The Philippine peasant Support Network (USA) vehemently condemns the latest decision of the Court of Appeals to deny the writ of habeas corpus to Morong 43 as “grave injustice perpetrated by the courts.” Pesante-USA pointed out that “ when the courts acts as conduit of the military to justify injustice by saying it’s the rule of rule, the court does not only fail the nation but betrays its people. The courts as US president Adams said “ is the guarantee of our independence”.

RP COURT OF APPEALS PERPETUATES INJUSTICES AND HUMAN RIGHTS ABUSES

Los Angeles- The Philippine peasant Support Network (USA) vehemently condemns the latest decision of the Court of Appeals to deny the writ of habeas corpus to Morong 43 as “grave injustice perpetrated by the courts.”

Pesante-USA pointed out that “ when the courts acts as conduit of the military to justify injustice by saying it’s the rule of rule, the court does not only fail the nation but betrays its people. The courts as US president Adams said “ is the guarantee of our independence”.

Bringing Back Martial Law

But in the case of the recent CA decision on the case of the Morong 43, despite the grave injustice, despite the torture, despite the illegal arrests and improper procedures, the court chose to base its ruling to a old martial law decision aggravating the injustice.

Pesante supports the aggrieved Morong 43 suspects step to appeal the unjust ruling to the Supreme Court. Atty. Romy Capulong was right in saying that the court did not just erred but :

“In simply adhering to the outdated Ilagan v. Enrile, a notorious martial law doctrine, the Court of Appeals seriously disregarded the litany of blatant violations of the constitutional rights of these 43 health workers from the time that they were unlawfully arrested and the continued abuse of their basic human rights in the hands of the military,”

Pesante-USA agree with Capulong who said that the CA “has actually legalized the abuses committed by the military.”

“We have no other recourse but to elevate the case to the Highest Court,” Capulong and the other lawyers from the Public Interest Law Center (PILC) and the National Union of People’s Lawyers (NUPL) said, referring to the Supreme Court.

For Pesante-USA it stated; “it is really saddening to note, while the nation have moved forward casting away the relics of martial law, we still have a court like the Court of Appeals (CA) that gave away itself by being partial to the military, re-imposes old martial law edicts and aggravates tyranny in our homeland.”
