The discovery of a previously unknown treasure chest of e-mails buried
by the Bush administration may prove to be as informative as Nixon's
secret White House tapes.

Richard Nixon and George W. Bush both invoked secrecy for national
security. Both insisted war -- the war in Vietnam, the war on terror
-- justified impunity. And both offered the reason of secrecy to cover

The discovery of a hitherto unknown treasure-trove of e-mails buried
by the Bush White House may prove to be as informative as Nixon's
secret White House tapes. Last week the National Journal disclosed
that Karl Rove does "about 95 percent" of his e-mails outside the
White House system, instead using a Republican National Committee
account. What's more, Rove doesn't tap most of his messages on a White
House computer, but rather on a BlackBerry provided by the RNC. By
this method, Rove and other White House aides evade the legally
required archiving of official e-mails. The first glimmer of this
dodge appeared in a small item buried in a January 2004 issue of U.S.
News & World Report: "'I don't want my E-mail made public,' said one

SUDDENLY,they all find pleasant things to say about each other. Until
the weekend, Carl Icahn, an activist investor who had taken a stake in
Yahoo!, a beleaguered internet company, was hurling public abuse at
Jerry Yang, its boss and co-founder, and proposing to fire the entire
board at a shareholder meeting on August 1st. Yahoo! was pitching the

White House E-mail Docs to Fall Under Info Act?

Appeal by citizens group pending on files relating to internal e-mail
investigation.

White House e-mail debacle

The advocacy group Citizens for Responsibility and Ethics (CREW) won a
small victory today, as the U.S. District Court held out the
possibility of an appeal overturning its decision on access to
documents relating to missing White House e-mails.

The latest ruling is not a reversal but an indication that the CREW
appeal has merit, Anne Weismann, CREW chief counsel, told
InternetNews.com. CREW had filed for access under the Freedom of
Information (FOI) act.

District Judge Colleen Kollar-Kotelly, of the United States District
Court for the District of Columbia, ruled Tuesday that the White House
Office of Administration (OA) must preserve any documents tied to its
internal e-mail investigation in the event CREW wins an appeal filed
to gain access to the material.

Last month Kollar-Kotelly had ruled the OA is not a federal agency and
its documents were not accessible under the FOI rules............

This week's court decision was separate from a lawsuit filed by CREW
and the National Security Archive last year against the Executive
Office of the President (EOP) to preserve e-mail and determine what
e-mails are missing from White House servers. It could impact the
joint e-mail preservation effort, however.

CREW and the Archive are awaiting a court decision on several issues
ranging from extending an e-mail preservation order to mandating that
the EOP confiscate mobile storage devices that could house e-mail from
the timeframe of March 2003 to October 2005. There is no specific
timeframe for the court's decision...


The Department of Justice (DOJ) has vigorously opposed CREW and
Archive efforts, stating such actions aren't necessary and that
recommendations to boost e-mail protection would prove onerous.

The EOP has previously admitted that three months of data at the heart
of the lawsuit are missing from its backup tapes.

Yahoo Co-founder, Jerry Wang to donate $75 Million to Stanford
University, his Alma Mater

It has been reported that co-founder of Internet media company, Yahoo
Inc., Jerry Yang plans on donating $75 million to Stanford University,
his alma mater. This bit of news was revealed by Stanford University
itself, which plans to use most of this money on a new environmental
studies center.

Both Jerry Yang and his wife, Akiko Yamazaki received their
undergraduate degrees from Stanford University in 1990. Besides, Yang
also received a master's degree from the university, and happened to
actually be working toward a doctorate in 1994. Coincidentally, at the
same time he then co-founded Yahoo with fellow Stanford student Dave
Filo. Later in 2005, Jerry Yang was elected to the Stanford University
Board of Trustees.

Out of the $75 million that is to be donated by Yang, $5 million will
be used for construction of a Learning and Knowledge Center at
Stanford's School of Medicine. $50 million has already been assigned
as the cost of the Environment and Energy Building project, and the
remaining $20 million will be retained for projects that will be
determined at a later date.

According to Jerry Wang, "We keep coming back to Stanford as a place
to give money to, because there's a uniqueness that Stanford offers
donors like us.......

