The Superior Court Department 85 for the County of Los Angeles under Judge James Chalfant ordered a new elections for the Filipino American Community of Los Angeles on May 31, 2009. This was the decision of the superior court on the Cynthia Gatus, Et Al, plaintiff vs Jose Baldonado, Et Al ,defendant on Case No. 400 293 last April 9, 2009. It was embodied in a 15 page transcript of proceedings issued by Jennie Campbell, court’s official reporter. Appearing for the defendants was Atty. Lorenzo Miranda Jr., official FACLA lawyer and for the plaintiff Atty. Martin Rodoy.

LA COURT SETS NEW FACLA ELECTIONS, MAY 31

Los Angeles-- The Superior Court Department 85 for the County of Los Angeles under Judge James Chalfant ordered a new elections for the Filipino American Community of Los Angeles on May 31, 2009.

This was the decision of the superior court on the Cynthia Gatus, Et Al, plaintiff vs Jose Baldonado, Et Al ,defendant on Case No. 400 293 last April 9, 2009. It was embodied in a 15 page transcript of proceedings issued by Jennie Campbell, court’s official reporter.

Appearing for the defendants was Atty. Lorenzo Miranda Jr., official FACLA lawyer and for the plaintiff Atty. Martin Rodoy.

COMELEC Authority upheld

The Court also ordered that the COMELEC that was designated by the old FACLA board will conduct the elections of May 31. The COMELEC is headed by Atty, Honorio Cabanilla.

The judge said in his decision that “ I cannot change the status of the board currently in place. I cannot change the status of that board”

The court also after ascertaining that there is still officers that run the entity also ordered that the officer manager will act to run FACLA during the interim period that there is no elected board. Mr. Sid Galace is the present office manager of FACLA. This was per the decision of the City Attorney General on the FACLA question.

This was concurring to the decision of both sides that January 1, 2009, where the new board took effect has passed and the old FACLA board does not exist. The newly elected 15 person new FACLA board from the Coalition for A Better Community (CBC) respected the court decision.

The FACLA, which is the oldest community organization in the community is swamped with court cases for a long time. With the new elections and the latest court decision, the community hopes that better times will come after the elections and the court settlement.
