Updating chaotic crumblings at Pacifica - affects KPFK too.

by KPFK loyal volunteer Wednesday, Apr. 30, 2014 at 3:01 PM

Events continue in the higher levels of a mixed-up Pacifica Fdtn with who is in charge and who is not and who has authority and who claims what. With most in Los Angeles not extending to keep up with details as others derail and destroy what was before a ‘radical’ variety of programming at KPFK, along with it’s sponsors, here are reposted excerpts to both advise, inform, and urge activism in any form an Indy reader will dare to help the mess from spilling over and out into KPFK and so into our lives here. Fuller information is available at the links provided here. Note that excerpts are for *Relevant Clarification * and those that may be pertinent how KPFK in LA is affected by what else is currently being disputed, declared and not questioned. The many detracting claims and counterclaims affect the operations and functionings of Pacifica Fdtn and it’s 5 stations, More specific detailed info can be read in the entire articles/ reports written by Tracy Rosenberg at the links included at facebook: “United for Community Radio KPFA “. Though the stories appear to emphasize the sibling station in Berkeley KPFA, the results affect our Local KPFK radio station 90.7 FM in LA equally, even when our station's ID is ignored in their stories. It was our own KPFK prior GM who was laddered Up into Pacifica's interim Exe Director position, but by Berkeley's group and it was not even discussed at the local KPFK LSB in April. Why ?

Posted 4/22/2014 :
“Temporary/interim ED Bernard Duncan has not returned from Los Angeles to the Berkeley headquarters after falling ill 3 days into his first week of employment. …

DC station WPFW is down to $4,000 in its operating account with no clear way to pay the end of the month payroll and WBAI has about $250,000 in unpaid bills piled up. KPFT in Houston faces a March 27th deadline to get up to full power after 4 FCC extensions. Station managers are improvising without clear guidance from national about how to meet their obligations without enough cash on hand.

Slow progress is being made on the overdue bank reconcilations at KPFA, but recent financial reports presented by the local board treasurer at the last two local board meetings both contained math errors and overstated earnings. The new audit completion date is anticipated to be no sooner than the end of June. ……….”

And posted April 24, 2014:
‘”Bound for Boracay when the bills come due””

“As financial and labor troubles mount, the "rehired" chief financial officer for the Pacifica Foundation has taken off for the Phillipines, leaving the rudderless foundation struggling with the inability to pay bills amid a strangely silent national board majority. The phones were briefly turned off at New York's WBAI due to non-payment, and payroll and benefits are not immediately on-hand for Washington DC's WPFW at the end of the month. ……….

Free Speech Radio News, the independent half hour daily news broadcast of Pacifica Reporters Against Censorship, which relied for the lion's share of its budget on Pacifica's NPPAG grants from the Corporation for Public Broadcasting, ceased production last year after the funds were withheld from Pacifica. Pacifica Reporters Against Censorship has filed suit in Alameda Superior Court (Case # RG 14722004) for breach of contract and non-payment, requiring the foundation to retain a counsel for the legal and labor troubles that have rapidly piled up in the wake of the breach of executive director Summer Reese's contract. ………

2013 and 2014 CPB funds (over $1.5 million dollars) are awaiting annual financial reports …. as well as open meeting compliance declarations. Falsified executive session reportouts, un-noticed agenda items and private teleconferences such as that on April 14th, will further delay CPB grant funds due to open meeting violations………

The DC-based National Labor Relations Board (NLRB) complaint was brought by the SAG/AFTRA union 3 weeks after the board majority attempted to terminate Reese. At the time of her termination, Reese was physically in Washington DC for discussions with SAG-AFTRA about staffing changes proposed by DC manager Michelle Price. As of March 13th, the bargaining unit had no intention of filing charges, a situation which changed abruptly in the weeks following.

Disputed board chair Margy Wilkinson, who declared herself acting ED for the period following the board's attempted termination of the ED, took no action to negotiate with the bargaining unit about their concerns and the changes went through, triggering the NLRB filing against Pacifica. ………….

