McCrae’s case given to public defender

A California judge appointed a public defender Tuesday morning for a former Springfield man charged in the slaying of a police officer.

Andrew H. McCrae's arraignment hearing was continued until 8 a.m. Feb. 25 in Tehama County Superior Court. Judge Richard Scheuler appointed public defender James Reichle, who requested the continuance.

At the next hearing, McCrae should enter a plea and a preliminary hearing should be scheduled, said Rene Shuman, an assistant court clerk.

McCrae, 23, was extradited from New Hampshire to California after a judge dismissed a petition fighting his return. McCrae's attorney in New Hampshire, Mark Sisti, had argued that McCrae could not understand court proceedings and is mentally incompetent.

A judge ruled that competence is not an issue to consider at an extradition hearing and that McCrae's comments to his attorney, a doctor and the press showed that he understands the proceedings and is capable of discussing the facts.

In a telephone interview Jan. 14 with the Record Searchlight newspaper in Redding, Calif., McCrae reportedly said he understood everything that had happened in his case and wanted to fire Sisti.

McCrae was booked Jan. 29 into the Tehama County Jail and is being held without bail.

At a hearing Thursday, McCrae asked to represent himself with a public defender to assist him, Tehama County District Attorney Gregg Cohen said.

McCrae is charged with murder and murder of a police officer on duty and could face the death penalty if convicted.

He is accused of shooting Red Bluff, Calif., police Officer David Mobilio while he was on duty Nov. 19. Mobilio was shot twice in the side and once in the head while he fueled his patrol car.

Investigators believe McCrae confessed to the murder Nov. 25 on a San Francisco news Web site, www.indymedia.org. In one of two letters posted online, the writer identified as McCrae claims he shot and killed the officer to protest "police state tactics" and corporate irresponsibility. The writer claimed he is immune from prosecution because he incorporated himself in New Hampshire as a protest against corporations who "murder thousands of people each year."

McCrae, who legally changed his name from Mickel in November, is a 1998 graduate of North High School. He served three years in the Army before attending Evergreen State College in Olympia, Wash.

Ok. First, I would like to sincerely than the la imc "editorial" staff for simply altering the title of the thread. Other imc forums would have immediately deleted the post or sent it to the "hidden" archives. You guys do good work and I agree. The title I chose was a bit obtrusive.

I chose that title for two reasons. First, it was a shocking attention grabber. And second, it falls in line with the standard liberal dementia that compels most imc readers.

I want to get as much attention on this incident as possible, because it's an example of what dissidents should not allow themselves to fall into. Quite honestly, I believe that we all have to stand up for what we believe is right, and that's what the radical and progressive movements are really about. They shouldn't be about "revolution" or slaughtering innocent police officers. You guys spend so much time trying to incite people into action, and when an idiot carries it too far, we all just ignore it and turn you turn your back on him, like "gee umm Andy, that's not what we meant."

Sheepdog knows I don't want imc shut down. There are a lot of brilliant people that congregate here, assaulting each other with personal thoughts and opinions. And I like that.

What I really want is for people to be responsible for their actions and be in control of their selves.

And I'd also like for us here at la imc to cover this case. I'm greatly interested in the outcome, as I know sheepdog has expressed an interest as well.

And yes, I admit that I have indeed made some idle threats. I was pretty ticked off at the time. A bit out of control, my appologies.

But we of course can all recognize when a threat has some merit compelling it. I mean, if the imc forum has clean hands and is merely a means of offering "legitimate" debate, then obviously there's nothing to worry about when a nutcase such as myself hurls a stone at it. Right? No one should even break a sweat over him or his deluded opinions, let alone place a check mark next to his name in their little black books, should they? Or take offense when this obvious looney offers further criticisms?

But if, on the contrary, the imc network is a means by which radicals communicate their plans to deconstruct or destroy the system, a system that many of us hold dear, then things become a little more murky. More contributors get huffy. After all, they can't allow the reputation of their "project" to be tarnished. Heavens no. Silence the offender by deleting his posts, maybe because he is making some sense? Ban his IP? How should we deal with this individual?

