With Bush apparently leading Gore\r\nby only\r\n hundreds of votes, in a state with hundreds of thousands of \r\ndisenfranchised voters, could similar errors be tipping the race?\r\n \r\n \r\n by Sasha Abramsky\r\n \r\n \r\n Nov. 8, 2000\r\n \r\n \r\n \r\n The cliffhanger in Florida may ultimately be decided by those \r\n who didn't vote. Hundreds or even thousands of Florida residents may\r\nhave been erroneously crossed off the voter lists because they were \r\nmistakenly\r\n identified as ex-felons.\r\nFelon disenfranchisement laws may have hurt Gore in two ways. With the\r\n> result of the presidential election coming down to a handful of \r\nvotes in\r\nFlorida, the disenfranchisement of close to three quarters of a \r\nmillion\r\nfelons and ex-felons in the state may well have made the difference\r\nbetween a Gore presidency and a Bush one. Considering that the majority\r\nof felons\r\nare poor, black and Latino -- that is, likely Democratic voters -- had \r\nfewer than two percent of the disenfranchised in Florida voted, Gore\r\nwould have\r\nprobably been elected president.\r\n But even more disturbing is the possibility that a significant number\r\nof\r\nFloridians may have been wrongfully barred from voting -- perhaps enough\r\nto have tipped the race.\r\n Just months ago, nearly 12,000 Floridians were informed by the state \r\nDivision of Elections that they had lost their voting rights because of\r\n felony convictions in other states. But the company hired by the state\r\nto compile that list of names made a massive mistake and misidentified\r\nthousands\r\n of people, according to the Palm Beach Post and other Florida papers.\r\nIn\r\n response to a barrage of complaints from irate voters, nearly 8,000 of\r\nthose who had received the notices were subsequently reinstated on the \r\neligible\r\nvoter lists in time for yesterday's vote.\r\n George Bruder, senior vice president of the Boca Raton-based company,\r\n Database Technologies, called the inaccurate lists \"a \r\nmiscommunication.\"\r\n Representatives of the company did not return calls inquiring as to \r\nwhether the other 4,000 voters on the list turned out to be genuine\r\nfelons \r\n> or\r\n> ultimately had their voting rights restored. Florida election \r\n> officials\r\n> also\r\n> could not be reached for comment.\r\n> In a state with such a huge number of disenfranchised \r\n> citizens, the\r\n> possibility that other such errors have gone undetected is \r\n> impossible to\r\n> ignore. In fact, in a separate, similar incident in August, some \r\n> 500 people\r\n> in Miami had their voting rights restored after they turned out to \r\n> either\r\n> be\r\n> non-felons or felons who had been given voting clemency, according \r\n> to the\r\n> Tampa Tribune.\r\n> In recent years, the Florida Division of Law Enforcement has \r\n> moved\r\n> aggressively to remove felons who had sneaked onto the voter \r\n> rolls. In\r\n> 1998,\r\n> the state reported that more than 50,000 felons were voting in \r\n> Florida. In\r\n> an\r\n> effort to crack down on these voters, state authorities provided \r\n> lists of\r\n> resident felons to each county; counties then sent out letters \r\n> informing\r\n> these people they were being struck from the voter rolls. The \r\n> state left\r\n> it\r\n> up to each county to determine whether the voters they deleted from\r\n> eligibility were indeed felons; some counties, in turn, placed the \r\n> onus on\r\n> individuals who claimed they were the victim of a mistake to prove \r\n> it,\r\n> according to local newspapers. At least one county gave citizens \r\n> only 30\r\n> days\r\n> to respond with a notarized affidavit challenging their\r\n> disenfranchisement.\r\n> \r\n> In some instances, it is possible legitimate voters whose \r\n> names were\r\n> being used as aliases by felons were struck off the voter rolls. \r\n> In Martin\r\n> County, for example, Elections Supervisor Peggy Robbins remembers \r\n> that two\r\n> people reported being sent the letters erroneously. One person said \r\n> he had\r\n> been wrongly disenfranchised several times. If the recipients \r\n> didn't phone\r\n> to challenge the letters, says Robbins, there would be no way to \r\n> rectify\r\n> the\r\n> mistake.\r\n> How many people might be affected? \"There might be one or \r\n> two,\" in her\r\n> county, Robbins believes. \"In a great big county, there might be \r\n> more.