Yahoo on NSA surveillance: No comment
California politician tries to get Yahoo's lawyer to say whether
company is cooperating with a domestic spying program.

Under cross-examination during a congressional hearing, Yahoo's top
lawyer refused on Wednesday to say whether the company opens its
records for government surveillance without a court order.

Michael Callahan, Yahoo's senior vice president and general counsel,
declined five times to answer that question from Rep. Brad Sherman, a
California Democrat who was probing whether the Internet company had
cooperated with the National Security Agency's domestic surveillance
efforts.

"It wouldn't be appropriate for me to comment," said Callahan, who was
testifying under oath. He added that Yahoo would "only turn over
information if it's required by law."

But Callahan refused to say whether a demand from the NSA--not backed
by a court order--qualifies as required by law.

No law or regulation prohibits Yahoo from answering the question. In a
survey published last week by CNET News.com, companies as varied as
BellSouth, Comcast, EarthLink and T-Mobile answered in the negative.
Rep. John Conyers, a Michigan Democrat, has posed similar questions to
those companies, and AT&T has been sued for allegedly turning
information over to the NSA in violation of privacy laws.

Sherman, who represents the San Fernando Valley near Los Angeles, is a
Harvard Law graduate who was known as a stickler for detail while a
lawyer in private practice. He's been critical of the NSA surveillance
program, and said last week that President Bush's recent claims about
terrorists planning to attack a Los Angeles skyscraper were a
political stunt........

In his(New York Post) column, Mr. Byron made reference to Tony Ryals,
who, he wrote, "has been bombarding the S.E.C. and Internet message

One is Chris Byron, a columnist for The New York Post. Byron has
insisted that phantom stock is not a problem. He has accused Patrick

Tony Ryals lives in a hut in Guatemala. On most mornings, he walks to a nearby internet café and begins writing - sometimes for stretches of
more than 24 hours. He has, indeed, become one of the most widely
published human beings on the planet. It seems almost impossible to

In the world of troubled dot-coms, you aren't likely to find a more
baroquely tangled intrigue than the one enveloping
GenesisIntermedia.com of Van Nuys, California--a company that claims
to operate such oddly unrelated businesses as a car rental company, a
consumer telemarketing company, a coupon business, and a network of
shopping mall Web kiosks.

Behind this company--or linked to it in one way or another--is a cast
of characters the likes of which are not often seen even in a
penny-stock souk, let alone the Nasdaq National Market, where Genesis
is (or at least, was) traded (Nasdaq: GENI). Within this yarn also
lurks a cautionary tale for any investor seeking to make a quick
killing on a volatile, low-priced stock like Genesis, which since
spring has soared from $6.50 to $25 and then back again............

So who's behind the veil? First, a fugitive Saudi arms merchant who is
wanted on a warrant for bank fraud in Thailand, and at least two
different drug dealers with felony rap sheets, one of whom is deceased
and had ties to the Central Intelligence Agency. Two regional
brokerage companies, one in Minnesota and the other in New Jersey,
have also gotten swept up in the story, as has the New York financier
Carl Icahn, who had the misfortune to extend a $100 million credit
line to Genesis in June in exchange for some warrants in the company's
stock.

Nasdaq market regulators halted trading in Genesis to seek "additional
information" from the company in apparent response to some
confused--and confusing--public statements as to whether its stock had
undergone a three-for-one split. A September 5 company press release
disclosing the plan said the split would take place on September 24.
One day later, the company issued a follow-up announcement in which
the date of the split was more vague...

Let's start with the largest single shareholder in Genesis: an outfit
called Ultimate Holdings. Ultimate Holdings turns out to be an
investment vehicle for a Saudi arms merchant named Adnan Khashoggi,
who played a key role in helping broker illegal weapons traffic from
the United States to Iran during the Iran/Contra affair.
(Incidentally, Mr. Khashoggi and Imelda Marcos, former first lady of
the Philippines, were jointly tried and acquitted of federal fraud
charges in New York, and he is currently a fugitive from a bank fraud
warrant in Thailand.)