And if in fact, IMC is truely a forum by which idiot radicals gloat about their acts of senseless violence, and incite others to the same deeds, well then perhaps more people should be getting ticked and hurling stones. That's just the opinion of a ranting weirdie though, so don't put too much though too it.

Which is it? The former I can live with, even though I might not agree. The latter is what disturbs me.

Forgot to banter on relentlessly about that...my bad.

I call them as I see them. Why do you care if I think you a liberal? Why does anyone care? Why would anyone care what I think of them?

Liberals are notoriously over-sensitive. And they hate the word "liberal". It's become some what of a pejorative to them for some reason. Or they don't want to be grouped in that category. They want to be known as radicals or anarchists or socialists, or anticorporate globalists, or whatever.

Who cares? I certainly don't care if you think me conservative. I freely admit that mostly, I am! If you want to think me a loon, an idiot, or whatever, to that too I say "please have a ball and knock yourself out!"

People take offense when I call them liberal because they are indeed a liberal. And they don't want anyone to know it.

When you rage against reason...you're a liberal.
When you call night "day", or black "white"...you're a liberal.
When you hold up signs and protest the obvious and overwhelming desires of the majority...you're a liberal. And let's talk about that one for a moment. The liberals are out right now, in full force with their cute little signs, coming out against the war. Even when so many people in this country think and believe, of their own free accord, that going into Iraq is the right thing to do. But then the liberals slant it further. They claim that "they" in fact are the "majority". After all, just look at how many people are in the streets with signs and posters!

Well only an idiot would protest "for" a war. That doesn't make the liberals "the majority" though. What it does make them ... are liberals.

And this argument about blood for oil. Let's talk about that. To Whom does that oil under Iraq belong? To claim that it belongs to Iraq just because they live atop it, is like saying you own the oxygen you're breathing right now. It's silly. It belongs to no one.

Let's put it another way. You bought those shoes on your feet, does that make them yours? I'd say yes. You traded something you earned (money) for them when you bought them. How did the Iraqis purchase that oil from the ground? They haven't. They found it. If you find a suitcase full of money in a dark alley, is it yours? Nope.

The key to "who owns the oil" is simple. It belongs to whomever is willing to fight for it, winner take all. That's human nature and that's the way it works. If someone comes up and lays claim to your shoes, you're either gonna give them up because they're not worth fighting for, or you're gonna fight for them.

There's a lot of good reasons America SHOULD go in there and take that oil. None more compelling than the fact that oil is money, and that much money should not be in the hands of a tyrant.

And if the UN doesn't like the fact that America is going into Iraq, then why don't they immediately assemble, and formally resolve against us? Another defining moment in the history of the UN, proving unequivocally that it is an impotent organization.

Thanks for your time. Don't forget to vote for me in 2004 as I, like so many others, have decided to run on the Democratic ticket. I figure I stand just as good a chance as any of them.

What Belongs to Whom

I support our Troops and President Bush's decision to take action in Iraq. What's in the ground in Iraq, USA, Mexico or anywhere in the world belongs to the that sovereign country. This doesn't mean they can doe as they damn well please with the resources that God has provide all mankind, but it does mean that they should be entitled to a fair compensation for the resource. As far as the air we breath and the water we drink, the countries it passes through have a responsibility to take care of it and let it move on cleanly. Iraqi oil belong to God and is under the stewardship of the Iraqi people.

Judge orders trial in Red Bluff cop death

The former college student from Olympia, Wash., is accused in the November slaying of the officer.

CORNING -- A judge ruled Wednesday that 24-year-old Andrew Hampton Mickel will stand trial in the murder of Red Bluff Police Officer David Mobilio.
The 31-year-old officer's widow and several family members, some weeping audibly, listened as Tehama Superior Court Judge Richard Scheuler handed Mickel over at the end of a one-day preliminary hearing.

The former college student from Olympia, Wash., sat quietly in his chair and paid rapt attention during the proceedings. He was shackled, but the chain on his right hand was longer so that he could jot notes on a yellow legal pad. He showed no reaction to the judge's ruling.