In the 5 weeks since the attempted termination, the Wilkinson/ Duncan acting/interim combo and the 2014 board majority has acquired three new lawsuits and an NLRB action. ………..

Reese has continued to report to work at the national headquarters since March 17th “....

“New boss same as old boss…”

“Disputed IED Bernard Duncan instructed California station manager Richard Pirodsky to transfer $85,000 from Berkeley station KPFA on Monday to assist with network bills.

Approximately $40,000 of the transfer is shared services income due from KPFA for the months of March and April and the other $45,000 constitutes an additional levy to support the month-end payrolls at WBAI and WPFW and United Health Care benefits for workers at the Houston, DC and New York stations, as well as the national office, who all use the same benefit package………

The law firm of Siegel and Yee, headed up by Oakland mayoral candidate Dan Siegel, engaged in a flurry of legal activity on behalf of the rogue board majority today. The board is hauling Pacifica into court Monday morning to try to get Judge Petrou to issue the board majority a temporary restraining order.

According to their filing, the Berkeley Police Department refused to accede to a request to assist with a forcible removal from the national office of the foundation's executive director without a restraining order issued by Alameda Superior Court. The filing contains notable falsities including an assertion that the annual audit was delayed by the national office occupation, rather than by KPFA's inability to provide reconciled books………….

Siegel and his firm made a third filing, countersuing Reese specifically for monetary damages of an unspecified amount for continuing to abide by her employment contract after the board breached it………"

Comments can be posted at the URL provided here to these reportings. LA is a silent barren desert with no information appearing visibly or audibly, not even at an LSB meeting, to explain or clarify who is doing what and why.

Notable is that the KPFK recently voted in PNB - Pacifica National Board - members from the KPFK LSB - Local Station Board - were 4 people who did Not Ever Say Anything about their plans or leanings but gave the pseudo-thank-you-for-nomination blurb without revealing their soon-to-be-riotous-actions at PNB.

That 3 out of the 4 voted PNB members colluded secretly to eliminate the contracted Executive Director in a phone call vote that was apparently not noticed or prior announced or even on the agenda for this drastic act, leaves many who pay for KPFK support to wonder if we are being fooled and our payments misused.

That the 3 LSB members just recently moving up to more power as PNB members were : Lawrence Reyes, Rodrigo Argueta, Lydia Brazon, and also was Kim Kaufman who did not vote with the slick 3 who helped create the chaos, that may be illegal and costly in future lawsuits also.

The next LSB meeting will be held May 16 in West Los Angeles on Sepulveda Blvd with the event info listed on the KPFK.org website.

If no one cares, if no one responds, if no one is concerned, then the Few who SECRETLY plan, act, steal, and trick to gain both power and destroy the way Pacifica runs with it's bylaws - then these few play out their mischief and thievery- all that may be happening now.

Then [it is a cliche repeated here] the KPFK listener sponsors deserve whatever results they get.

The Destruction of stability and honoring of bylaws, the shifts in power positioning, the creating more high-priced lawsuits, the inciting more fractionalization and inter-inner-strivings = to kill off any of 'the others' and to then take it all 'for only us'.... a faction taking over to favor their own ambitious strivings and repay their allies - all in even worse fightings..

If so few even voted for those 'elected' or selected as LSB members as was noted more so the last few years, then no one cares enough to just even send in a marked envelope.

If the LSB members continue to do everything in secrecy and not even reveal what has been planned, agreed, decided, or who chosen to do what in their emails/ phone calls/ collusions together, with NO Public Members having access to that information, then there is no accountability and no responsibility by any LSB selected person.

The lie is that the board body is responsive and represents large groups of sponsor/ supporters. The truth may be very different, a fraud that is never acknowledged nor admitted.

How can KPFK continue to act like every other corporate entity they claim to be "better" than and then do same or worse ?
