I believe the regulations you've cited only apply to people that are still on the payroll of the U.S. military. I doubt the retard you've photographed is still involved with any branch of the armed forces. There's a possibility he's never been in the U.S. military, either.
I think the penalty is worse if you are no longer active military or reserve.
Didn't Olie North testify before congress in uniform after he was discharged? Somehow I remember him doing so at the time and had thought it was curious.
It's a United Staes Naval uniform. Not Army.
He already identified it as Navy and the UCMJ is, well, you know; 'U' as in universal.

When my father was stationed at an Army base in California during World War II he and some fellow soldiers say a group of men in Army uniforms board a bus and get driven away. Nothing unusual about that, except that there "was something odd about their uniforms" that no one could put their finger on. Later it turned out to be Errol Flynn and some other actors making the war movie The Burma Road. Maybe the guy in the photo was a fugitive from some movie or tv set. Probably not, though.