Tehama County District Attorney Gregg Cohen called six witnesses. First was Red Bluff Police Sgt. Ted Wiley, who had gone in search of Mobilio when he failed to respond to dispatchers after stopping to refuel his patrol car in the early morning hours of Nov. 19.

Wiley described driving to an unmanned fueling station at the northern edge of town and finding the officer face down near his vehicle, with his gun a few feet from his body. "I saw him lying on the cement. ... I could see a large amount of blood by his head," he said.

Dr. Thomas Resk, a forensic pathologist, said an autopsy revealed two additional gunshot wounds in the back. He testified that the shots to the back were fired first, and that Mobilio would have been face down with "the muzzle of the gun directly over the back of his head" when he sustained the final blow.

On cross-examination Mickel's defense attorney, James Reichle, vigorously challenged that scenario, but the pathologist did not waver in his conclusion.

Other witnesses described Mickel's odyssey through southern Oregon back roads where he flipped his car Nov. 19 in a place that Harney County (Oregon) Deputy Timothy Alexander called "high desert, with lots of sagebrush and kind of in the middle of nowhere."

A family at the nearby Whitehorse Ranch helped Mickel. Alexander later drove Mickel two-and-a-half hours to catch a bus in Burns. While searching Mickel's backpack, the deputy found a loaded gun, which he cleared through a database and returned to Mickel with the advice not to take it on the bus.

Jeff Lierly, special agent with the California Bureau of Investigation, testified that the woman in Burns who sold Mickel a ticket told Mickel to inform the bus driver about the gun. After he got on the bus, Mickel got off briefly and threw items into a trash bin. She retrieved the cast-offs, including the gun, all of which were later turned over to investigators, Lierly said.

Forensic specialists linked the gun to bullets that killed Mobilio and determined it was the same gun Mickel had purchased in 2002.

Mickel fled to Concord, N.H., where he was arrested Nov. 26. Mickel, who used the name Andrew Hampton McCrae at the time of his arrest, was a sophomore at Evergreen State College in Olympia, Wash., and an Army veteran.

During a hearing in February, Mickel told Scheuler that he admitted committing the act that resulted in Mobilio's death, but that he was pleading not guilty because he wanted to go to trial to show that it was "a valid and justified action."

Cohen asked that the unusual plea be added as part of the preliminary hearing, along with a typed portion of an interview that Mickel gave to a Redding TV reporter.

Outside court, Reichle said his client "has not admitted guilt. He's made statements admitting responsibility for his actions."

Arraignment was set for June 9 in Tehama Superior Court in Red Bluff.

Documents describe accused cop killer

The former Springfielder charged with murdering a California police officer was involved in peace efforts in Israel, according to recently unsealed court documents.

Andrew Hampton Mickel traveled to Israel at about Christmas 2001 as part of a peace-oriented group that acted as human shields between the Israelis and Palestinians, according to a Nov. 26 inter-office communication written by then-Springfield Police Capt. Stephen P. Moody, who became Springfield's police chief Wednesday.

Mickel, 23, reportedly was frustrated by the Israelis' ability to circumvent the effort, Moody wrote in the document released by Tehama County Superior Court in California.

Moody wrote that Mickel's parents contacted a local defense attorney after the killing of the police officer in November.

"They related that they had been in telephonic contact with their son, and he had advised then that he had shot and killed a police officer in Red Bluff," Moody wrote.

Moody's narrative was filed in the California court and was made available after a records request by the Red Bluff Daily News.

Officer David Mobilio was ambushed at about 1:30 a.m. Nov. 19 while he fueled his patrol car. He was shot twice in the left side and once at close range in the back of the head.

Mickel reportedly contacted several people after the shooting, including Washington Post reporter Lois Raimondo, who reportedly is a family friend. She is a Wittenberg University graduate.

He told her he killed the officer and he needed to be arrested so the media would report the story, Moody wrote. Mickel reportedly said he was not afraid of going to jail for the rest of his life because he was exposing the injustice of the world.

