The recent The Court of Appeals decision on the partial granting of the petition for writ of amparo and habeas data filed by Filipino-American activist Melissa Roxas only successfully highlights and exposes the contradictions in the bourgeois justice system in the Philippines.

The Philippine Peasant Support Network (Pesante)-USA learned through news sources in the Philippines that the Court of Appeals has partially granted the petition for writ of amparo and habeas data filed by Filipino-American activist Melissa Roxas, and directed the military establishment to provide protection to her and her family while in the country against any form of harassment. In a 33-page decision penned by Associate Justice Noel Tijam, the CA’s Former Special 16th Division also enjoined the military from distributing to the public any documents or records pertaining to Roxas’s alleged ties with the Communist Party of the Philippines-New People’s Army (CPP-NPA).

The Regional Trial Court (RTC) here has ordered the clerk of court to issue anew summonses to 37 respondents to a petition of writ of amparo filed by the family of a missing barangay official. During the hearing on March 24, RTC Branch 30 Judge Jovito Abarquez also issued an order of protection for Dennis Gutierrez, son of Elizabeth Gutierrez who was allegedly abducted by New People’s Army (NPA) members on Oct. 24 last year.
