The majority held the homeless can be punished for their conduct even when the state has wholly inadequate shelter beds. Ignoring the Martin v Boise and Robinson decisions, the majority held that this punishment is not cruel and unusual and is not a punishment of status. 138 Gospel Rescue beds for 620 homeless!!