Raimondo reportedly called Mickel's parents, Stanley Mickel, a Wittenberg professor of languages, and his wife, Karen, a mathematics professor at the University of Dayton. His father checked the Web site of the Red Bluff Police Division and found the killer's profile fit his son, Moody's document stated.

Andrew Mickel also telephoned both his brothers and his parents and reportedly told his parents that what he told Raimondo was true. He did not give them specific information about how he allegedly killed Mobilio, but he told his mother he disposed of the gun before he boarded a plane east, the document stated.

A .40-caliber handgun that could have been one of four makes, including a Sig Sauer, was used to shoot Mobilio, according to a Nov. 26 statement of probable cause written by California Bureau of Investigation Special Agent Jeff Lierly. A .40-caliber Sig Sauer handgun was registered to Andrew Mickel in Washington.

Andrew Mickel, 23, is a 1998 North High School graduate who served in the U.S. Army for three years. His father said he joined the service to provide discipline in his life and excelled in the mental and physical challenges, but also was turned off by the service, according to the inter-office police document.

He graduated from the Army's Ranger school, airborne school and jungle operations training school, and he served at Fort Benning, Ga., and Fort Campbell, Ky., Moody wrote.

He then began studying creative writing at Evergreen State College in Olympia, Wash., where he was a sophomore.

Moody's inter-office communication states Mickel's father said his son needs an opportunity to express his platform and described him as idealistic, intelligent and stubborn, with a wry sense of humor. He said his son believes "America is raping the world ... and is anti-globalization," Moody wrote.

Andrew Mickel's brother reportedly stated he "is acting as if he is in a movie and the media attention will cause the world to change."

A maroon 1992 Ford Mustang hatchback registered to Andrew Mickel in Washington potentially is linked to the crime. Two witnesses said they saw a maroon early-90s model Ford Mustang hatchback parked near the scene of the shooting at about 6:30 p.m. Nov. 18, the day before the killing, according to the probable cause statement. A cloth covered both license plates.

Another witness stated he was passed by a car with a brown cloth over the rear license plate at about 1:45 a.m. Nov. 19, about 15 minutes after the killing, according to the probable cause statement.

Andrew Mickel wrecked his car Nov. 19 in Oregon, according to a report in the Sacramento Bee. While deputies responded to the crash, a nearby resident invited Andrew Mickel in to shower and clean up. He was not arrested because deputies had no indication he was linked to a homicide, the Bee reported.

Investigators believe Mickel, who also uses the name McCrae, confessed to the murder on Nov. 25 on a San Francisco news Web site, www.indymedia.org. In one of two letters posted online, the writer identified as McCrae claims he shot and killed the officer to protest "police state tactics" and corporate irresponsibility. The writer claimed he is immune from prosecution because he incorporated himself in New Hampshire as a protest against corporations who "murder thousands of people each year" without being held accountable.

Andrew Mickel was arrested Nov. 26 at a Concord, N.H., hotel after several hours of negotiations with FBI agents and a phone interview with a Concord reporter.

He is being held without bail in a New Hampshire jail while he fights extradition. He has until Jan. 10 to file a petition contesting the validity of the California governor's warrant for his return.

He is charged with murder in California and could face the death penalty.

RED BLUFF — The confessed killer of a Red Bluff police officer is set to appear in Tehama County Superior Court on July 7 to enter a formal plea.

Andrew Mickel, 24, of Olympia, Wash., is accused of murdering Dave Mobilio, 31, on Nov. 19 as the officer was fueling his patrol car at a deserted Main Street gas station.

Mickel, also known as Andrew McCrae, had a preliminary hearing last month and has been ordered to stand trial for the officer's murder. Tehama County District Attorney Gregg Cohen has said he will seek the death penalty if Mickel is convicted.

Mickel, who was arrested at a Concord, N.H., motel a week after the shooting, has pleaded innocent to murder in order to get a trial, but has admitted to killing Mobilio, saying he did so to protest police tactics.