Genesis's original underwriter was an outfit bearing the name
Millennium Financial. The firm--now known as I-Bankers Securities--is
run by a fellow named Michael Roy Fugler. Prior to becoming an
investment banker and broker, Mr. Fugler worked as a criminal defense
lawyer--in which capacity he handled narcotics-related cases for an
Arkansas pilot named Barry Seal.

Seal kept a plane at a rural airport in Mena, Arkansas, which was
eventually cited in news stories as a base of operations for alleged
CIA drug trafficking in connection with covert U.S. support for the
Contras. Seal is widely reported to have worked as a contract pilot
for the CIA in that effort, smuggling arms to the Contras in Nicaragua
and returning to Mena with cargoes of cocaine and other drugs. Seal
was murdered in 1986 in Louisiana by Colombian cocaine cartel hit men.
Mr. Fugler says he had absolutely no involvement with Seal except to
represent him in two criminal cases involving narcotics in Florida,
and a series of more routine civil actions elsewhere. He says he has
never met and does not know Mr. Khashoggi....

German press report last March identified Mr. Khashoggi as holding a
financial interest in WMP Bank and listed an individual named Regis
Possino as being active in the bank's affairs in an unspecified way.
Mr. Possino is a lawyer with a criminal record stretching back more
than 15 years. He was disbarred in the mid-'80s after being convicted
of selling 350 pounds of marijuana to undercover drug agents in
California. In 1995, he pleaded guilty in federal court in Los Angeles
to participating in a fraudulent scheme to use overvalued stock to
pump up an insurance company's balance sheet.

A June 2000 financial filing with the SEC lists a company under which
Mr. Possino does business--Corporate Financial Enterprises--as having
the same address as an investor named Reid Breitman. Mr. Breitman's
company, Corona, is listed in other SEC filings as being the largest
single shareholder of Global Capital Partners.

So let's see: a fugitive arms dealer, two convicted drug dealers (one
reportedly murdered by a Colombian cocaine hit squad), the scent of
the CIA, and even those golden oldie memories of the Iran/Contra
scandal--should we even bother to look at the company's financials? As
of its latest filing, Genesis showed $54 million in assets, $63
million in liabilities, a negative net worth of $9 million, $8 million
in quarterly losses, and $13 million in negative cash flow--assuming
you even believe the numbers.

balmy afternoon in Southern California, arrayed in neat rows and
wearing brand new Nikes, Nick Matzorkis became instantly famous.

Soon he'd sold rights to the story of the cult suicide to the
Hollywood entertainment company for which both he and some of the dead
cultists worked. It was a smart move.
But fame can be a two-edged sword, and Matzorkis wound up suffering
the twin fates common to people in certain circles in L. A.: a

Fifteen months ago, Red Herring columnist Christopher Byron advised
readers to avoid the stock of GenesisIntermedia (Nasdaq: GENI), a
company involved in a bizarre collection of businesses that included
car rentals, telemarketing, and Web kiosks. There were also apparent
ties to drug dealers (see "The Contrarian," November 2001). Those who
followed his advice would have saved at least the cost of an eight
ball.

His recommendation was based less on the company's financial prospects
(although they were dubious) than on an uncomfortable feeling brought
on by the cast of shady characters that seemed to be floating in its

two convicted drug dealers (one dead), a Colombian cocaine hit squad,
and others with ties to the Iran-Contra scandal.

Amazingly, a recent lawsuit suggests that he hadn't even uncovered all
the malefactors. The case, which was filed last fall on behalf of MJK
Clearing, a subsidiary of Minnesota brokerage StockWalk Group, points
a finger directly at the Toronto branch of Deutsche Bank and a
recently fired broker named Wayne Breedon. Other colorful defendants:
Mr. Khashoggi; Ramy El-Batrawi, the former CEO of GenesisIntermedia;
Bradford Keiller, the owner of a Las Vegas strip club; and ten people
referred to as "John Does 1-10."

According to the suit, Mr. Breedon and his co-conspirators engaged in
fraudulent stock loans using Genesis shares, bringing down StockWalk
in the process. The firm's collapse last year was the largest of a
brokerage in 30 years.
