departure of “Nicole,” his accuser, from our shores had already conditioned the country into believing an “arrangement” was in the works. In that sense, whatever the actual merits of the court’s decision, the case may be relegated as yet another one decided on clout rather than in fulfilment of justice. The United States can claim it fulfilled the letter—though not the spirit—of the Visiting Forces Agreement by keeping Smith in Manila throughout the judicial process, but not a second longer. Smith is now out of sight and, probably, out of mind—seemingly the objective of both the Philippine and American governments. Smith’s co-defendants went on to dishonorable or less-than-honorable discharge from the military. And no one expects Smith to be glorified or rewarded by his military or country. But that is a pretty small consolation for the manner in which Smith’s case proved that the VFA is a lopsided agreement; and worse, that the instinct of our own officials is not to assert Philippine rights and processes but to kowtow and grant every possible consideration to American wishes. Public opinion forced the prosecution of Smith and company. Public opinion kept the justice system creaking along; and while the beginning of the case found American authorities complying with their obligations under the VFA, Philippine authorities began finding ways to subvert the spirit of the agreement. Most dramatic of all was the handing over of Smith to American custody in the dead of night in December 2006. All throughout the judicial process itself, it was hard to tell whether the Department of Justice, for one, was lawyering for the government, the alleged rape victim, or the American soldiers.

The Alliance Philippines (AJLPP) scored the ambivalent and double standard Philippine Supreme Court’s decision that said that US Marine Daniel Smith could be continuously detained in the US Embassy while he appeals his case in court. AJLPP condemns the self- contradictory rule that has been the hallmark of the Supreme Court ever since time immemorial. The ruling that the convicted marine must be jailed in a Philippine facility that cannot be implemented just perpetrates the colonial status of the Philippines under the rule of the United States.

The influential Makati Business Club (MBC) on Thursday said the Supreme Court decision on executive privilege did not conform to the “progressive standards of transparency” and restricted the ability of the legislature to check presidential abuse. In a statement, the MBC said it was “very concerned” about the tribunal’s ruling on the petition of then Director General Romulo Neri of the National Economic and Development Authority to stop the Senate from questioning him further on the $329-million National Broadband Network (NBN) deal with China’s ZTE Corp. “Their decision gives greater value to executive privilege than to the public’s right to know, which is not in keeping with progressive standards of transparency. It also has the effect of restricting the ability of the legislature to act as a countervailing force against executive abuse,” the MBC said.

What remains now is to ask all patriotic Filipinos to unite and act to scrap the Visiting Forces Agreement (VFA) that is the source of all the indignities and violations of our national territory and honor as a people. The United States will always use the onerous and lop-sided VFA to advance their interest against our people and nation. Truly, it took the courage of a Filipino woman, “Nicole”, who stood up for her dignity as a person to emphasize the unequal relationship between the US and the Philippines. It took another brave Filipino man, a judge, to uphold our sovereignty and the majesty of Philippine laws to make us proud to be on a moral high ground and to stand firm as Filipinos.