\"\r\n> Small\r\n> numbers, but Florida has 67 counties; if this race comes down to \r\n> just a few\r\n> hundred votes, such glitches could provide the Democratic Party \r\n> with\r\n> grounds\r\n> for challenging the result in the courts.\r\n> \r\n> The wrongful-disenfranchisement question joins a lengthening \r\n> list of\r\n> voting irregularities in Florida. In Palm Beach County, thousands \r\n> of Gore\r\n> voters may have mistakenly marked their ballots for Pat Buchanan, \r\n> thanks to\r\n> a\r\n> confusingly laid-out ballot. ABCNews.com reports that thousands of \r\n> other\r\n> Gore\r\n> votes may not have been counted because of a computer error in \r\n> Volusia\r\n> County. Officials of both major parties also reported that many \r\n> voters were\r\n> apparently turned away from the polls and that some precints ran \r\n> out of\r\n> ballots. Several papers reported that white state Highway Patrol \r\n> officers\r\n> set\r\n> up a checkpoint near a balloting site in a heavily black district \r\n> in\r\n> Broward\r\n> County, allegedly prompting state and federal officials to \r\n> investigate\r\n> whether the incident amounted to intimidation against \r\n> African-American\r\n> voters.\r\n> In almost any other election, the number of potential\r\n> wrongful-disenfranchisement errors would be so small as to not \r\n> matter.\r\n> But,\r\n> if a couple thousand -- or even a few hundred -- people who would \r\n> have\r\n> voted\r\n> were wrongfully deprived of their right to do so, it is at the \r\n> very least\r\n> possible that the election of the most powerful man in the world \r\n> will have\r\n> been swung by bad information about eligible voters fed into \r\n> computers.\r\n> \r\n> Read the article online:\r\n> \r\n> http:\/\/www.motherjones.com\/news_wire\/floridavote.html\r\n> \r\n> Check out the latest from the MoJo Wire and Mother Jones magazine \r\n> at:\r\n> \r\n> http:\/\/www.motherjones.com\r\n> \r\n","author":"RevereRides","parent_id":4440,"mime_type":"text\/plain","created":"2000-11-11 14:59:48","modified":"2000-11-11 15:30:23","fileurl":""},{"id":4746,"heading":"Response to ex-felon Voting rights ban in Fl","article":"I am in complete agreement with the premise in the article--i.e. gross disenfranchisement of blacks in particular and all convicts in voting. \r\nI believe these are laws are discrimination and arbitrary especially in today's climate with nearly 2 million people in prisons and an even larger population of people on probation, parole, or with previous criminal record.\r\nThis situation demands a remedy and has been overlooked for too long. Here in Califorinia I have registered voters and been a field organizer for peition drives on referendums to change the drug laws and legalize medical marijuana; we were told that after release from prison for 1 year all voting rights were restored and we could register them...a far better situation than Florida but still far from optimum.\r\nI see now reason that those in jail or prison should lose their most basic of civil rights, the franchise to vote. A citizen's status should not be held up any more than skin color, religion, sexual orientation etc. Both major political parties prefer small voter turnouts when it's to their advantage.\r\nRC\r\n","author":"Roger C.","parent_id":4440,"mime_type":"text\/plain","created":"2000-12-01 15:22:53","modified":"2000-12-01 16:00:00","fileurl":""},{"id":4882,"heading":"appalling","article":"worse than i ever imagined. had no idea these 'jim crow' laws were still being used like this","author":"who he","parent_id":4440,"mime_type":"text\/plain","created":"2000-12-15 12:43:51","modified":"2000-12-15 13:00:01","fileurl":""},{"id":4962,"heading":"Thank God Felons Can't Vote","article":"Thank God convicted felons can't vote.\r\n\r\nI don't want rapists, murderers, drug dealers, thieves and muggers choosing my president, or deciding who gets into the Senate or Congress. \r\n\r\nI don't care what color they are.\r\n\r\nIf you care about how this country is going to be in the future -- you won't want politicians being \"the felons choice.\" \r\n\r\nWe have enough felons in politics already!","author":"Paul Daly","parent_id":4440,"mime_type":"text\/plain","created":"2000-12-23 22:22:58","modified":"2000-12-23 23:00:01","fileurl":""},{"id":5060,"heading":"Voteless in Florida","article":" There are two separate issues here--the legal (if probably unconstitutional) disenfranchisement of felons, and the illegal disenfranchisement of voters incorrectly labeled as felons.
